IMPORTED TIMBER (MAXIMUM PRICES) (No. 11) ORDER, 1947. | ||||||||||||||||||||||||||
I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. &, O., No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946) ) and of every and any other power me in this behalf enabling, hereby order as follows :— 1. (1) This Order may be cited as the Imported Timber (Maximum Prices) (No. 11) Order, 1947. | ||||||||||||||||||||||||||
(2) This Order shall come into operation on the 17th day of December, 1947. 2. (1) In this Order— | ||||||||||||||||||||||||||
the expression " the Minister " means the Minister for Industry and Commerce; | ||||||||||||||||||||||||||
the expression " deep cut " and " flat cut " shall have the meanings customarily attached to them in the course of trade in timber. | ||||||||||||||||||||||||||
(2) References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy. 3. (1) No person shall sell imported short leaf pitch pine in deals, planks or scantlings cut to standard sizes not less than 2" thick or 3" wide at a price in excess of a price calculated at the rate of ten shillings and eight pence per cubic foot. | ||||||||||||||||||||||||||
(2) No person shall sell imported short leaf pitch pine in boards up to 1¼" in thickness at a price in excess of a price calculated at the rate of eleven shillings and one penny per cubic foot. 4. (1) No person shall sell imported long leaf pitch pine in baulk at a price in excess of a price calculated at the rate of fourteen shillings and nine pence per cubic foot. | ||||||||||||||||||||||||||
(2) No person shall sell imported long leaf pitch pine in deals planks or scantlings cut to standard sizes not less than 2" thick or 3" wide at a price in excess of a price calculated at the rate of sixteen shillings and nine pence per cubic foot. | ||||||||||||||||||||||||||
(3) No person shall sell imported long leaf pitch pine in boards up to 1¼" in thickness at a price in excess of a price calculated at the rate of seventeen shillings and three pence per cubic foot. 5. Where imported short leaf or long leaf pitch pine has been deep-cut or flat-cut after importation the vendor may add to the appropriate maximum price calculated according to the terms of the preceding paragraph a charge not exceeding— | ||||||||||||||||||||||||||
(1) in the case of deep cuts a charge calculated at the appropriate rate set out in Column (3) of Part I of the Schedule hereto for any width set out in Column (2) of the said Part I ; | ||||||||||||||||||||||||||
(2) in the case of flat cuts a charge calculated at the rate set out in Column (3) of Part II of the Schedule hereto for the thickness set out in Column (2) of the said Part II. 6. No person shall sell any imported short leaf or long leaf pitch pine unless such pitch pine is so described on every quotation, estimate, invoice or other document used in connection with the sale. Where the timber has been deep cut or flat cut after importation the charges, if any, for such cutting shall be stated in such documents. 7. Where imported short leaf or long leaf pitch pine is sold and is delivered at any place not more than five miles from the vendor's premises, no charge shall be made for the delivery. 8. Where imported short leaf or long leaf pitch pine is sold by a registered timber merchant not being a merchant who obtains his supplies direct from Timber Importers, Ltd., the appropriate price may be increased by an amount not exceeding the cost of transport at the cheapest rate available borne by such registered timber merchant. 9. Where a direction is given by the Minister in respect of any particular person or group of persons or in respect of any particular imported short leaf or long leaf pitch pine, the provisions of this Order shall, if and in so far as they are inconsistent with such direction, have effect subject to such direction. 10. Where imported short leaf or long leaf pitch pine is sold and the quantity sold is 10 cubic feet or less, an addition not exceeding 10 per cent, may be made in calculating the proper maximum price. 11. The Emergency Powers (Timber other than Firewood) (Maximum Prices) Order, 1944 (S. R. & O. No. 5 of 1944), as amended by the Emergency Powers (Timber other than Firewood) (Maximum Prices) Order, 1944 (First Amendment) Order, 1944 (S. R. &, O., No. 298 of 1944), and the Emergency Powers (Timber other than Firewood) (Maximum Prices) Order, 1944 (Second Amendment) Order, 1945 (S. R. & O. No. 17 of 1945), shall not apply to imported short leaf or long leaf pitch pine. 12. The Emergency Powers (Imported Timber) (Maximum Prices) (No. 3) Order, 1946 (S. R. & O. No. 249 of 1946) and the Emergency Powers (Imported Timber) (Maximum Prices) (No. 7) Order, 1947 ( S. R. & O. No. 143 of 1947 ) are hereby revoked. | ||||||||||||||||||||||||||
