THE MERCHANT SHIPPING (FEES) ORDER, 1940.

The Minister for Industry and Commerce in exercise of the powers conferred on him by the Merchant Shipping Acts, 1894 to 1939, and of every and any other power him in this behalf enabling, with the consent of the Minister for Finance, hereby makes the following Order and Regulations:—

1. This Order and Regulations may be cited as the Merchant Shipping (Fees) Order, 1940, and shall come into operation on the 7th August, 1940.

2. The fees, charges and expenses set out in the First Schedule hereto shall be chargeable in connection with surveys of ships and other mercantile marine services in lieu of those heretofore in force.

3. The fees set out in the Second Schedule hereto shall be chargeable for the registration, transfer and mortgage of ships and for certain other services in lieu of those heretofore in force.

FIRST SCHEDULE.

FEES AND EXPENSES PAYABLE IN CONNECTION WITH SURVEYS OF SHIPS AND OTHER MERCANTILE MARINE SERVICES.

NOTES.

(a) Except where otherwise stated, the appropriate fees must be paid before any survey, inspection or service can be undertaken. In cases where the fee cannot be assessed beforehand (e.g. tonnage measurements), a deposit sufficient to cover the probable charge is required and any outstanding expenses or balance of fees must be paid before the case is completed.

(b) Fees and expenses under the First Schedule must in every case be paid to the Superintendent of a Mercantile Marine Office and not to Surveyors.

(c) An official receipt is given for all payments.

Survey for passenger or passenger and safety certificate.

Scale for steamships (including motor vessels of over 50 tons gross tonnage).

1. For a certificate for twelve months—

2. Where a certificate for less than twelve months is required, the fee will be in proportion to the period from the date of termination of the survey to the date of expiration of the certificate, at the rate of one-twelfth of the full fee for each month or part of a month, but in no case is less than three-twelfths of a twelve months' fee to be paid, nor less than £4 for a vessel not exceeding 100 tons gross or £6 for a vessel exceeding that tonnage.

3. The full twelve months' fee must be paid for the survey of a new ship or a ship coming under survey for a passenger certificate for the first time, even though a certificate for twelve months may not be required.

4. In any case in which the duration of the certificate has been limited by the Surveyor's declaration, owing to special reasons rendering one or more further surveys necessary within the ensuing twelve months, the total fees paid for certificates covering the period of twelve consecutive months shall not exceed that payable for a twelve months' certificate. The Surveyor's expenses must, however, be charged in connection with each survey made during the year.

5. If machinery, etc., is fitted on board a vessel or alterations are made to the hull while the passenger certificate is in force, or the vessel is removed to a plying district other than that for which the survey was first made, the fee for surveying the machinery or hull and issuing a declaration and certificate for each additional set of limits is £2.

6. If a certificate is required for limits additional to those dealt with at the main survey, but in the same plying district, the fee of £2, for issuing a declaration and certificate, will be charged only in the case of vessels of over 50 tons gross.

7. If the number of passengers is altered while a passenger certificate is in force, the fee for the necessary survey is £2, and includes the issue of new certificates when necessary, provided, however, that if the number of passengers is increased by more than 200, the fee is £1 10s. for every additional 200 passengers or part thereof.

8. The fee paid in accordance with the foregoing paragraphs covers any number of visits that a Surveyor may require to make before granting his declaration, and it includes the survey of the hull, boilers and propelling machinery (including the tests of the material), and the inspection of the equipments of the vessel, including the lights and sound signals. Provided the full fee for a twelve months' passenger certificate has been paid, this fee covers an ordinary survey for load line of a classed vessel, if made at the same time, and an annual survey of load line of any vessel. It does not, however, include inspection of the crew spaces (paragraph 30) or measurement for tonnage (paragraph 22).

Scale for motor boats not exceeding 50 tons gross tonnage.

