WILD BIRDS (COUNTY KERRY) ORDER, 1933. | ||
WHEREAS it is enacted by sub-section (1) of section 7 of the Wild Birds Protection Act, 1930 (No. 16 of 1930), that the Minister for Justice may, by order made on the application of the Council of a county or a county borough, prohibit for reasons stated in such application, the taking or destroying either generally or in any particular years or year in such county or county borough or any particular parts or part thereof of the eggs of any wild birds whatsoever or any particular kinds or kind of wild bird : | ||
AND WHEREAS the Council of the County of Kerry has applied to the Minister for Justice, because of the rarity of the birds concerned and the attraction they provide, to make an order prohibiting in each of the years 1933, 1934, 1935, 1936 and 1937 in the County of Kerry the taking or destroying of the eggs of any of the following wild birds, that is to say :—golden eagle, sea eagle, peregrine falcon, merlin, kestrel, harriers (all kinds), raven, kingfisher, owls (all kinds), siskin, goldfinch, terns (all kinds), petrels (all kinds), woodcock, snipe, hoopee, phalaropes (all kinds) and chough : | ||
NOW, I, P. J. RUTTLEDGE. Minister for Justice, in exercise of the powers conferred on me by section 7 of the Wild Birds Protection Act, 1930 (No. 16 of 1930), and of every and any other power me in this behalf enabling, do hereby because of the rarity of the birds concerned, and the attraction they provide, order as follows :— 1. This Order may be cited for all purposes as the Wild Birds (County Kerry) Order, 1933. 2. The Interpretation Act, 1923 , (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas. 3. No person shall in any part of the County of Kerry take or destroy in any of the years 1933, 1934, 1935, 1936 and 1937, the eggs of any of the following wild birds, that is to say :—golden eagle, sea eagle, peregrine falcon, merlin, kestrel, harriers (all kinds), raven, kingfisher, owls (all kinds), siskin, goldfinch, terns (all kinds), petrels (all kinds), woodcock, snipe, hoopee, phalaropes (all kinds) and chough. | ||
