STATUTORY RULES AND ORDERS. 1936. No. 384.

AGRICULTURAL PRODUCE (CEREALS) (WHEAT GROWING AND FEEDING STUFFS) (AMENDMENT) REGULATIONS, 1936.

WHEREAS the Minister for Agriculture is empowered by Part IV of the Agricultural Produce (Cereals) Act, 1933 (No. 7 of 1933), as amended by the Agricultural Produce (Cereals) Act, 1934 (No. 41 of 1934) and the Agricultural Produce (Cereals) Act, 1936 (No. 30 of 1936), to make by order regulations in relation to the matters and things which are the subject of these regulations:

AND WHEREAS, in exercise of the powers conferred on him by (amongst other provisions of the said first-mentioned Act) the said Part IV, the said Minister made the Agricultural Produce (Cereals) (Wheat Growing and Feeding Stuffs) Regulations, 1933 (Statutory Rules and Orders No. 57 of 1933), and the said Regulations were amended by the Agricultural Produce (Wheat Growing and Feeding Stuffs) (Amendment) Regulations, 1935 (Statutory Rules and Orders No. 605 of 1935):

NOW, I, SEAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Agricultural Produce (Cereals) Acts, 1933 to 1936, and of every and any other power me in this behalf enabling, do hereby order and make the following regulations, that is to say:—

1. (1) These Regulations may be cited as the Agricultural Produce (Cereals) (Wheat Growing and Feeding Stuffs) (Amendment) Regulations, 1936.

(2) The Agricultural Produce (Cereals) (Wheat Growing and Feeding Stuffs) Regulations, 1933 (Statutory Rules and Orders No. 57 of 1933), the Agricultural Produce (Cereals) (Wheat Growing and Feeding Stuffs) (Amendment) Regulations, 1935 (Statutory Rules and Orders No. 605 of 1935), and these Regulations may be cited together as the Agricultural Produce (Cereals) (Wheat Growing and Feeding Stuffs) Regulations, 1933 to 1936.

(3) These Regulations shall come into operation on the 1st day of February, 1937.

2. The Interpretation Act, 1923 (No. 46 of 1923), applies to the interpretation of these Regulations in like manner as it applies to the interpretation of an Act of the Oireachtas.

3. In these Regulations—

the expression "the Principal Act" means the Agricultural Produce (Cereals) Act, 1933 (No. 7 of 1933) as amended by the Agricultural Produce (Cereals) Act, 1934 (No. 41 of 1934), and the Agricultural Produce (Cereals) Act, 1936 (No. 30 of 1936);

the expression "the Minister" means the Minister for Agriculture;

the expression "the Principal Regulations" means the Agricultural Produce (Cereals) (Wheat Growing and Feeding Stuffs) Regulations, 1933 (Statutory Rules and Orders No. 57 of 1933).

4. (1) Every registered maize miller shall, within seven days after the expiration of the month of February, 1937, and every subsequent month, furnish to the Minister a return, in the Form A.P.C.10 in the Schedule hereto, giving in respect of such month the particulars indicated in that form.

(2) Every registered maize importer shall, within seven days after the expiration of the month of February, 1937, and every subsequent month, furnish to the Minister a return in the Form A.P.C.11 in the Schedule hereto, giving in respect of such month the particulars indicated in that form.

(3) Sub-paragraphs (3) and (4) of paragraph 6 of the Principal Regulations shall cease to apply in respect of the month of February, 1937, and every subsequent month.

5. For the purposes of sub-section (2) of Section 57 of the Principal Act—

(a) the records required by that section to be kept by every registered maize miller shall be in the Form A.P.C.16 in the Schedule hereto, and the particulars to be entered therein shall be those indicated in that form;

(b) the records required by that section to be kept by every registered maize importer shall be in the Form A.P.C.17 in the Schedule hereto, and the particulars to be entered therein shall be those indicated in that form.

6. The following provisions of the Principal Regulations are hereby revoked, that is to say, sub-paragraph (c) of paragraph 5, sub-paragraph (5) of paragraph 6, paragraph 7, and sub-paragraphs (c), (d) and (e) of paragraph 8.