10. Surveyors' expenses incurred in connection with an inspection, after casualty, of a passenger ship which has sustained damage are charged to the owners of the vessel in accordance with paragraph 60.

11. The fee for a copy of a passenger certificate is 10s.

12. The fee charged for change of name (paragraph 49) includes, in the case of a passenger vessel, the issue of fresh declarations and passenger certificates, showing the new name and any alterations in the ownership and port of registry.

Examination of Plans.

Designs of hulls of proposed passenger ships.

13. For the convenience of designers, preliminary plans of hulls of proposed ships will, if desired, be examined, and the fees chargeable in such cases are as follows :—

(a) £3 for the examination of the structural drawings and scantlings.

(b) £3 for the consideration of the watertight sub-division arrangements.

These fees are additional to any fees which later may become chargeable for other services.

Designs of boilers, machinery, etc.

14. For the consideration of designs of boilers, shafting or other machinery parts, or for the consideration of plans of a froth or C.O.₂ distributing installation for fire extinguishing, the fee is £2. In addition thereto a fee of £1 10s. should be charged for a certifying letter if required.

Survey of marine boilers.

15. The fees for separate survey of boilers for use on board ship are as follows :—

For the new double-ended cylindrical boiler, £4 10s.

For one single-ended cylindrical boiler, or one water tube boiler, £3 10s.

16. The fee covers the inspection of the drawings and the survey of the boiler or boilers up to and including the hydraulic test, but no declaration or certificate can be issued until either the full fee for passing certificate (paragraph 1, etc.) or a fee of £1 10s for a special certificate has been paid. If the vessel for which the boilers are intended is ultimately surveyed for a passenger certificate before the boilers have been in use these fees will be considered as a portion of the survey fee for such certificate and credit will be given for them accordingly.

Survey of vessels in dry dock.

17. A fee of £2 is charged in the case of a vessel not exceeding 10,000 tons gross, or £3 in the case of a vessel exceeding 10,000 tons gross for the survey of the vessel's hull in dry dock unless this survey is being made whilst a complete survey of the whole vessel is being carried out. This fee covers the issue of a dry docking certificate, if such certificate is required. This applies only tovessels holding passenger certificates issued by the Minister, or certificates accepted by the Minister as equivalent thereto. In other cases the fee for survey in dry dock is the same as that charged for a three months' passenger certificate (paragraph 2) plus ten shillings for each propeller shaft drawn for examination; this fee is, however, not subject to a minimum of £4.

Survey of emigrant ships and tourist accommodation.

18. The fee for an ordinary survey for an emigrant ship, involving not more than two visits by the Officers, is £8, provided the inspection is made before the vessel leaves the vicinity of the docks.

This fee covers the survey of the ship and of her equipments (including lights and sound signals), accommodation, distilling apparatus, stores, lighting, ventilating and sanitary arrangements and medical stores.

If from three to five visits by the Officers are required, either at one or more ports where passengers are embarked, the survey is to be deemed a special survey. For this, the fee is £12, but if the case requires unusual attention and more than five visits are necessary, or an unusual amount of the time of the Officers concerned is occupied, the fee is £15 or upwards, according to the special circumstances of the case and the number of visits made. The maximum fee chargeable is £20.

19. The fee for a survey of Tourist Third Class Accommodation is £6.

20. Fees for the survey of emigrant ships do not cover survey for passenger certificate (paragraph 1, etc.), measurement for tonnage (paragraph 22, etc.), inspection of crew spaces (paragraph 30), or survey for load line (paragraph 3).

Medical inspection of passengers and crew of emigrant ships.

21. The fee for the medical inspection of the passengers and crew of an emigrant ship is £3 3s. for the first hundred persons or fraction of a hundred persons inspected, and £1 for each additional hundred or fraction of a hundred persons.

Tonnage measurement.

