UNCLAIMED PROCEEDS OF STAMP SALES REGULATIONS, 1936.

Regulations made by the Minister for Local Government and Public Health under the National Health Insurance Acts, 1911 to 1936.

The Minister for Local Government and Public Health in exercise of the powers conferred on him by the National Health Insurance Acts, 1911 to 1936, and of all other powers enabling him in that behalf hereby makes the following Regulations:

*1.—(1) These Regulations may be cited as the National Health Insurance (Unclaimed Proceeds of Stamp Sales) Regulations, 1936.

(2) In these Regulations unless the context otherwise requires—

The expression "the Minister" means the Minister for Local Government and Public Health;

The expression "the principal Act" means Parts I and III of the National Insurance Act, 1911 (1 and 2 Geo. 5, C.55) ;

The expression "the Act of 1918" means the National Health Insurance Act, 1918 (7 and 8 Geo. 5, C.32) ;

The expression "the Act of 1933" means the National Health Insurance Act, 1933 (No. 13 of 1933) ;

The expression "the Society" means Cumann an Arachais Náisiúnta ar Shláinte (The National Health Insurance Society).

(3) The Interpretation Act, 1923 , applies to the interpretation of these Regulations as it applies to the interpretation of an Act of 'the Oireachtas.

2. The residue of any sums received by the Minister on account of sales of stamps issued for the purpose of Part I of the principal Act and available for application under Section 29 of the Act of 1918 shall be applied so far as necessary in manner following:—

(a) Such sum as the Minister may determine shall be advanced by way of loan to the Society for the purpose of purchasing premises to be used as offices for the administration of the business of the Society under the Acts: and the sum so advanced shall, together with interest thereon from the date upon which it is advanced at the yearly rate prescribed from time to time under Section 56 (1) (c) of the principal Act, be repaid to the National Health Insurance Fund out of the moneys available for the administration of the Society in such yearly instalments as the Minister may from time to time determine;

(b) Any sums repaid to the National Health Insurance Fund in accordance with the provisions of the preceding paragraph shall revert to and become part of the residue of sums received by the Minister on account of sales of stamps issued for the purpose of Part I of the principal Act and available for application under Section 29 of the Act of 1918;

(c) Any expenditure incurred by the Society in effecting transfers of engagements of Approved Societies under the Act of 1933, which, in the opinion of the Minister, is not properly attributable to the ordinary administration of the Society, shall to such extent as the Minister may determine be repaid to the Society.

*These Regulations supersede the Provisional Regulations entitled the National Health Insurance (Unclaimed Proceeds of Stamp Sales) Regulations, 1934, which were made and came into force on the 14th day of May, 1934.
