ADAPTATION (LICENCE DUTIES AND LOCAL GRANTS) ORDER, 1924. | ||
[Extract from Iris Oifigiúil, April 25, 1924.] | ||
WHEREAS by sub-section (2) of section 20 of the Local Government (Temporary Provisions) Act, 1923 , it is provided that the Minister for Local Government may by Order make such adaptations of any existing enactment relating to any matter dealt with or affected by the said Act as appear to him necessary or expedient for carrying into effect the said Act or the county schemes made thereunder: | ||
AND WHEREAS sub-section (2) (a) of Section 58 of the Local Government (Ireland) Act, 1898, as amended by sub-section (1) of Section 5 of the Local Government (Ireland) Act, 1902, is an existing enactment relating to the payment out of the Local Taxation (Ireland) Account of sums towards the salaries of the officers of Boards of Guardians therein specified: | ||
AND WHEREAS the said payment is a matter affected by the said local Government (Temporary Provisions) Act, 1923 : | ||
AND WHEREAS it appears to me, the Minister for Local Government, necessary and expedient for carrying into effect the said Local Government (Temporary Provisions) Act, 1923 , and the County Schemes made thereunder, to make the adaptations hereinafter specified in the said sub-section (2) (a) of Section 58 of the Local Government (Ireland) Act, 1898, and in the said sub-section (1) of Section 5 of the Local Government (Ireland) Act, 1902: | ||
NOW THEREFORE I, the Minister for Local Government, in exercise of the powers conferred on me by the said sub-section (2) of Section 20 of the Local Government (Temporary Provisions) Act, 1923 , and of all other powers thereto enabling me do hereby order as follows:— | ||
1. Sub-section 2 (a) of Section 58 of the Local Government (Ireland) Act, 1898, shall, in so far as it applies to the Councils of Counties to which County Schemes relates, be adapted so as to read as follows:— | ||
" To the Council of each County to which a County Scheme relates, for the purpose of such County Scheme, the following amounts towards the salaries approved by the Minister for Local Government, of the following officers, namely: | ||
(i) One-half of the said salaries of the Medical Officers of the County Home, County or District Hospitals and Dispensaries provided or maintained under or in pursuance of such County Scheme, and | ||
(ii) One-half of the said salary of one trained nurse in each County Home, County or District Hospital in such County who is actually employed under or in pursuance of such County Scheme, and possesses the prescribed qualifications, and | ||
(iii) The whole of the said salaries of schoolmasters or school-mistresses who are actually employed under or in pursuance of such County Scheme, | ||
and also one-half of the cost of such medicines and medical and surgical appliances as are provided in accordance with the prescribed conditions." | ||
2. Sub-section (1) of Section 5 of the Local Government (Ireland) Act, 1902, shall in so far as it applies to the Councils of Counties to which County Schemes relate, be adapted by the substitution therein for the words "by the Guardians of a Union" of the words "under or in pursuance of a County Scheme" and the substitution for the words "of a workhouse or dispensary" of the words "employed under or in pursuance of a County Scheme." | ||
3. In the adaptations made by this Order the expression "County Scheme" shall have the same meaning as in the Local Government (Temporary Provisions) Act, 1923 . | ||
4. This Order may be referred to as the Adaptation (Licence Duties and Local Grants) Order, 1924. | ||
