County Scheme Order, General Amendment, 1933.

COUNTY SCHEME ORDER, GENERAL AMENDMENT, 1933.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

WHEREAS the Minister for Local Government in exercise of the powers vested in him by the Local Government (Temporary p visions) Act, 1923 (hereinafter referred to as "the Act"), did by the orders mentioned in column II of Part I of the Schedule to this Order amend and modify the existing county schemes for the administration of the relief of the poor in the counties and county boroughs, the names of which are set out opposite thereto in column 1 of the said Part of the said Schedule in such manner as to bring such schemes into conformity with the provisions set forth in the Schedules to the said Orders and did substitute such provisions for the provisions of the said existing county schemes respectively:

AND WHEREAS the Minister for Local Government in exercise of the powers vested in him by the Act did by the Orders mentioned in column II of Part II of the Schedule to this Order confirm county schemes prepared and submitted to him under the Act for the administration of the relief of the poor in the counties and county boroughs the names of which are set out opposite thereto in column I of the said Part of the said Schedule with such modifications, omissions and additions as were necessary to bring such schemes into conformity with the provisions set forth in the Schedules to the said Orders:

AND WHEREAS the Minister for Local Government and Public Health did by the Orders mentioned in column III of Parts I and II of the Schedule to this Order further amend and modify the county schemes relating to the counties and county boroughs, the names of which are set out opposite thereto in column I of the said Parts of the said Schedule:

AND WHEREAS the county schemes above referred to have come into operation and the Minister for Local Government and Public Health deems it necessary further to amend such county schemes in manner hereinafter appearing, and has given to the councils of the counties and county boroughs to which such schemes relate one month's notice of his intention to make such amendment, and has taken into consideration any representations which have been made to him by such councils within such month in respect of such amendment:

NOW, THEREFORE, the Minister for Local Government and Public Health, in exercise of the powers vested in him by Section 5 of the Act, does by this his Order, order and direct as follows, that is to say:—

1. This Order may be cited as the County Schemes (General Amendment) Order, 1933, and shall come into operation on, from and after the date hereof.

2. The Interpretation Act, 1889, shall apply to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas passed before the 1st day of January, 1924.

3. In this Order the expression "board of assistance" means the body to which under a county scheme is entrusted the administration of the relief of the poor in the county or county borough to which such scheme relates.

4. The County Schemes relating to the counties and county boroughs, the names of which are set out in column I of Parts I and II of the Schedule to this Order as confirmed or amended by the Orders mentioned in columns II and III of the said Parts of the said Schedule shall be and are hereby amended in the manner and to the extent necessary to give effect to the provisions hereunder set forth and every such county Scheme shall be read and construed accordingly:—

(1) Notwithstanding anything contained in a County Scheme a board of assistance shall, in addition to any institutions authorised by the County Scheme, provide and maintain for the reception and maintenance of persons within their functional area eligible for relief, such additional institution or institutions as the Minister for Local Government and Public Health may by Order direct at such place or places within their functional area as may be specified in such Order.

(2) Notwithstanding anything contained in a County Scheme a board of assistance shall, if so required by Order of the Minister for Local Government and Public Health, remove any institution provided by them under the County Scheme from the place and premises at and in which such institution is provided to such other place within their functional area as shall be specified in such Order.

(3) A board of assistance shall not erect or provide any institution under a County Scheme save upon a site and in premises approved of by the Minister for Local Government and Public Health.

(4) A board of assistance shall when so required by Order of the Minister for Local Government and Public Health restore, alter, enlarge or improve any institution provided by them under a County Scheme in such manner as the Minister may by such Order direct.

(5) A board of assistance shall not erect, restore, alter, enlarge or improve any institution provided by them under a County Scheme save in accordance with plans and specifications approved of by the Minister for Local Government and Public Health.