22. The fees for the measurement of ships for tonnage under Rules I and II of the Second Schedule to the 1894 Act are shown in scale (a) and (b) of the following table :—

When a vessel previously measured under Rule II is remeasured under Rule I, the full fee in scale (a) is chargeable without any deduction for measurement under Rule II.

The fees for remeasurement in consequence of alterations on the upper dock or in the engine room or under Sections 77 (4), 78 (2), 79 (1), and 80 of the Merchant Shipping Act, 1894, or Section 54 of the Merchant Shipping Act, 1906, are shown in Column (c) above. The maximum fee in respect of each item is £5. The fee for re-measurement under Section 79 (1) (a) (i) includes the inspection of crew spaces if made at the same time as the re-measurement (see paragraph 30).

The fee for measurement under Section 81; Merchant Shipping Act, 1894 and in all other cases where, in consequence of alterations, re-measurement of the under dock tonnage is found necessary, is that stated in Column (a) above.

23. In the case of fishing vessels of 300 tons gross tonnage or under, half the fees stated in Scales (a) and (b) of paragraph 22 will apply.

24. In cases of application for the issue or amendment of a " Suez Canal " or " Panama Canal " Special Tonnage Certificate, a fee of two-fifths of the full tonnage fee is to be charged for each certificate whether the measurement is made at the same time as the measurement for registry or not. This fee includes re-measurement of ordinary tonnage (except under deck) if made at the same time but in no case is the fee to be less than the appropriate measurement fee under paragraph 22. Certified copies of Suez Canal or Panama Canal certificates are issued on payment of 10s. each.

25. The fee for change of name of a vessel (paragraph 49) covers the amendment of the Panama and Suez Canal Certificates or the issue of replacement certificates.

26. In the case of a ship seeking re-registry, a fee of £2 only is to be charged if, on comparison, the principal dimensions are found to agree with the original tonnage formula of the vessel. But if they do not agree and the vessel has to be measured throughout, a full tonnage fee is payable. If the underdeck tonnage is found to agree and other items differ, then, in addition to the £2 fee for check measurement, further fees are chargeable for these inspections in accordance with the foregoing regulations.

27. In cases where the registry of a vessel is being transferred to a foreign country, details of the tonnage calculations may be supplied for the guidance of the foreign Customs Authorities on payment of a fee of 10s per sheet with a minimum fee of £2.

28. The fees paid in accordance with scales (a) and (b) cover any number of visits that the Surveyor may find it necessary to make before he is able to fill up the formula of tonnage and grant his certificate to enable a vessel to obtain registry. It also covers the inspection of crew spaces and lights and sound signals, if the Surveyor is able to make these inspections on the occasion on which the measurement is performed, but not otherwise. For any further visits necessary for the completion of inspection of crew spaces and lights and sound signals, further fees in accordance with paragraphs 30 and 38 will be charged.

29. The fee for the inspection of minor alterations (e.g., of rig, engines, etc.) is £1.

Inspection of Crew spaces.

30. The fee for each visit to the ship for the purpose of inspection of crew spaces under Section 210 of the Merchant Shipping Act, 1894, is £1, but the aggregate amount of the fees for any such inspection is not to exceed £4, whatever may be the number of separate visits.

When the inspection of crew spaces is made at the same time as the measurement of tonnage, or the survey prior to re-registry, no separate fee is chargeable (see paragraphs 22 and 43).

Survey for Load Line.

31. The standard fees for this survey are as follows :—

Variation of Standard Fees.

(1) Annual survey carried through in one operation :—

For every annual survey of any ship over 500 tons (classed or unclassed) which is carried through in one operation there shall be paid—

(a) the standard fee, and

(b) in addition, a single fee of £1 if, for the purposes of the survey, more than one visit is paid to the ship by the Surveyor.

(2) Annual survey not carried through in one operation :—

(a) the standard fee,

(b) in addition, a fee of £1 for every partial annual survey, and

(c) for any ship over 500 tons, in addition, a single fee of £1 for every partial annual survey in respect of which, for the purposes of the partial annual survey, more than one visit is paid to the ship by the Surveyor.

