STATUTORY RULES AND ORDERS. 1938. No. 33.

VOCATIONAL EDUCATION ACT, 1930 (PART V) (STATUTORY FORMS) REGULATIONS, 1938.

WHEREAS it is enacted by sub-section (1) of Section 125 of the Vocational Education Act, 1930 (No. 29 of 1930), that the Minister for Education may by order (amongst other things) make regulations prescribing any matter or thing referred to in the said Act as prescribed or to be prescribed :

AND WHEREAS these regulations relate to matters or things referred to in Part V of the said Act as prescribed :

NOW, I, TOMÁS Ó DEIRG, Minister for Education, in exercise of the powers conferred on me by the Vocational Education Act 1930 (No. 29 of 1930), and of every and any other power me in this behalf enabling, do hereby order and make the following regulations, that is to say :—

1. These Regulations may be cited as the Vocational Education Act, 1930 (Part V) (Statutory Forms) Regulations, 1938.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations, the expression " the Act " means the Vocational Education Act, 1930 (No. 29 of 1930).

4.—(1) The certificate mentioned in sub-section (1) of Section 62 of the Act that a course of instruction provided by a person other than a vocational education committee is an approved course for the purposes of Part V of the Act shall be in the Form V 41 in the Schedule hereto.

(2) The certificate mentioned in sub-section (2) of Section 62 of the Act that a school (other than a school which is for the time being recognised by the Minister for Education as a secondary school and other than a national school) is an approved school for the purposes of Part V of the Act shall be in the Form V 42 in the Schedule hereto.

5. The notice mentioned in sub-section (1) of Section 66 of the Act to a person to furnish particulars of young persons of whom he is the parent shall when such notice relates to all such young persons be in the Form V43 in the Schedule hereto, and, when such notice relates to a specified young person, be in the Form V44 in the Schedule hereto.

6. The notice mentioned in sub-section (1) of Section 67 of the Act to a person to furnish particulars of young persons employed by him shall, when such notice relates to all such young persons, be in the Form V45 in the Schedule hereto, and when such notice relates to a specified young person, be in the Form V46 in the Schedule hereto.

7. The warning to a parent under sub-section (1) of Section 73 of the Act shall be in the Form V47 in the Schedule hereto.

In the event of your failing to comply with this Notice or furnishing on the Schedule any such particulars which are to your knowledge false or misleading in any material respect, you will be guilty of an offence and be liable on summary conviction to a fine riot exceeding twenty shillings.

Note A.—The expression " young person " used in this Notice means a person who has attained age of fourteen years and has not attained the age of sixteen years.

Note B.—The word "parent" used in this Notice in relation to a young person means the individual having the legal custody of such young person, and where, owing to the absence of such individual or for any other reason, such young person is not living with or is not in the actual custody of such individual, includes the individual with whom such young person is living or in whose actual custody such young person is.

Note C.—The Attendance Officer may insert at the head of Column 6 such other particulars as he may lawfully require.

(i) Insert in column 1 the Christian name(s) and surname of every young person of whom you are the parent, who is over 14 and under 16 years on the............day of..........................., 19......, and is on that day either living with you or in your actual custody, but living at a school or elsewhere.

(ii) Insert also in column 1 the Christian name(s) and surname of any young person of whom you are not the parent, who on the............day of..........................., 19......, is over 14 and under 16 years and is on that day in your legal guardianship or living with you, or in your actual custody, but living at a school or elsewhere.

(iii) Insert in column 2, opposite the name of each young person entered in column 1 the age of the young person on the ............day of.................. 19......, and insert in column 3 the date (giving the day, month and year) of his or her birth.

(iv) Insert in column 4 opposite the name of each young person entered in column I the name and address of the place of instruction or school which the young person is attending, either for day-time, evening or night classes. If the young person has taken up employment, insert in column 5 the nature and place of such employment.

(v) Insert in column 6, opposite the name of each young person entered in column 1, the information asked for at the head of the said column 6.

(vi) When you have filled in the Schedule according to these instructions, you must sign and date it, under Note C, and leave it with or send it by post to the Attendance Officer at the address named under his signature on this Notice.

(i) State at No. 1 the full Christian name(s) and surname of the young person named in this Notice.

(ii) State at No. 2 the present age of the said young person and state at No. 3 the date (giving the day, month and year) on which he or she was born.

(iii) State at No. 4 the name and address of the School which the said young person is attending either for day-time, evening or night classes. If the said young person has taken up employment, state at No. 5 the nature and place of such employment.

(iv) State at No. 6 the information there asked for.

(v) Note that information at Nos. 4, 5 and 6, is required only when the age of the said young person is over 14 years and under 16 years.

(vi) Note also that, for the purposes of the Vocational Education Act, 1930 , a parent includes a legal guardian and any person who has the actual custody of a young person or with whom the young person is living.

(vii) When you have filled up the Schedule, you must sign and date it, under No. 6, and leave it with or send it by post to the Attendance Officer at the address named under his signature on this Notice.

(iii) Insert in column 4 the private address of every such young person.

(iv) Insert in column 5, in relation to every young person in your employment, the particular occupation or branch of employment, business or trade in which each said young person is engaged.

(v) Insert in column 6 the regular day each week which is for the time being the short day of employment and the hour at which such employment terminates.

(vi) Insert in column 7 the word " Yes " or " No " in so far as this information is within your knowledge or procurement.

(vii) Insert in column 8 the information there asked for.

(viii) When you have filled in the Schedule according to these instructions, you must sign and date it and leave it with or send it by post to the Attendance Officer at the address named under his signature on this Notice.

(vii) The particulars asked for in No. 8 should be supplied in so far as this information is within your knowledge or procurement. If the said young person has not attended or is not attending continuation education courses " Nil " should be noted thereon.

(viii) Insert in column No. 9 the information there asked for.

(ix) When you have filled up the Schedule, you must sign and date it and leave it with or send it by post to the Attendance Officer named at the foot of this Notice.

Now you are hereby required within one week after the service of this Notice upon you either to cause the said young person..........................................to attend for instruction in accordance with Part V of the said Vocational Education Act, 1930 , or to furnish to me at the address given below a reasonable excuse for not so doing.

In the event of your failing to comply with this Warning, proceedings will be instituted against you under the said Vocational Education Act, 1930 , and if, within three months after such proceedings, you again fail to comply with the said Act, further proceedings may be instituted against you under the said Act without previous warning.
