IMPORTATION OF PHEASANTS AND PARTRIDGES ORDER, 1947. | ||
I, PATRICK SMITH, Minister for Agriculture, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)), and of every and any other power me in this behalf enabling, hereby order as follows :— 1. This Order may be cited as the Importation of Pheasants and Partridges Order, 1947. 2. In this Order— | ||
the word " carcases " includes parts of carcases ; | ||
the expression " the Minister " means the Minister for Agricculture ; | ||
the word " permit " means a permit issued by the Minister under this Order authorising the import of specified restricted articles ; | ||
the expression " restricted articles " means any articles being pheasants or partridges or the eggs of pheasants or partridges or the carcases of pheasants or partridges. 3.—(1) Any person may apply to the Minister for a permit and every such application shall— | ||
(a) be in writing, and | ||
(b) be sent to the Secretary, Department of Agriculture, Dublin. | ||
(2) On receipt of an application duly made under paragraph (1) of this Article, the Minister may, in his discretion, grant or refuse the application. | ||
(3) The Minister may attach to a permit any conditions which he considers proper, including, in particular, conditions as to the disposal by the holder of the permit of the restricted articles to which the permit relates. | ||
(4) Where any condition is attached to a permit, the holder of the permit shall comply with the condition. 4. On and after the 7th day of July, 1947, no person shall import restricted articles unless— | ||
(a) he is the holder of a permit issued in respect of the articles, and | ||
(b) the articles are imported in accordance with the permit, and | ||
(c) the permit is delivered at the time of the importation to the proper officer of Customs and Excise. | ||
