STATUTORY RULES AND ORDERS. 1947. No. 362.

SHOPS (HOURS OF TRADING ON WEEKDAYS) ORDER, 1947.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Section 25 of the Shops (Hours of Trading) Act, 1938 (No. 3 of 1938), and after due compliance with subsection (1) of section 4 of that Act, hereby order as follows :

1.—(1) This Order may be cited as the Shops (Hours of Trading on Weekdays) Order, 1947.

(2) This Order shall come into operation on the 3rd day of November, 1947.

2. Each of the following areas shall be a trading area for the purposes of this Order :

(a) the area of the county borough of Dublin,

(b) the area of the county borough of Cork,

(c) the area of the county borough of Limerick,

(d) the area of the county borough of Waterford,

(e) the area of the borough of Dun Laoghaire,

(f) the area consisting of the remainder of the State.

3.—(1) Where one or more than one of the following businesses, that is to say :

(a) the business of selling tobacco, cigars, cigarettes or smokers' requisites,

(b) the business of selling newspapers, periodicals, books, magazines or stationery,

(c) the business of selling chemists' commodities,

(d) the business of hairdressing,

(e) the business of pawnbroking,

(f) the business of making boots, shoes, slippers or leather footwear for retail sale on the premises, or of altering or repairing the same, or of selling boot accessories,

(g) the business of making dresses, costumes or other women's or children's clothing or hats for retail sale on the premises or of altering or repairing the same,

(h) the business of selling fuel for domestic use,

(i) the business of selling wallpaper and paints,

(j) the business of repairing motors, cycles or aircraft,

(k) the business of selling or repairing wireless receiving sets or selling accessories for the same,

(l) the business of selling or repairing musical instruments or selling music or accessories connected with such instruments,

(m) the business of receiving fabric articles direct from customers for the purpose of having them dyed, cleaned, repaired, altered or laundered,

(n) the business of a photographer,

(o) the business of selling religious articles,

(p) the business of lending books or periodicals for reward,

(q) the business of selling funeral requisites,

(r) the business of selling food or drink for human consumption, is or are carried on in a shop situate in the county borough of Dublin and such business or businesses constitutes or constitute the entire business or the main business carried on in the shop, the shop shall, for the purposes of this Order, be a Dublin City (ordinary closing hours) shop.

(2) A shop situate in the county borough of Dublin which is not a Dublin City (ordinary closing hours) shop shall, for the purposes of this Order, be a Dublin City (early closing hours) shop.

4. For the purposes of this Order—

(a) the closing hour on a weekday for a Dublin City (early closing hours) shop shall be the hour specified for that weekday in Part II of the Schedule to this Order ;

(b) the closing hour on a weekday for a Dublin City (ordinary closing hours) shop or a shop situate in the county borough of Cork, the county borough of Limerick, the county borough of Waterford or the borough of Dun Laoghaire shall, during any period mentioned in column (1) of Part III of the Schedule to this Order, be the hour specified for that weekday in column (2) of the said Part III opposite such period ;

(c) the closing hour on a weekday for a shop (not being a hairdressing shop) situate neither in a county borough nor the borough of Dun Laoghaire shall, during any period mentioned in column (1) of Part IV of the Schedule to this Order, be the hour specified for that weekday in column (2) of the said Part IV opposite such period ;

(d) the closing hour on a weekday for a hairdressing shop situate neither in a county borough nor the borough of Dun Laoghaire shall, during any period mentioned in column (1) of Part V of the Schedule to this Order, be the hour specified for that weekday in column (2) of the said Part V opposite such period.

5.—(1) It shall not be lawful for the proprietor of any shop situate in any trading area to open or keep open such shop for the serving of customers on any weekday to which this Article applies before the hour specified in Part I of the Schedule to this Order or after the closing hour.

(2) This Article applies to every weekday not being—

(a) a day falling within the period commencing on the 7th day of December in any year and ending on the 24th day of December in that year, or

(b) a day immediately preceding St. Patrick's Day.

Closing hours for a Dublin City (early closing hours) shop.

PART III.

Closing hours for a Dublin City (ordinary closing hours) shop or a shop situate in the county borough of Cork, the county borough of Limerick, the county borough of Waterford or the borough of Dun Laoghaire.