(3) Renewal Survey carried out concurrently with a Special Survey for classification purposes :—

In the case of the survey of a classed ship for renewal of the Load Line Certificate, the fee in column 2 shall be paid if the renewal is carried out concurrently with a Special Survey for classification purposes, for which a fee is charged. Otherwise the fee will be 50 per cent of that in column 1.

(4) Issue of renewal survey carried out concurrently with survey for Passenger or Passenger and Safety Certificate :—

Where the survey for the issue or renewal of a Load Line Certificate is carried out by a Surveyor concurrently with that for a Passenger or Passenger and Safety Certificate, and the ship is:—

(a) a classed ship—no fee will be charged under column 1 or column 2;

(b) an unclassed ship—half the fee under column 4 or column 5 shall be paid.

(5) Annual Survey carried out concurrently with survey for Passenger or Passenger and Safety Certificate :—

Where the annual load line survey is made by a Surveyor at the same time as the survey for the issue of a Passenger or Passenger and Safety Certificate, no fee will be charged under column 3 or column.

(6) Survey where minor alterations have been made to a ship :—

Where minor alterations have been made to a ship having a Load Line Certificate in force, which involve an alteration of the freeboard but do not require a full survey, the fee in column 2 shall be paid whether the ship is classed or unclassed.

(7) Partial survey for issue of a short-term certificate :—

Where for special reasons a partial survey is made and a certificate is issued or renewed for a period not exceeding twelve months, one half of the standard fee appropriate to a full survey shall be paid.

32. Surveyors' expenses incurred on an inspection, after casualty, of a load line ship which has sustained damage are charged to the owners of the vessel in accordance with paragraph 60.

33. The fee for a copy of a Load Line Certificate is 10s.

34. The fee for change of name of a vessel (paragraph 49) includes the alteration of the name on the Load Line Certificate or the issue of a replacement Certificate.

Surveys for seaworthiness.

35. When a ship is finally detailed or when it appears that a ship provisionally detained was at the time of that detention an unsafe ship, the following charges are to be made, viz. :—

If the vessel is detained on account of overloading, improver loading, insufficient ventilation of coal cargoes, undermanning, or defective equipments, such as chronometers or charts, the charge is that prescribed by the scale in paragraph 36 (a).

If the vessel is detained on account of defective hull or machinery, the charge is that prescribed by the scale in paragraph 36 (b).

36. The fees for survey made, by direction of a court, under Section 463 (6) of the Merchant Shipping Act, 1894, upon the complaint of the crew of a vessel, are as follows :—

(a) If the Surveyor is appointed under Section 724 of the Merchant Shipping Act, 1894, the following are the fees :—

(b) If the Surveyor is a person appointed for the purpose either by the Minister or by the court under Section 463 (3) of the said Act, the fees are as follows :—

These fees do not include any other service whatever.

37. Where a survey for seaworthiness is made at the owner's request, the fee set out in paragraph 36 (b) are charged, except that in the case of vessels of under 100 tons gross tonnage the fee is £3.

Inspection and approval of lights and sound signals.

38. The fees for the survey of lights and sound signals are, £1 for each visit made to a ship on the application of the owner and for each visit made when the lights and sound signals are found to be defective, provided that the aggregate amount of fees for any such inspection shall not exceed £4, whatever may be the number of separate visits.

39. The fee for the inspection of lights and sound signals covers the issue of a report of the inspection (Surveys 69 or 69a). The fee for a copy of the report is 5s.

40. When the lights and sound signals are found in order and the Surveyor endorses the report of inspection in the course of his normal inspection duties, no fee is chargeable unless an application for survey has been made by the owner.

41. The inspection of lights and sound signals is covered by fees paid for survey for passenger certificate (paragraphs 1 and 8), clearance as an emigrant ship (paragraph 18), measurement of tonnage under column (a) paragraph 22, or survey prior to re-registry (paragraph 43.)

