WHEREAS it is enacted by sub-section 3 of Section 4 of the Widows' and Orphans' Pensions Act, 1935 , that, where the Minister for Local Government and Public Health is satisfied as regards any employment in respect of which the conditions mentioned in paragraphs (a) and (b) of sub-section 1 of that section are complied with, provision is made, by means of any statutory enactment or by other means approved by the Minister, for securing, in respect of the widows and children of men employed in such employment, or in respect of the children of women employed in such employment, benefits on the whole not less favourable than the benefits conferred by the Widows' and Orphans' Pensions Act, 1935 , the Minister may by order declare that such employment shall not be an excepted employment to which the Widows' and Orphans' Pensions Act, 1935 , applies: | ||
NOW, the Minister for Local Government and Public Health, in exercise of the powers conferred on him by the said sub-section 3 of Section 4 of the Widows' and Orphans' Pensions Act, 1935 , hereby orders as follows:— | ||
1. This Order may be cited as the Widows' and Orphans' Pensions (Excepted Employments) Order, 1937. | ||
2. The Interpretation Act, 1923 (No. 46 of 1923) applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas. | ||
3. In this Order— | ||
the expression "the Acts" means the Widows' and Orphans' Pensions Act, 1935 , as amended by any subsequent enactments. | ||
4. The employments specified in the Schedule to this Order shall not be excepted employments to which the Acts apply. | ||
5. This Order shall be deemed to have come into force on the 6th January, 1936. | ||

SCHEDULE. | ||
1. Employment under the Cork Harbour Commissioners in any pensionable office in a permanent capacity which is either— | ||
(a) employment by way of manual labour, | ||
or | ||
(b) employment otherwise than by way of manual labour at a rate of remuneration not exceeding in value two hundred and fifty pounds a year. | ||
2. Employment as a member of the Gárda Síochána at a rate of remuneration not exceeding in value two hundred and fifty pounds a year. |
