DAIRY PRODUCE (BUTTER RETURNS) REGULATIONS, 1931.

WHEREAS it is enacted by subsection (1) of section 8 of the Dairy Produce Act, 1931 (No. 29 of 1931), that the Minister for Agriculture may by Order make regulations in regard to any matter or thing referred to in the said Act as prescribed, or as being or to be prescribed;

AND WHEREAS these regulations relate to matters and things referred to in the said Act as prescribed.

NOW I, PATRICK HOGAN, Minister for Agriculture, in exercise of the powers conferred on me by the Dairy Produce Act, 1931 (No. 29 of 1931), and of every and any other power me in this behalf enabling do by this Order make the following regulations, that is to say—

1. These regulations may be cited as the Dairy Produce (Butter Returns) Regulations, 1931.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In these regulations the expression "the Act" means the Dairy Produce Act, 1931 (No. 29 of 1931).

4. For the purposes of the following provisions of the Act, that is to say, paragraph (b) of subsection (1) of section 4, paragraph (b) of subsection (2) of section 4, and paragraph (b) of subsection (3) of section 4, each of the following periods shall be a prescribed period, namely—

(a) the period between the 1st day and the 15th day of every month, both days inclusive, and

(b) the period between the 16th day and the last day of every month, both days inclusive.

5. For the purposes of the following provisions of the Act, that is to say, paragraph (a) of subsection (1) of section 4, paragraph (a) of subsection (2) of section 4, and paragraph (a) of subsection (3) of section 4, a return in the form set out at No. 1 in the Schedule hereto and containing the particulars asked for or otherwise indicated in such form in relation to the date specified in the returns notice requiring such return to be made shall be a prescribed return.

6. For the purposes of paragraph (b) of subsection (1) of section 4 of the Act, each of the following returns shall be a prescribed return, that is to say—

(a) a return in the form set out at No. 2 in the Schedule hereto and containing the particulars asked for or otherwise indicated in such form in relation to the prescribed period to which such return relates;

(b) a return in the form set out at No. 3 in the Schedule hereto and containing the particulars asked for or otherwise indicated in such form in relation to the prescribed period to which such return relates;

(c) a return in the form set out at No. 4 in the Schedule hereto and containing the particulars asked for or otherwise indicated in such form in relation to the prescribed period to which such return relates;

(d) a return in the form set out at No. 5 in the Schedule hereto and containing the particulars asked for or otherwise indicated in such form in relation to the prescribed period to which such return relates.

7. For the purposes of paragraph (b) of subsection (2) of section 4 of the Act, a return under the said paragraph shall be in the form set out at No. 4 in the Schedule hereto and shall contain the particulars asked for or otherwise indicated in such form in relation to the prescribed period to which such return relates.

8. For the purposes of paragraph (b) of subsection (3) of section 4 of the Act, a return under the said paragraph shall be in the form set out at No. 5 in the Schedule hereto and shall contain the particulars asked for or otherwise indicated in such form in relation to the prescribed period to which such return relates.

* In the case of a creamery from which butter is sent to a store owned by the same proprietor, under such conditions that the manager of the creamery is not responsible for the subsequent disposal of the butter, the quantity sent to such store should be shown under "Other Disposals," and any butter received therefrom should be shown under "Other Acquisitions." The address of the store should be given.

The address of the store should be given.
