DUBLIN METROPOLITAN POLICE. THE DUBLIN METROPOLITAN POLICE PENSIONS ORDER, 1924.

By virtue and in exercise of the powers conferred by Section 4 of the Constabulary and Police (Ireland) Act, 1919, as adapted by the Adaptation of Enactment Act, 1922, and of all other powers enabling me in that behalf, I, CAOIMHGHIN O H-UIGIN, Minister for Home Affairs, with the concurrence of the Minister for Finance, do hereby order as follows :—

1. Where any member of the Force, who was serving as such on the 6th December, 1921, retires on or after the date of commencement of this Order under circumstances qualifying him for the grant of an ordinary pension or gratuity, and his annual pay at the date of retirement is less than his annual pay on the 29th day of February, 1924, there shall be added to the pension or gratuity for which the member is qualified under the Pensions Order, 1922, a supplementary pension or gratuity calculated at one-fiftieth or one-sixtieth (according as the ordinary pension is calculated in fiftieths or sixtieths) in the case of pension and at one-twelfth in the case of gratuity of the excess of the annual pay at the 29th February, 1924, over the annual pay at the date of retirement for each year of " Pensionable service " completed on the 29th February, 1924, provided however that no such supplementary pension shall exceed two-thirds of such excess and provided further that no member of the Force to whom the scale of ordinary pensions prescribed by the Pensions Order, 1922, does not apply who retires before he has completed 30 years of service and attained the age of 50 years shall receive any pension greater than that to which he would have been entitled if this Order had not been made.

2. (1) For the purposes of this Order, each completed year of approved service from the twenty-first such year to the twenty-fifth inclusive (in the case of a pension calculated in fiftieths) and each completed year of approved service from the twenty-first such year inclusive onwards (in the case of a pension calculated in sixtieths) shall be reckoned as two completed years of " personable service," but each other completed year of approved service shall be reckoned as one completed year of " pensionable service."

(2) For the purposes of this Order, " annual pay on the 29th February, 1924," means the pay on which pension or gratuity would have been calculated had the member of the force retired on grounds of ill-health on that date.

3. In the case of any member of the force who retires on or after the date of commencement of this Order " annual pay " at the date of retirement shall not exceed the annual amount actually received by the member at the date of his retirement and subject to this maximum limit shall be calculated as provided in Paragraph 20, Part III., of the First Schedule to the Pensions Order, 1922.

4. In this Order, the Pensions Order, 1922, means the Dublin Metropolitan Police Pensions Order, 1922, made on the 16th day of March, 1922.

5. This Order shall take effect as from the 1st day of March, 1924, and that date shall be deemed to be the date of commencement of this Order.

6. (1) This Order may be cited as the Dublin Metropolitan Police Pensions Order, 1924, and this Order and the Dublin Metropolitan Police Pensions Order, 1922, may be cited together as the Dublin Metropolitan Police Pensions Orders, 1922 and 1924.

(2) This Order shall be read as one with the Dublin Metropolitan Police Pensions Order, 1922.
