THE WEIGHTS AND MEASURES FEES ORDER, 1924, DATED 14TH APRIL, 1924, MADE BY THE MINISTER FOR INDUSTRY AND COMMERCE PRESCRIBING THE FEES TO BE TAKEN BY THE MINISTRY.
1. The Minister for Industry and Commerce under the powers conferred by Section 39 of the Weights and Measures Act, 1878 41 & 42 Vict., c. 49) ; Section 8 of the Weights and Measures Act, 1889 (52 & 53 Vict., c. 21) ; Sections 6 and 8 of the Weights and Measures Act, 1904 (4 Edw. 7, c. 28) ; and Section 14 of the Gas Regulation Act, 1920 (10 & 11 Geo. 5, c. 28) ; and with the approval of the Minister for Finance, has determined that the Fees to be taken by the Ministry shall be those set out in the accompanying Schedule.
2. This Order may be cited as the Weights and Measures Fees Order, 1924.

Notes to Part A.
|
| |
(1) The above fees provide for the verification and testing of Standard appliances in which a greater degree of accuracy is required than is specified in the Weights and Measures Regulations, 1907 (a), for traders' appliances. Where the Schedule provides for verification or testing in the two Classes A. and B., the applicant should state in which class he wishes the apparatus to be dealt with. The Ministry of Industry and Commerce may, in any case where they think fit, determine the class of test to be applied to any weight, measure or instrument submitted.

(2) For tests or examinations not covered by the Schedule, fees will be fixed by the Ministry of Industry and Commerce according to the circumstances of the case.
|

(3) Full fees are charged in every case where rejection follows a completed test, but a refund of half the fee may be allowed where the rejection is based on inspection or on a preliminary test.

Notes to Part B.
|
| |
(1) The above fees cover (1) such examination and testing of appliances, with reference to the material of which and the principle on which they are constructed, as may be necessary to satisfy the Ministry of Industry and Commerce that the pattern is not such as to facilitate the perpetration of fraud; (2) testing for accuracy in accordance with the appropriate limits of error prescribed by the Weights and Measures Regulations, 1907; (3) issue of certificate (where issuable).

(2) The application for examination must be accompanied by a clearly defined engraving or drawing with detailed specification of the pattern, and such engraving, drawing and specification shall be retained by the Ministry. A copy of the pattern may also be retained on deposit by the Ministry for such period as may be deemed advisable.

(3) For patterns not included in the Schedule, fees will be fixed by the Ministry of Industry and Commerce according to the circumstances of the case.
|
| |
(4) Where a pattern after submission is withdrawn for minor modifications, or where a pattern, after approval, is subsequently modified in detail only, the Ministry may, if they think fit, undertake the examination of the modified form of one-half the normal fee.

PART C.
|
| |
Miscellaneous.
|
| |
I.—EXAMINATION OF APPLIANCES IN DISPUTE, ETC.
|
| |
In special cases where the Ministry of Industry and Commerce undertake, in disputed cases or otherwise, to examine the accuracy or efficiency of any weight, measure or weighing or measuring instrument purporting to be either of a pattern for which the Ministry of Industry and Commerce have issued a certificate under Section 6 of the Weights and Measures Act, 1904, the fee payable shall be one-fifth of the corresponding fee as determined under Part B.

1. All standards and apparatus must be delivered unpacked, and where necessary, erected and adjusted ready for examination and test.
|
| |
2. Where, in the opinion of the Ministry of Industry and Commerce, it is necessary to conduct an examination or test in situ, or where, at the request of the applicants, they agree to do so, the expenses incurred by the Ministry and their officers will be payable in addition to the above fees.
