BUTTER (LEVY AND BOUNTY) (No. 6) ORDER, 1935.

WHEREAS it is enacted by section 18 of the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), that the Minister for Agriculture may from time to time by order make regulations prescribing the rates of levy under Part III of the said Act on creamery butter and non-creamery butter and may at any time by order revoke or amend any such order and may by any such order prescribe different rates of levy on different substances and on different classes (defined in such manner as the said Minister shall think proper) of any particular substance and the date on which any particular rate of levy shall come into force:

AND WHEREAS it is enacted by section 34 of the said Act that the Minister for Agriculture may from time to time by order make regulations prescribing the rates of bounty under Part VII of the said Act on creamery butter and non-creamery butter and may at any time revoke or amend any such order and may by any such order prescribe different rates of bounty on different substances and on different classes (defined in such manner as the said Minister shall think proper) of the same substance and the date on which any particular rate of bounty shall come into force:

AND WHEREAS it is enacted by section 35 of the said Act that the Minister for Agriculture may at any time by order declare that no bounty shall be payable under Part VII of the said Act on any specified substance or substances or on any specified class (defined in such manner as the said Minister shall think proper) of any particular substance exported from Saorstát Eireann after a specified date, and may at any time revoke such order either wholly or in respect of one or more substances or classes of substance.

NOW, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935), and of every and any other power me in this behalf enabling, do by this Order make the following regulations:-

1.-This Order may be cited as the Butter (Levy and Bounty) (No. 6) Order, 1935.

2.-The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.

3.-The Butter (Levy and Bounty) (No. 5) Order, 1935 (Statutory Rules and Orders, No. 18 of 1936) is revoked as on and from the 1st day of December, 1935.

4.-(1) The rate of levy on creamery butter shall be whichever of the following rates is applicable to any particular class of creamery butter, that is to say:-

(a) On creamery butter manufactured on or before the 31st day of August, 1935, which was put into cold store on or before the 19th day of October, 1935, under and in accordance with an arrangement sanctioned by the Minister for Agriculture, the rate of twenty-six shillings the hundredweight;

(b) On creamery butter manufactured on or after the 1st day of September, 1935, which was put into cold store on or before the 19th day of October, 1935, under and in accordance with an arrangement sanctioned by the Minister for Agriculture, the rate of nineteen shillings the hundredweight;

(c) On creamery butter manufactured on or after the 1st day of November, 1935, which was put into cold store on or before the 30th day of November, 1935, under and in accordance with an arrangement sanctioned by the Minister for Agriculture, the rate of twenty-three shillings and sixpence the hundredweight;

(d) On other creamery butter manufactured on or before the 30th day of November, 1935, the rate of twenty-eight shillings the hundredweight;

(e) On creamery butter manufactured on or after the 1st day of December, 1935, the rate of eighteen shillings and eight pence the hundredweight.

(2) The rates of levy mentioned in and prescribed by this paragraph shall come into force as on and from the 1st day of December, 1935.

5.-(1) The rate of levy on non-creamery butter shall be whichever of the following rates is applicable to any particular class of non-creamery butter, that is to say:—

(a) On non-creamery butter which was put into cold store on or before the 2nd day of November, 1935, under and in accordance with an arrangement sanctioned by the Minister for Agriculture, the rate of twenty-two shillings the hundredweight;

(b) On non-creamery butter to which the foregoing sub-paragraph (a) of this paragraph does not apply which was manufactured on or before the 30th day of November, 1935, the rate of twenty-eight shillings the hundredweight;

(c) On all other non-creamery butter the rate of eighteen shillings and eight pence the hundredweight.

(2) The rates of levy mentioned in and prescribed by this paragraph shall come into force as on and from the 1st day of December, 1935.

6.-The rate of bounty on creamery butter which is delivered on sale in Saorstát Eireann and on which a levy at the appropriate rate has been paid shall be eighteen shillings and eight pence the hundredweight and such rate shall come into force as on and from the 1st day of December, 1935.

7.-(1) No bounty shall be payable on creamery butter (other than creamery butter to which the foregoing paragraph 6 applies) exported from Saorstát Eireann after the 30th day of November, 1935.

(2) No bounty shall be payable on non-creamery butter exported from Saorstát Eireann after the 30th day of November, 1935.
