HOME GROWN WHEAT (DETERMINATION, OF CLASS) ORDER, 1936. | ||
WHEREAS it is enacted by sub-section (1) of section 14 of the Agricultural Produce (Cereals) Act, 1935 (No. 26 of 1935), that the Minister for Agriculture may, whenever and so often as he thinks fit, by order require that whenever any home-grown millable wheat is sold to a person, who is the holder of a milling licence or a registered distiller or a registered wheat dealer, the class to which such wheat belongs shall for the purposes of such sale be determined by means of an apparatus of the type or types specified in such order and by no other means: | ||
AND WHEREAS it is enacted by sub-section (4) of the said section 14 that the Minister for Agriculture shall before making any order under the said section 14, consult the Minister for Industry and Commerce in regard to the making of such order: | ||
AND WHEREAS the Minister for Agriculture has before making this order consulted the Minister for Industry and Commerce in regard to the making thereof: | ||
NOW, THEREFORE, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by subsection (1) of section 14 of the Agricultural Produce (Cereals) Act, 1935 (No. 26 of 1935), and of every and any other power me in this behalf enabling, hereby order as follows:— 1.—(1) This Order may be cited as the Home-grown Wheat (Determination of Class) Order, 1936. | ||
(2) This Order shall come into operation on the 1st day of September, 1936. 2.—The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas. 3.—For the purposes of this Order an apparatus of either of the following types shall be an apparatus of an approved type— | ||
(a) a weighing instrument of a type corresponding to the pattern of the weighing instrument certified, by the Minister for Industry and Commerce by Certificate numbered 152SE, under section 6 of the Weights and Measures Act, 1904; | ||
(b) a weighing instrument of a type corresponding to the pattern of the weighing instrument certified, by the Minister for Industry and Commerce by Certificate numbered 153SE, under section 6 of the Weights and Measures Act, 1904. 4.—Whenever any home-grown millable wheat is sold to a person, who is the holder of a milling licence or a registered distiller or a registered wheat dealer, the class to which such wheat belongs shall for the purposes of such sale be determined by means of an apparatus of an approved type and by no other means. | ||
