STATUTORY RULES AND ORDERS. 1947. No. 76.

SOCIAL WELFARE SCHEMES (CASH SUPPLEMENTS) ORDER, 1947.

The Government, in exercise of the powers conferred on them by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946), hereby order as follows :

1 Short title

1. This Order may be cited as the Social Welfare Schemes (Cash Supplements) Order, 1947.

2 Interpretation

2.—(1) In this Order —

the expression " the Minister " means the Minister for Social Welfare ;

the expression " scheduled area " means an area comprised in any county borough, borough, urban district or town specified in the First Schedule to this Order.

(2) A reference in this Order to any Act or Order shall be construed as a reference to that Act or Order as amended by any subsequent Act or Order.

3 General Provision for payment of supplements

3. The Minister shall cause allowances in money (in this Order referred to as supplements) to be paid in accordance with this Order.

4 Supplement to old age pension or blind person's pension

4.—(1) A person —

(a) who, having attained the age of seventy years, is entitled to a pension under the Old Age Pensions Acts, 1908 to 1938, or

(b) who, not having attained the age of seventy years but being blind, is entitled to a pension under these Acts,

shall be a person to whom this Article applies.

(2) A person to whom this Article applies who is entitled to a pension in respect of a week beginning on or after the 4th day of April, 1947, shall be entitled to a supplement in respect of that week in accordance with the Second Schedule to this Order.

5 Supplement to sickness benefit or disablement benefit

5.—(1) A person (not being an excluded person) who is entitled to sickness benefit or disablement benefit under the National Health Insurance Acts, 1911 to 1942, shall be a person to whom this Article applies.

(2) A person to whom this Article applies who is entitled to sickness benefit or disablement benefit in respect of any day (being the 1st day of April, 1947, or any subsequent day) shall be entitled to a supplement in respect of that day in accordance with the Third Schedule to this Order.

(3) In this Article, the expression " excluded person " means a person who is resident and maintained in an institution supported by one or more than one local authority or out of any public funds or by a charity or voluntary subscriptions and who has no dependants.

6 Supplement to unemployment benefit

6.—(1) A person who is entitled to unemployment benefit under the Unemployment Insurance Acts, 1920 to 1946, shall be a person to whom this Article applies.

(2) A person to whom this Article applies who is entitled to unemployment benefit in respect of any day (being the 1st day of April, 1947, or any subsequent day) shall be entitled to a supplement in respect of that day in accordance with the Fourth Schedule to this Order.

7 Supplement to unemployment assistance

7.—(1) A person who is entitled to unemployment assistance under the Unemployment Assistance 1933 to 1940, shall be a person to whom this Article applies.

(2) A person to whom this Article applies who is entitled to unemployment assistance in respect of any day (being the 26th day of March, 1947, or any subsequent day) shall be entitled to a supplement in respect of that day in accordance with the Fifth Schedule to this Order.

8 Supplement to widow's pension or orphan's pension

8.—(1) A person—

(a) who is entitled to a widow's (contributory) pension or a widow's (non-contributory) pension under the Widows' and Orphans' Pensions Acts, 1935 to 1940, or

(b) who is entitled to an orphan's (contributory) pension or an orphan's (non-contributory) pension under these Acts,

shall be a person to whom this Article applies.

(2) A person to whom this Article applies who is entitled to a pension in respect of any week beginning on or after the 4th day of April, 1947, shall be entitled to a supplement in respect of that week in accordance with the Sixth Schedule to this Order.

(3) Where a person to whom this Article applies and who is ordinarily resident in a scheduled area receives food vouchers in respect of any week beginning on or after the 4th day of April, 1947, the value of the food vouchers (calculated at the rate of 2s. 6d. for each set of three vouchers for milk, butter and bread) shall be deducted from any supplements payable to such person.

(4) In this Article the expression " food voucher " has the same meaning as in the Emergency Powers (Food Allowances) Order, 1941 (S. R. & O. No. 412 of 1941).

9 Saver for non-entitlement under relevant Acts

9. The provisions of this Order relating to the payment of supplements shall not operate to entitle any person to any benefit, assistance or pension where he would not be entitled to benefit, assistance or pension under the provisions of the relevant Acts if this Order had not been made.