Survey, prior to re-registry, of a ship whose registry has been closed on account of wreck, etc.

42. The fee payable for the survey and certificate required by Section 54 of the Merchant Shipping Act, 1894, is the same as that prescribed in paragraph 36 (b).

43. This fee covers the inspection of crew spaces, and lights and sound signals but not measurement for tonnage.

44. The fee also covers the survey for load line, except in the case of hulks and lighters, provided the load line survey is held at the same time as the survey for seaworthiness and provided the fee for survey for load line is not the greater ; if such be the case, the balance is payable.

45. In the case of hulks and lighters and sailing barges which do not go to sea the fee is £2.

Inspection of markings under section 7 (1), (a), (b) and (c), merchant shipping act, 1894.

46. In cases where application for the inspection of the marking of a vessel is made by the owner, a fee of £1 is to be charged. This fee covers the number of visits required for the inspection of marking, but does not include any other service.

47. No charge is to be made for the inspection of marking on change of name of a vessel, or if the vessel is being measured for registry or re-registry and the fees for tonnage measurement have been paid.

Survey of ships prior to change of name.

48. When a Surveyor is directed to survey a vessel for seaworthiness, with a view to the change of her name, fees are charged in accordance with the scale prescribed in paragraph 36 (b), except (i) when the vessel is employed solely as a steam tug, and survey of the boiler only will be required, the survey fee chargeable is £2 for tugs having one boiler only, containing one furnace, and £4 for tugs having one boiler containing two or more furnaces, or having more than one boiler, and (ii) when the vessel is employed solely as a motor tug and the air reservoirs and bottles only will require to be opened up for survey the fee chargeable is £2 for a single screw and £4 for a twin screw vessel.

For unclassed dumb barges and sailing vessels under 100 tons gross the fee is £2.

Fees for change of name.

49. The fee for authorising the change of name of a ship is as follows :—

This fee is charged in all cases without reference to the description or employment of the vessel, and covers the inspection of marking, the change of name on the vessel's certificates, or the issue of replacement certificates.

Survey of a vessel before transfer to a foreign flag.

50. The fee for survey before transfer to a foreign flag is that shown in paragraph 36 (b) and is exclusive of the Surveyor's expenses.

Inspection of life-saving appliances.

51. For the inspection of life saving appliances on a vessel on or before first registry, or re-registry, a fee calculated on the basis of £2 for each boat is charged. The fee covers the issue to the owner, master or agent of the vessel of a report of inspection of the whole of the live-saving appliances on form Surveys 123.

52. For subsequent inspection at the request of the master or owner, or in the case of a vessel found to have defective or deficient life-saving appliances, a fee of £1 per visit with a maximum of £4 is charged.

53. For a certificate of inspection of life-saving appliances on a ship registered outside Ireland the fee is the same as that stated in paragraph 51 above.

54. The fee for a copy of the report of inspection on form Surveys 123 is 5s.

55. On application being made for survey during construction and certification of boats and buoyant apparatus intended to form part of the statutory life-saving appliances of a passenger steamer or a cargo vessel, the following fees are chargeable :—

56. For boats undergoing extensive repairs involving re-certification similar fees are chargeable.

57. The fees mentioned in paragraphs 55 and 56 include the issue to the applicant of a report of inspection on form Surveys 123. If the boats or buoyant apparatus are for a passenger ship, the fees are in addition to the usual fees for survey for a passenger certificate. If the boats are supplied to a cargo steamer, and a subsequent inspection of the whole of the life-saving appliances is made under paragraph 51, only the balance of the fees under that paragraph should be charged.

Inspection of Wireless Telegraphy Apparatus.

58. Fees are determined in each case by the Department of Posts and Telegraphs according to the time occupied and the expenses incurred by the Wireless Telegraphy Surveyor.

Inspection of explosives magazines.

