THE IRISH LAND COMMISSION (RE-DISTRIBUTION OF PUBLIC SERVICES) ORDER, 1927. | ||
WHEREAS by virtue of paragraphs (vi) and (viii) of section 1 of the Ministers and Secretaries Act, 1924 (No. 16 of 1924) the Irish Land Commission (including the Agricultural and Land Branches but excluding the Fisheries and Rural Industries Branches of the late Congested Districts Board for Ireland) is now included in the Department of Lands and Agriculture and so much of the functions of the Irish Land Commission as consists of or represents the Fisheries and Rural Industries Branches of the late Congested Districts Board for Ireland is now included in the Department of Fisheries: | ||
AND WHEREAS it is enacted by sub-section (2) of section 12 of the said Ministers and Secretaries Act, 1924 , that it shall be lawful for the Executive Council from time to time by order to re-distribute all or any of the public services and officers and the administration, jurisdiction, powers, duties and functions thereof amongst the several Ministers and Departments of State or any of them in any manner which may seem to the Executive Council to be expedient or proper in the public interests, and to make such orders consequential on or necessary for giving effect to any such re-distribution as the Executive Council may consider expedient or proper: | ||
AND WHEREAS it seems to the Executive Council to be expedient in the public interests that such of the public services of the Irish Land Commission as are now included in the Department of Lands and Agriculture should be re-distributed and transferred to the Department of Fisheries, and the Executive Council considers that the provisions hereinafter contained consequential on or necessary for giving effect to such re-distribution are expedient and proper: | ||
NOW the Executive Council of Saorstát Eireann in exercise of the power conferred on them by sub-section (2) of section 12 of the Ministers and Secretaries Act, 1924 (No. 16 of 1924) and of every and any other power them in this behalf enabling do here by order as follows:— 1.— This Order may be cited for all purposes as the Irish Land Commission (Re-distribution of Public Services) Order, 1927. 2.— This Order shall come into operation on the 22nd day of July, 1927. 3.— The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of this Order in the like manner as it applies to the interpretation of an Act of the Oireachtas. 4.— So much of the public services and officers of the Irish Land Commission and the administration, jurisdiction, powers, duties and functions thereof as are now included by the said Ministers and Secretaries Act, 1924 , or otherwise in the Department of Lands and Agriculture are hereby transferred to the Department of Fisheries to the intent that the whole of the public services and officers of the Irish Land Commission (including the late Congested Districts Board for Ireland) shall be included in the Department of Fisheries and that the whole of the jurisdictions, powers, duties and functions of the Irish Land Commission (including as aforesaid) and the exercise and performance thereof shall become and be subject to the direction and control of the Minister for Fisheries, and that that Minister shall become and be responsible for the administration of the services of the Irish Land Commission (including as aforesaid). 5. Every mention or reference contained in any Act of the Oireachtas passed before the coming into operation of this Order or in any order, rule, or regulation made under any such Act or under any British Statute of or to the Minister for Lands and Agriculture in relation to the Irish Land Commission and every mention or reference contained in any such Act, order, rule, or regulation which has relation to the Irish Land Commission and is required by section 18 of the said Ministers and Secretaries Act, 1924 , to be construed as a mention of or reference to the Minister for Lands and Agriculture shall, in so far as the same has relation to the Irish Land Commission, be construed and have effect as a mention of or reference to the Minister for Fisheries. | ||
