FOOT AND MOUTH DISEASE (IMPORTED PACKING) ORDER OF 1923.
|

(Dated 7th December, 1923).
|
| |
THE Department of Agriculture and Technical Instruction, by virtue and in exercise of the powers vested in them under the joint operation of the Agriculture and Technical Instruction (Ireland) Act, 1899, and of the Diseases of Animals Acts, 1894 to 1914, and of every other power enabling them in this behalf, do, with the concurrence of the Minister for Agriculture, hereby order:—

1. In this Order—
|
| |
(1) The expression "imported packing" means hay or straw or other material, capable of being used as fodder or litter for animals or for farm manure, which has been used in the packing of merchandise brought from any country out of Ireland except the countries mentioned in the Schedule to this Order;

(2) The expression "animals" means cattle, sheep, goats, other ruminating animals or swine;
|
| |
(3) The expression "Act of 1894" means the Diseases of Animals Act, 1894.
|

2 Disposal of Imported Packing.
|
2. All imported packing shall be destroyed by fire at the place of unpacking, or disposed of otherwise in such manner as effectually to prevent it from being used for or about animals or as manure on a farm in Saorstát Eireann.

3 Use prohibited.
|
3. It shall be unlawful for any person to use or permit the use of imported packing for or about animals or as manure on a farm.
|
|
4 Offences.
|
4. (1) Any person who, being the owner or the receiver, or the agent or servant of the owner or the receiver of imported packing, disposes or permits, or assists in the disposal, of such imported packing otherwise than by fire, without making reasonably certain that it shall not subsequently be used contrary to the foregoing Article, shall, each in respect of his own acts and defaults, be deemed guilty of an offence against the Act of 1894.

(2) Any person who, being the owner, or the agent or the servant of the owner of an animal or the owner or tenant of a farm, uses or permits the use of imported packing contrary to the foregoing Article shall each in respect of his own acts and defaults be deemed guilty of an offence against the Act of 1894.

5 Local Authority to enforce Order.
|
5. The provisions of this Order shall be executed and enforced by the Local Authority.

6. This Order shall come into operation forthwith.
|

7 Short Title.
|
7. This Order may be cited as the Foot and Mouth Disease (Imported Packing) Order of 1923.