59. The fee for the inspection of an explosives magazine is £1. If the magazine is found to be efficient, a certificate to that effect may be issued. The fee for the certificate is £1. The fee for a copy of the certificate is 5s.

Surveyor's expenses.

60. The travelling and subsistence expenses incurred in connection with a survey are charged in all cases except where the fee is stated to include the expenses.

Travelling expenses mean sums actually and necessarily paid out-of-pocket for travelling.

Subsistence expenses are chargeable when the Officer has to proceed to some place outside the limits of the port and is absent for not less than a whole day (10 hours). These expenses will be charged in accordance with the official scale.

61. A deposit to cover estimated expenses may be demanded in advance at the Surveyor's discretion (see also paragraphs 10 and 32).

Surveys abroad.

62. In cases where it is decided to allow a survey to be made abroad, in addition to the usual survey fees and Surveyor's travelling expenses and subsistence allowance, a special fee of £8 will be payable for every twenty-four hours, or part of twenty-four hours, during which the Surveyor is absent from the port at which he is stationed.

63. All fees and a deposit to cover the additional charges must be paid in advance in the case of surveys abroad and an undertaking given for the payment of any balance of fees and expenses connected with the service.

Overtime charges (Surveyors).

64. Whenever Surveyors are called upon to perform services out of office hours, application should be made on form Surveys 22. The application must include an undertaking to pay the overtime charges.

65. Overtime is charged according to the following scale :—

On week days—

From 8 a.m. to 10 a.m., and 5 pm. to 6 p.m., £1 per hour.

From 6 a.m. to 8 a.m. and 6 p.m. to 8 p.m., £2 per hour.

Before 6 a.m. and after 8 p.m., £4 per hour.

On Sundays, Good Fridays, and Christmas Days, £4 per hour.

66. A service occupying less than an hour will be charged for as one hour, according to the scale. For services exceeding one hour, a quarter fee will be charged for every quarter or part quarter of an hour, according to the scale, but for a service exceeding ten hours in any one case the charge will be limited to last for ten hours. These charges cover the services of all the Surveyors engaged in the survey, except that if the services of an Engineer Surveyor in addition to those of an Emigration Officer are required before an emigrant ship can be cleared, the survey made by the Engineer Surveyor will be regarded as a separate one, and overtime charges will be made in respect of both officers.

67. If from unforeseen circumstances the service cannot be commenced at the hour stated on the form of application (form Surveys 22), or cannot be completed without interruption, or if there is delay after completion, the time during which the Surveyors are kept waiting is to be charged for at half the usual overtime rate subject to a limit of ten hours. This does not apply to the clearances of emigrant ships where the delay is due to circumstances which are out of the shipowners' control.

68. Time occupied in travelling is not to be deemed overtime, except that normally spent on a tender between the shore and the ship, which is to be charged for at half the usual overtime rate. In the case of abnormal delay on the tender the half rate may be charged for the entire period of travelling if the Surveyor is satisfied that the delay was occasioned by circumstances within the control of the shipowners.

69. When a medical inspector is called upon to perform services out of office hours overtime fees will be charged according to the following scale, in addition to those above-mentioned:—

On week days—

Before 10 a.m., or after 5 p.m., £1.

On Sundays, Good Fridays, and Christmas Days, £2.

When both a.m. and p.m. overtime fees are incurred on the same day, both fees will be charged. These special charges are to cover the whole of the time occupied by the medical inspection.

70. The office hours are to be regarded as from 10 a.m. to 5 p.m.

71. If the usual three clear days' notice has been given of the survey or inspection, and the official arrangements have not allowed of the service being done within office hours, no overtime charge is required.

Fees for Services by the Staff of Mercantile Marine Offices.

(a) Engagement and Discharge of Seamen.

