THE ANIMALS (TRANSIT AND GENERAL) (IRELAND) ORDER OF 1913 AMENDMENT (IRISH FREE STATE) ORDER OF 1923.

THE Department of Agriculture and Technical Instruction, by virtue and in exercise of the powers vested in them under the Agriculture and Technical Instruction (Ireland) Act, 1899, the Diseases of Animals Acts, 1894 to 1914, and of every other power enabling them in this behalf, do, with the concurrence of the Minister for Agriculture hereby order:—

1 Application.

1. For the purposes of a more effective enforcement of the provisions of the Animals (Transit and General) (Ireland) Order of 1913 (in this Order referred to as the Principal Order) relating to the conveyance by sea of cattle, sheep and goats, and other ruminating animals and swine, the provisions of this Order shall apply in substitution for the provisions of Article 3 (iv), (viii), (ix) and (xiii), of the said Principal Order and in addition to every other provision of that Order relating to vessels and animals carried on vessels, to any vessel on which animals are carried direct from a port or place in that part of Ireland within the jurisdiction of the Irish Free State to any port or place outside of Ireland, Great Britain, the Channel Islands, or the Isle of Man, and to the animals carried on any such vessel.

2 Notice of Intended Exportation.

2. (i) Any person intending to ship an animal on a vessel to which this Order applies shall give such notice in writing of his intention as is hereinafter prescribed:

(ii) The notice shall be signed by the owner or consignor of the animal or by a person authorised by the owner or consignor in that behalf, and shall be sent by post or otherwise in time for its receipt not less than 48 hours before the time of intended shipment.

(iii) The notice as aforesaid shall be sent:—

(a) if the port of intended shipment is one of those named in the First Schedule to this Order, to the Officer named in the Schedule opposite the name of the port; or

(b) if the port of intended shipment be not one of those named in the Schedule, then to the Secretary, Department of Agriculture and Technical Instruction (Veterinary Branch), Government Building, Dublin.

(iv) The notice shall state:

(a) The name of the vessel on which the shipment of the animal or animals is intended;

(b) the name and address of the owner or charterer of the vessel;

(c) The port or place of proposed shipment;

(d) the number and kind of animals intended to be shipped;

(e) the date and approximate time at which the animal or animals will arrive at the place of proposed shipment;

(f) the name and address of the owner and of the foreign consignee (if any) of each animal, and the name of the port to which shipment is proposed;

(g) as to each of the animals the purpose for which it is exported;

(h) the estimated value of each animal.

PROTECTION OF ANIMALS.

3 Pens and Fittings of Vessels.

3. (i) Every animal in a pen shall have sufficient space to enable it to feed and drink and to lie down, rest, and rise during the voyage.

(ii) No pen shall exceed eleven feet in length and nine feet in breadth, and the stanchions of each pen shall be securely fastened to the deck by means of iron sockets or otherwise, and the materials used in the construction of the pens shall be of a substantial character, and of sufficient strength to withstand the action of the weather, and to resist the weight of the animals thrown against them.

Passage Ways.

(iii) Between every two rows of animals, and in front of every single row of animals, there shall be a passage-way of a minimum width of one foot and six inches, which passage-way shall be kept free of obstruction.

Food and Water.

(iv) The vessel shall be provisioned with a quantity of food and water sufficient for the feeding and watering of the animals during the voyage, and proper facilities shall be provided for enabling each animal to be adequately fed and watered whilst on board the vessel.

Bedding.

(v) The vessel shall carry a quantity of straw or other suitable material sufficient for the bedding of the animals whilst on board the vessel.

Attendance.

(vi) Every consignment of cattle shall be in charge of a responsible foreman who shall have under him competent assistants numbering, with himself, one for every thirty head of cattle; and proper and suitable accommodation shall be provided for all persons carried on a vessel as attendants on animals.

Securing of Cattle.

(vii) All cattle whether polled or not, while being carried on the vessel shall be securely tied by the head or neck in such manner as not to cause unnecessary suffering and so as to stand athwartships.

4 Carriage of Cows in Calf.

4. No cow shall be permitted by the owner thereof or his agent, or any person in charge thereof, to be embarked on a vessel to which this Order applied if the calving of the cow on the vessel is reasonably probable.

CLEANSING AND DISINFECTION.

5 Vessels and Apparatus.

5. Notwithstanding compliance with the provisions of Articles 18 and 20 of the Principal Order it shall be unlawful, unless and until the written authorisation of an Inspector of the Department has been obtained, to land at any place in Ireland within the jurisdiction of the Irish Free State from a vessel to which this Order applies any of the things required by the said provisions to be cleansed or disinfected, any of the sweepings or scrapings resulting from any cleansing process therein prescribed or any of the dung, litter, or other matter referred to therein.

6 Fodder and Litter.

6. Partly consumed or broken fodder that has been supplied to and litter that has been used for or about animals carried on a vessel to which this Order applies shall not be landed at any place in Ireland under the jurisdiction of the Irish Free State unless and until it has been well mixed with quicklime and the written authority of an Inspector for its landing has been obtained, and when landed under such authorisation it shall forthwith be effectually removed from contact with animals: Provided that if the vessel has come from a country included at the time in the Schedule to the Foreign Hay and Straw (Ireland) Order of 1912 the provisions of that Order shall apply to all hay and straw on board the vessel.

7 Disinfection of Attendants.

7. Every person carried as an attendant on animals on a vessel to which this Order applies shall on returning to Ireland have himself and his clothes disinfected before leaving the wharf at the port of landing, and every such person and any other person on the vessel who has been or, in the opinion of an Inspector of the Department, is likely to have been in contact with animals either on the vessel or in any port or place outside of the British Islands, shall if required by the Inspector submit himself and his clothes to disinfection under the Inspector's supervision.

GENERAL.

8 Offences.

8. If any animal in respect of the intended shipment of which notice is not duly given in accordance with this Order be carried on a vessel, or if any animal to which the Order applies be carried on a vessel which does not conform to the provisions of this Order, or if anything is omitted which by the Order is required to be done, or if anything be done which by this Order is forbidden to be done, or if anything be landed without a Licence or written authority contrary to the requirements of this Order, or contrary to the conditions of such Licence or written authority, the owner of the animal or thing, and the owner and the charterer and the Master of the vessel, and the owner of the thing landed, shall each according to and in respect of his own acts and defaults be deemed guilty of an offence against the Diseases of Animals Act of 1894.

9 Interpretation.

9. Except that in this Order "Calf" means a bovine animal not exceeding six months old, all terms used in this Order and defined in the Principal Order, have the same meaning as in the Principal Order, and all other terms have the same meaning as in the Diseases of Animals Act, 1894.

10 Commencement.

10. This Order shall come into operation on the date hereof.

11 Short Title.

11. This Order may be cited as the Animals (Transit and General) (Ireland) Order of 1913 Amendment Order of 1923.
