DIPLOMATIC AND CONSULAR FEES (No. 1) REGULATIONS, 1943.

WHEREAS it is enacted by Subsection (1) of Section 2 of the Diplomatic and Consular Fees Act, 1939 (No. 31 of 1939), that the Minister for External Affairs may, with the consent of the Minister for Finance, make regulations fixing the fees to be charged for such services as are specified in such regulations when rendered by a person to whom the said Act applies :

AND WHEREAS it is enacted by Subsection (3) of the said Section 2 that regulations made under that Section may provide for the waiver in specified circumstances of any fee fixed by those regulations :

NOW I, ÉAMON DE VALÉRA, Minister for External Affairs, in exercise of the powers conferred on me by Section 2 of the Diplomatic and Consular Fees Act, 1939 (No. 31 of 1939), and of every and any other power enabling me in this behalf, with the consent of the Minister for Finance testified by his Official Seal affixed hereto, do hereby make the following regulations :—

1. These Regulations may be cited as the Diplomatic and Consular Fees (No. 1) Regulations, 1943.

2. In these Regulations, the expression " the Act " means the Diplomatic and Consular Fees Act, 1939 (No. 31 of 1939).

3. For every service specified in the second column of the Schedule to these Regulations, there shall be charged the fee set out in the third column of the said Schedule opposite the mention of such service in the said second column when such service is rendered—

(a) in the case of the fees mentioned at reference numbers 1 to 11 in the said Schedule—by any person to whom the Act applies,

(b) in the case of the fees mentioned at reference numbers 12 to 15 in the said Schedule—by any officer of the Minister appointed by the Minister to be a person to whom the Act applies, and

(c) in the case of the fee mentioned at reference number 16 in the said Schedule—by any diplomatic or consular officer to whom the Act applies.

4. The Minister may waive any fee chargeable under these Regulations in any of the following circumstances, that is to say :—

(a) where the service for which such fee is chargeable is rendered for, and at the request of, any official or public authority ;

(b) where the service for which such fee is chargeable is rendered for, or on behalf of, a person who is in straitened circumstances or the levying of the fee would for other reasons constitute a serious hardship ;

(c) where the service in respect of which such fee is chargeable is performed for official reasons or in pursuance of public policy.