10 Exclusion of supplements in ascertaining means

10. In calculating the means of a person for the purposes of the Old Age Pensions Acts, 1908 to 1938, the Unemployment Assistance Acts, 1933 to 1940, or the Widows' and Orphans' Pensions Acts, 1935 to 1940, no account shall be taken of the value of any supplement payable under this Order.

11 Application of Acts relating to benefit, assistance or pension

11.—(1) Where a supplement is payable to a person, the provisions of the Acts relating to the benefit, assistance or pension of which such person is the recipient (excluding any provisions specified in paragraph (2) of this Article) shall apply in relation to the supplement as if the supplement were a payment of such benefit, assistance or pension.

(2) The provisions referred to in paragraph (1) of this Article as being excluded are :—

(a) any provisions relating to moneys provided by the Oireachtas in aid of benefits,

(b) any provisions relating to reduction of benefit on account of arrears.

12 Payments to National Health Insurance Fund

12.—(1) So much of the moneys paid out of moneys provided by the Oireachtas to meet the expenses incurred in giving effect to this Order as relates to the supplements payable under Article 5 of this Order shall be paid into the National Health Insurance Fund.

(2) The amount to be paid into the National Health Insurance Fund under paragraph (1) of this Article in respect of the financial year beginning on the 1st day of April, 1947, and in respect of every subsequent financial year shall be such amount as, in the opinion of the Minister and of the Minister for Finance, is necessary as respects that year.

13 Payments into Unemployment Fund

13.—(1) So much of the moneys paid out of moneys provided by the Oireachtas to meet the expenses incurred in giving effect to this Order as relates to the supplements payable under Article 6 of this Order shall be paid into the Unemployment Fund.

(2) The amount to be paid into the Unemployment Fund under paragraph (1) of this Article in respect of the financial year beginning on the 1st day of April, 1947, and in respect of every subsequent financial year shall be such amount as, in the opinion of the Minister and of the Minister for Finance, is necessary as respects that year.

14 Payments into Widows' and Orphans, Pensions Fund

14.—(1) So much of the moneys paid out of moneys provided by the Oireachtas to meet the expenses incurred in giving effect to this Order as relates to the supplements payable under Article 8 of this Order shall be paid into the Widows' and Orphans' Pensions Fund.

(2) The amount to be, paid into the Widows' and Orphans' Pensions Fund under paragraph (1) of this Article in respect of the financial year beginning on the 1st day of April, 1947, and in respect of every subsequent financial year shall be such amount as, in the opinion of the Minister and of the Minister for Finance, is necessary as respects that year.

15 Payments into and out of Widows' and Orphans' Pensions Fund in relation to Emergency Powers (No. 318) Order, 1944

15.—(1) The amount which, in the opinion of the Minister and of the Minister for Finance, is required to defray the cost of the supplementary allowances provided for by the Emergency Powers (No. 318) Order, 1944 (S.R. & O., No. 101. of 1944), which are payable on or after the 1st day of April, 1947, shall be paid into the Widows' and Orphans' Pensions Fund.

(2) The supplementary allowances provided for by the Emergency powers (No. 318) Order, 1944, which are paid on or after the 1st day of April, 1947, shall be paid out of the Widows' and Orphans' Pensions Fund.

16 Termination of payment of supplementary allowances under Emergency Powers (No. 318) Order, 1944

16.—(1) Articles 6 to 14 of the Emergency Powers (No. 318) Order, 1944 (S.R. S, O., No. 101 of 1944), are hereby revoked.

(2) This Article shall come into operation on the 4th day of April, 1947.

SIXTH SCHEDULE.

Article 8.

SUPPLEMENT TO PENSION UNDER THE WIDOWS' AND ORPHANS' PENSIONS ACTS, 1935 TO 1940.

PART I.

GENERAL.

1. Any expression or word to which a particular meaning is assigned in the Widows' and Orphans' Pensions Acts, 1935 to 1940, has in this Schedule that meaning.

2. Where a child's allowance or an orphan's pension would be payable if a particular child or particular children or a particular orphan or particular orphans were under full-time instruction in a day school, the allowance or pension shall be deemed for the purposes of this Schedule to be payable.

PART II.

SUPPLEMENT FOR RECIPIENT WHO IS ORDINARILY RESIDENT IN A SCHEDULED AREA.