72. The fees for engagement or discharge of seamen before a Superintendent are as follows :—

73. The additional fees for attendance on board ship under the conditions laid down in the printed regulations are as follows :—

74. The actual travelling expenses of the Officers between the ship and the Mercantile Marine Office will be charged in addition in every case.

75. Where seamen are engaged on board ship at the time of discharge the additional fee for engagement on board is to be half the ordinary rate, if the men have just been discharged.

76. For attendance on board, by request, to render a service independent of the number of seamen on board (e.g., to attest the insertion of a new clause in the agreement) the minimum fee of £1 prescribed for attendance on board in connection with engagements and discharges will be charged.

(b) Engagement and discharge of fishermen at a Mercantile Marine Office.

77. The fees for the engagement or discharge of fishermen are 1s. per man.

(c) Overtime charges.

78. For attendance at the Mercantile Marine Office or on board ship out of the usual office hours the following special charges are made in addition to the ordinary fees :—

79. A service occupying less than an hour will be charged for as one hour, according to the scale. Where a service occupies more than one hour but not an exact number of hours the fee will be calculated as follows :—If the period in excess of an exact number of hours is 30 minutes or less, half the appropriate fee for 1 hour will be charged ; if the period in excess is more than 30 minutes the appropriate fee for 1 hour will be charged. For a service exceeding ten hours in any one case the charge will be limited to that for ten hours.

80. If from unforeseen circumstances the service cannot be commenced at the hour stated on the form of application (Eng. 12) or cannot be completed without interruption, the time during which the officers remain idle is to be charged for at half the usual overtime rate, subject to a limit of ten hours.

81. Time occupied in travelling is not to be deemed overtime, except that spent on a tender between the shore and the ship, which is to be charged for at half the usual overtime rate.

82. Where, however, the time occupied in travelling to and from the ship, from and to the Mercantile Marine Office, exceeds two hours in all, an additional fee of 2s. 6d. for every quarter of an hour will be charged ; any time less than a quarter of an hour being ignored.

(d) Services of Outdoor Officer.

83. When an outdoor officer is required to take men engaged to another port to join the ship, the following extra charges are to be paid in advance :—

For the outdoor officer—

(1) A personal allowance according to the authorized scale.

(2) An allowance for fare by railway, third class.

(3) An allowance for passage by steamer.

(4) A sum of 5s. for each day or part of a day employed.

(e) Indentures of Apprenticeship.

84. The fee for the registration of an indenture of apprenticeship is 2s. 6d.

85. The fee for each indenture of apprenticeship effected with the Super intendent's assistance is 5s.

86. The fee for a copy of an apprentice's indenture is 5s.

(f) Inspection of lime-juice and spirits.

87. The fee for the inspection of lime-juice is 5s. each cask.

88. If spirits are inspected at the same time, no separate fee is charged if the quantity of spirits inspected does not exceed 15 per cent of the lime-juice.

89. For any excess above this percentage, or for spirits inspected alone, a fee of 5s. per cask is charged.

Examinations.

90. Masters and Mates.—The following fees are payable on each occasion on which a candidate presents himself for examination for a Certificate of Competency as Master or Mate, or for one of the Voluntary Examinations for which provision is made in the Regulations relating to the examination of Masters and Mates :—

91. Where a candidate for a Certificate of Competency is re-examined in the written or in the oral part of the examination only, half the usual fee with a minimum of 10s. Od. will be payable.

92. In the event of a candidate for a Certificate of Competency failing in the sight tests, the fee of two shillings and sixpence for the sight tests will be deducted and the balance of the fee paid will be returned. If a candidate fails in any other part of the examination for a Certificate of Competency no part of the fee will be returned.

93. No abatement will be made in the fee charged to a candidate for a Certificate for foreign-going ships in consequence of his possessing a Certificate as Master or Mate of a Home Trade ship.

