STATUTORY RULES AND ORDERS. 1936. No. 270.

FLAX ACT (FORMS) REGULATIONS, 1936.

WHEREAS it is enacted by Section 29 of the Flax Act, 1936 (No. 20 of 1936), that the Minister for Agriculture may by order make regulations prescribing any matter or thing referred to in the said Act as prescribed or to be prescribed:

AND WHEREAS the matters or things to which these regulations relate are matters and things which are referred to in the said Act as prescribed or to be prescribed:

NOW, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Flax Act, 1936 (No. 20 of 1936), and of every and any other power me in this behalf enabling, do by this Order make the following regulations, that is to say:—

1. These Regulations may be cited as the Flax Act (Forms) Regulations, 1936.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3.—(1) in these Regulations—

The expression " the Act " means the Flax Act, 1936 ;

The expression " the Minister " means the Minister for Agriculture.

(2) All references to registers shall, unless the context otherwise requires, be construed as references to the registers kept by the Minister in pursuance of the Act.

4. (1) Every application made under Section 5 of the Act for registration in the register of flax-growing premises by any person in respect of land which is in the occupation of such persons shall be in the Form Flax 1a set forth in the Schedule hereto, and the directions and instructions contained in or appended to such Form shall be complied with by every person who applies for registration in the said register.

(2) Every application made under Section 5 of the Act for registration in the register of flax-growing premises by any person in respect of land which is not in the occupation of such person shall be in the Form Flax 1b, set forth in the Schedule hereto, and the directions and instructions contained in or appended to such Form shall be complied with by every person who applies for registration in the said register.

5. Every application made under Section 6 of the Act for registration in the register of scutch-milling premises shall be in the Form Flax 2, set forth in the Schedule hereto, and the directions and instructions contained in or appended to such Form shall be complied with by every person who applies for registration in the said register.

6. Every application made under Section 5 or under Section 6 of the Act shall be sent to the Minister by being sent by post to the Secretary, Department of Agriculture, Dublin.

7.—(1) The return which shall be sent to the Minister by every registered proprietor of registered flax-growing premises under Section 12 of the Act shall be in the Form Flax 3, set forth in the Schedule hereto, and the entries which shall be made by every such registered proprietor shall be such as are indicated in the said Form.

(2) Every such return shall be sent to the Minister by being sent by post to the Secretary, Department of Agriculture, Dublin, so as to reach the said Secretary not later than the 28th day of February in the year in respect of which such return is sent.

8.—(1) The return which shall be sent to the Minister by every registered proprietor of registered flax-growing premises under sub-section (1) of Section 13 of the Act shall be in the Form Flax 4, set forth in the Schedule hereto, and the entries which shall be made by every such registered proprietor shall be such as are indicated in the said Form.

(2) Every such return shall be sent to the Minister by being sent by post to the Secretary, Department of Agriculture, Dublin.

9.—(1) The records which shall be kept under sub-section (1) of Section 23 of the Act by every registered proprietor of registered scutch-milling premises shall be in the Form Flax 5, set forth in the Schedule hereto, and the entries which shall be made by every such registered proprietor in the said records shall be such as are indicated in the said Form.

(2) Every entry required to be made by these Regulations by every registered proprietor of registered scutch-milling premises in the said Form Flax 5 shall be made not later than forty-eight hours after the doing of the thing to which such entry relates.