3. Where the pension is a widow's (contributory) pension payable in respect of the insurance of a man who was normally engaged in non-agricultural employment, the supplement shall be at the weekly rate of—

(a) 5s. in the case of a pension which does not include a child's allowance,

(b) 7s. 6d. in the case of a pension which includes one child's allowance,

(d) 2s. 6d. in respect of the widow's allowance and 2s. 6d. in respect of each child's allowance in the case of a pension which includes three or more children's allowances.

4. Where the pension is a widow's (contributory) pension payable in respect of the insurance of a man who was normally engaged in agricultural employment, the supplement shall be at the weekly rate of—

(a) 4s. in the case of a pension which does not include a child's allowance,

(b) 6s. in the case of a pension which includes one child's allowance,

(c) 2s. 6d. in respect of the widow's allowance and 2s. 6d. in respect of each child's allowance in the case of a pension which includes two or more children's allowances.

5. Where the pension is a widow's (non-contributory) pension at the rate applicable to a widow resident in a county borough, the supplement shall be at the weekly rate of—

(a) 4s. in the case of a pension which does not include a child's allowance,

(b) 6s. in the case of a pension which includes one child's allowance,

(c) 2s. 6d. in respect of the widow's allowance and 2s. 6d. in respect of each child's allowance in the case of a pension which includes two or more children's allowances.

6. Where the pension is a widow's (non-contributory) pension at the rate applicable to a widow resident in an urban area, the supplement shall be at the weekly rate of—

(a) 4s. in the case of a pension which does not include a child's allowance,

(b) 2s. 6d. in respect of the widow's allowance and 2s. 6d. in respect of each child's allowance in the case of a pension which includes one or more than one child's allowance.

7. Where the pension is a widow's (non-contributory) pension at the rate applicable to a widow resident in a rural area, the supplement shall be at the weekly rate of—

(a) 2s. 6d. in the case of a pension which does not include a child's allowance,

(b) 2s. 6d. in respect of the widow's allowance and 2s. 6d. in respect of each child's allowance in the case of a pension which includes one or more than one child's allowance.

8. Where the recipient is in receipt of one orphan's pension, the supplement shall be at the weekly rate of 2s. 6d.

9. Where the recipient is in receipt of two or more orphans' pensions, there shall be the same number of supplements as there are of pensions and each supplement shall be at the weekly rate of 2s. 6d.

10. Where the recipient is a widow pensioner who has remarried and a child's (contributory) allowance only is payable, the supplement shall be at the weekly rate of 2s. 6d. in respect of each child's allowance.

PART III.

SUPPLEMENT FOR RECIPIENT WHO IS ORDINARILY RESIDENT IN AN AREA WHICH IS NOT A SCHEDULED AREA.

11. Where the pension is a widow's (contributory) pension payable in respect of the insurance of a man who was normally engaged in non-agricultural employment, the supplement shall be at the weekly rate of—

(a) 6s. in the case of a pension which does not include a child's allowance,

(b) 6s. in respect of the widow's allowance and 1s. 6d. in respect of each child's allowance in the case of a pension which includes one or more than one child's allowance.

12. Where the pension is a widow's (contributory) pension payable in respect of the insurance of a man who was normally engaged in agricultural employment, the supplement shall be at the weekly rate of—

(a) 4s. 6d. in the case of a pension which does not include a child's allowance,

(b) 4s. 6d. in respect of the widow's allowance and 1s. 6d. in respect of each child's allowance in the case of a pension which includes one child's allowance or two, three, four, five or six children's allowances,

(c) 3s. in respect of the widow's allowance and 1s. 6d. in respect of each child's allowance in the case of a pension which includes seven or more children's allowances.

13. Where the pension is a widow's (non-contributory) pension at the rate applicable to a widow resident in a rural area, the supplement shall be at the weekly rate of—

(a) 3s. in the case of a pension which does not include a child's allowance,

(b) 4s. 6d. in the case of a pension which includes one child's allowance,

(c) 1s. 6d. in respect of the widow's allowance and 1s. 6d. in respect of each child's allowance in the case of a pension which includes two or more children's allowances.

14. Where the recipient is in receipt of one orphan's pension, the supplement shall be at the weekly rate of 1s. 6d.

15. Where the recipient is in receipt of two or more orphans' pensions, there shall be the same number of supplements as there are of pensions and each supplement shall be at the weekly rate of 1s. 6d.

16. Where the recipient is a widow pensioner who has remarried and a child's (contributory) allowance only is payable, the supplement shall be at the weekly rate of 1s. 6d. in respect of each child's allowance.
