STATUTORY RULES AND ORDERS. 1931. No. 8.ORDER OF THE DEPARTMENT OF AGRICULTURE AND TECHNICAL INSTRUCTION FOR IRELAND.

THE SHEEP DIPPING (Local Regulations) ORDER OF 1931

(Dated 23rd January, 1931.)

The Department of Agriculture and Technical Instruction for Ireland, by virtue and in exercise of the powers in them vested under the Agriculture and Technical Instruction (Ireland) Act, 1899, the Diseases of Animals Acts, 1894 to 1914, and of every other power enabling them in this behalf, do, with the concurrence of the Minister for Agriculture, hereby order :—

1 Powers of a Local Authority as to making Regulations.

1.—A Local Authority may, with a view to a better execution and enforcement in their district of the provisions of the Sheep Dipping (Ireland) Order of 1915 (hereinafter called the Principal Order), make such Regulations as they think fit for the following purposes, that is to say :—

(a) For requiring that any dipping or double dipping of sheep prescribed in the Principal Order shall be carried out under such conditions and at such time and place or times and places as may be specified in a Notice signed by an Inspector of the Local Authority and served by post or otherwise on the owner or person in charge of the sheep referred to in the Notice ;

(b) for requiring documentary evidence of dipping, in compliance with the regulations, to be furnished by the owner or person in charge of sheep to such person, at such time, in such form, and with such particulars, as may be prescribed by the regulations ;

(c) for requiring, notwithstanding the provisions in Article 7 of the Principal Order, that sheep moved into or exposed for sale in any fair, market, or saleyard during the periods each year from the first day of July to the thirty-first day of August, both dates inclusive, and from the first day of September to the fifteenth day of November, both dates inclusive, shall be accompanied by such documentary evidence of dipping, in compliance with the regulations, as may be prescribed by the regulations ;

(d) for requiring that the owner and the person in charge of sheep, shall comply with all reasonable requirements of an Inspector of the Local Authority as to the collection, penning, and dipping of such sheep.

2 Regulations as to Fairs, Markets and Saleyards.

2.—Notwithstanding the provisions in Article 7 of the Principal Order requiring that a Declaration as prescribed therein shall accompany sheep moved into or exposed for sale in any fair, market, or sale-yard within the periods specified therein, no such declaration shall be necessary in the case of sheep which are accompanied at the time of such movement or exposure in the administrative area of a Local Authority by such documentary evidence of dipping as may be prescribed by the regulations of that Local Authority.

3 Notice of Intention to dip.

3.—Notwithstanding anything in the Principal Order requiring the owner or person in charge of sheep to give notice of his intention to dip his sheep, no such notice shall be necessary with regard to any dipping required, in accordance with Regulations made under this Order, to be carried out at a specified time and place.

4 Powers of the Department.

4.—Any powers exercisable under a Regulation made by a Local Authority under this Order by a Veterinary Inspector acting for a Local Authority shall be exercisable also by a Veterinary Inspector of the Department.

5 Provisions as to Regulations of Local Authority.

5.—(1) A Local Authority shall forthwith send to the Secretary, Department of Agriculture and Technical Instruction for Ireland, Dublin, a copy of every Regulation made by them under this Order.

(2) If the Department are satisfied, on inquiry, with respect to any Regulation or part of a Regulation made by a Local Authority under this Order, that the same is for any reason objectionable, and direct the revocation thereof, the same shall thereupon cease to operate.

(3) For the purpose of any Regulation made by a Local Authority under this Order, an Inspector of such Local Authority may, subject to their direction, enter any premises within the district of the Local Authority and examine any sheep thereon, and such powers of entry and examination shall be in addition to any other like powers vested in the Inspector by the Act of 1894 or otherwise.

6 Power to make Regulations not to be deputed.

6.—The power to make Regulations under this Order shall be exercised only by a Local Authority or their Executive Committee; and shall not be deputed to any other Committee nor to a Sub-Committee.

7 Limitation as to Regulations of Local Authority.

7.—No Regulation made by a Local Authority under this Order shall apply to sheep moved by railway through the District of the Local Authority from a place outside the District—

(a) To another place outside the District without unnecessary delay and without the sheep being untrucked within the District ; or

(b) direct to a port within the District or to a lair at such port for shipment from such port within two days.

8 Offences.

8.—If anything is done or omitted to be done in contravention of any Regulation made by a Local Authority under this Order, the owner and the person in charge of any sheep in respect of which the same is done or omitted to be done, and the lessee and the occupier of the place in which such sheep are located shall, each according to and in respect of his own acts and defaults, be deemed guilty of an offence against the Diseases of Animals Act, 1894.

9 Interpretation.

9.—In this Order, "Inspector" includes Veterinary Inspector and any person appointed an Inspector by a Local Authority under the Sheep Dipping (Appointment of Inspectors) (Ireland) Order of 1915 ; "The Department" means the Department of Agriculture and Technical Instruction for Ireland.

10 Commencement.

10.—This Order shall come into operation on and from the date hereof.

11 Revocation of Order.

11. —The Order described in the Schedule to this Order is hereby revoked.

12 Short Title.

12.—This Order may be cited as the SHEEP DIPPING (LOCAL REGULATIONS) ORDER OF 1931, and shall be read as one with the Principal Order.