94. Engineers.—The following fees are payable on each occasion on which a candidate presents himself for an examination either for a Certificate of Competency or for the Endorsement of a Certificate of Competency :—

(a) Second Class Examination (Steam, or Motor, or combined Steam and Motor)—

(b) First Class Examination (Steam, or Motor, or combined Steam and Motor)—

95. Skippers and Second Hands.—The following fees are payable on each occasion on which a candidate presents himself for Examination for a Certificate of Competency as Skipper or Second Hand :—

96. Voluntary examinations in Signalling and Compass Deviation are open, without fee, to all persons who hold or have passed for a Certificate of Competency as Skipper or Second Hand of a fishing vessel.

97. In the event of a candidate for a Certificate as Skipper or Second Hand failing in the sight tests, the fee of two shillings and sixpence for examination in the sight tests will be deducted and the balance of the fee returned. If a candidate fails in any other part of the examination no part of the fee will be returned.

98. Efficient Deck Hands.—The fee for examination for a Certificate of Qualification as an Efficient Deck Hand is 1s.

99. Lifeboatmen.—The fee for examination for a Certificate of Efficiency as Lifeboatman is 2s. 6d.

100. Sight Tests.—The fee for the examination in Sight Tests only of a person serving or intending to serve in the Mercantile Marine, or in fishing vessels, is 2s. 6d. Where an Examiner refers a candidate for special examination, no additional fee is charged, but where a candidate appeals against the result of such special examination a fee of £2 2s. is charged for re-examination. For a second appeal examination (allowed in exceptional cases) a fee of £5 5s. is charged.

Signal Letters.

101. The fee payable for the allotment of Signal Letters is £1 1s., which covers the marking of the letters upon the vessel's certificate of registry.

Inspection of Registers, and Miscellaneous Fees.

102. The following fees are to be paid for the Inspection of Registers, for reference to documents, or for Searches made in the records of ships and seamen, and for copies of, or extracts from, those documents. Superintendents should be guided by this Table of Fees when issuing a document or allowing a reference to it. (See Note(a)).

Notes to Para. 102.—(a) The fees under paragraph 102 are not to be charged to Government Departments or to Consuls or other representatives of Foreign Governments when the inspection, etc., is required for Official purposes.

The Agreement and Official Log Book of a ship for one voyage, or in case of Running Agreements (Home or Foreign Trade) for one half-year, are to be regarded as constituting one record.

(b) This fee is for the attendance of an Officer for one day only ; it applies to the production of one document only, but the agreement and Official Log Book relating to one voyage may be regarded as one document, and in the case of a running agreement for one half-year the documents are regarded as constituting one record. When several documents have to be produced the fee is 12s, 6d. a day for the attendance of an Officer and 2s. 6d. a day for each document produced.

(c) No charge is to be made for a book (Dis. A) when the original has been lost through shipwrecks or fire at sea, or for a continuation book when the original book has been filled.

General.

103. For any surveys or services not specified in this Schedule, the Minister for Industry and Commerce may charge a fee of such amount as the said Minister, with the approval of the Minister for Finance, considers appropriate.

SECOND SCHEDULE.

FEES PAYABLE IN CONNECTION WITH THE REGISTRATION, TRANSFER AND MORTGAGE OF SHIPS.

Note.—Fees under this Schedule are payable to Registrars of Ships.

Initial Registry.

103. The following fees are payable on the initial registry of ships :—

Transfer and Mortgage.

104. The following fees are payable on the transfer, transmission, registry a new, transfer of registry, mortgage and transfer of mortgage, according to the gross tonnage of ship or shares transferred (e.g., the transfer of one sixty-fourth share in a ship of 6,400 tons gross equals transfer of 100 tons gross) :—

And 2s. 6d. for each additional 50 tons gross or part thereof up to 500 tons gross, after which 2s. 6d. for each 100 tons gross or part thereof.

105. Vessels belonging to the Commissioners of Irish Lights and vessels solely employed in fishing are exempt from the fees mentioned in paragraphs 103 and 104.

Miscellaneous Fees.
