The Cement Act, 1933 (Part IV) Regulations Order, 1936, made by the Minister for Industry and Commerce pursuant to section 24 and section 26 of the Cement Act, 1933 . | ||
WHEREAS it is enacted by sub-section (2) of section 24 of the Cement Act, 1933 , that every application for a transport works order shall be accompanied by a draft of the proposed order, a plan, in the prescribed form, of the proposed transport works and a book of reference, in the prescribed form, to such plan. | ||
AND WHEREAS it is enacted by sub-section (2) of section 26 of the said Act that all fees received the Minister for Industry and Commerce under the said section of the said Act shall be collected and accounted for in such manner as shall be prescribed by the said Minister with the sanction of the Minister for Finance. | ||
AND WHEREAS it is enacted by section 6 of the said Act that the Minister may by order make regulations in relation to any matter or thing referred to in the said Act as prescribed. | ||
NOW, THEREFORE, the Minister for Education, acting as Agent for the Minister for Industry and Commerce, in exercise of the powers conferred on the Minister for Industry and Commerce by section 6 of the Cement Act, 1933 , and of every and any other power him in this behalf enabling makes by this order the following regulations, that is to say :— 1. This Order may be cited for all purposes as the Cement Act, 1933 (Part IV) Regulations Order, 1936. 2. The Interpretation Act, 1923 , shall apply to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas. 3. Words and expressions, defined or established by the Cement Act, 1933 , shall have the same meanings where they occur in this Order as in that Act. 4. In this Order the expression " the Act " means the Cement Act, 1933 . 5. The draft order to accompany every application for an order under Part IV of the Act shall be typewritten on foolscap paper and on one side only, and any schedule annexed shall commence on a new page. The name and address of the applicant and the names and addresses of the applicant's agents for the purposes of the application shall be shown on the outside of every draft order. 6. (1) The plan and book of reference to such plan to accompany every application for an order under Part IV of the Act shall be such plan (including sections and cross-sections) and book of reference as would be required by the Standing Orders of Dáil Eireann relative to Private Business to be deposited if the applicants, instead of applying for an order under Part IV of the Act, were proceeding by private Bill. | ||
(2) Every application shall be accompanied by an Ordnance Sheet with the exact position of the proposed works indicated thereon. 7. (1) The fee payable to the Minister on application for an Order under Part IV of the Act shall be lodged with the application, and shall be payable in the form of a Post Office Money Order payable to the Paymaster-General at the General Post Office, Dublin, and crossed " /& Co./ " or in the form of a cheque guaranteed by the bank on which it is drawn payable to the credit of the Paymaster General. | ||
(2) Every fee collected in respect of applications for orders under Part IV of the Act shall be paid into the Exchequer. | ||
