CREAMERY BUTTER (LEVY) (No. 2) ORDER, 1942.

I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Dairy Produce (Price Stabilisation) Act, 1935 (No 21 of 1935), and of every and any other power me in this behalf enabling, do by this Order make the following regulations :

1. This Order may be cited as the Creamery Butter (Levy) (No. 2) Order, 1942.

2. The Creamery Butter (Levy) (No. 4) Order, 1941 ( S. R. & O. No. 582 of 1941 ) is revoked as on and from the 10th day of September, 1942.

3. In this Order—

the expression " butter box " means a 56 lb. box in which creamery butter has been sold.

the expression " butter (wholesale) dealer " means a person who carries on the business of selling creamery butter by wholesale only, but does not include a company which purchases creamery butter mainly for resale to another company any of the shares in which is held by such first-mentioned company or by any person who is a shareholder in such first-mentioned company.

4. The rate of levy of twenty-eight shillings the hundred weight imposed by the Creamery Butter (Levy) Order, 1942 ( S. R. & O. No. 385 of 1942 ) on creamery butter manufactured on or before the 9th day of September, 1942, other than creamery butter sold on or before that date, shall where such butter is sold packed in butter boxes to a purchaser other than a butter (wholesale) dealer or the proprietor of a creamery be increased, as on and from the 10th day of September, 1942, by one shilling.

5. The rate of levy on creamery butter manufactured on or after the 10th day of September, 1942, shall be—

(a) on butter packed in butter boxes and sold to a purchaser other than a butter (wholesale) dealer or the proprietor of a creamery ; one shilling and four pence the hundred-weight ;

(b) on butter other than butter of the class defined in the next preceding paragraph ; four pence the hundred-weight.
