INFECTIOUS DISEASES (MAINTENANCE) REGULATIONS, 1948. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
The Minister for Health in exercise of the powers vested in him by section 44 of the Health Act, 1947 , hereby makes the following regulations :— 1. These regulations may be cited as the Infectious Diseases (Maintenance) Regulations. 1948. 2. In these regulations— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
the expression " the Act" means the Health Act, 1947 ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
the word " outgoings " means the rent, ground rent, rates and purchase annuity payable in respect of premises and mortgage repayments relating to the purchase of premises ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
the word " person " means a person to whom section 44 of the act applies, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
the expression " the payment " means the payment to be made by a health authority under section 44 of the act to or in respect of a person or his dependants. 3. Subject to the provisions of these regulations, the payment shall be a weekly payment not exceeding a sum calculated at the appropriate rate specified in the Schedule hereto. 4. Where a person is owner or tenant of the premises in which he ordinarily resides, the approprite rate specified in the Schedule hereto may be increased by whichever of the following sums is the lesser :— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) the weekly amount of the outgoings payable by the person in respect of such premises or | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) fifteen shillings per week where the premises are situate in a county borough and ten shillings, per week where the premises are situate elsewhere. 5. (1) Where a male person and his dependent wife or a female person and her dependent husband are both receiving free of charge institutional services in a health institution, the payment shall not exceed the sum of the following :— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) ten shillings per week, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) where the person has one or more than one dependant (other than such husband or wife), a sum not exceeding £1 per week where the person is ordinarily resident in a county borough or fifteen shillings per week where the person is ordinarily resident elsewhere or the actual wage payable (whichever is the lesser) where, with the approval of the health authority, it is necessary to employ someone other than a relative to take care of such dependant or dependants, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) a sum in respect of dependants calculated at the appropriate rate specified in the Schedule hereto, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(d) a sum calculated in accordance with Article 4 of these regulations in respect of the ownership or occupation of premises. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) Where a person who is a widow, widower, or a single person is receiving free of charge institutional services in a health institution the payment shall not exceed the sum of the following:— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) five shillings per week, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) where such person has one or more than one dependant a sum not exceeding £1 per week where the person is ordinarily resident in a county borough or fifteen shillings per week where the person is ordinarily resident elsewhere or the actual wage payable (whichever is the lesser) where, with the approval of the health authority, it is necessary to employ someone other than a relative to take care of such dependant or dependants, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) a sum in respect of dependants' allowances calculated at the appropriate rate specified in the Schedule hereto, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(d) a sum calculated in accordance with article 4 of these regulations in respect of the ownership or occupation of premises. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) Where a male person with dependent wife is receiving free of charge institutional services in a health institution, the payment shall not exceed the sum of the following :— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) thirty-seven shillings per week where such person is ordinarily resident in a county borough or thirty-five shillings per week where such person is ordinarily resident elsewhere, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) a sum in respect of dependants' allowances calculated at the appropriate rate specified in the Schedule hereto, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) a sum calculated in accordance with article 4 of these regulations in respect of the ownership or occupation of premises. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(4) Where a female person with dependent husband is receiving free of charge institutional services in a health institution, the payment shall not exceed the sum of the following :— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) thirty-seven shillings per week where such person is ordinarily resident in a county borough or thirty-five shillings per week where such person is ordinarily resident elsewhere, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) where such person has one or more than one dependant (other than her husband) a sum not exceeding £1 per week where the person is ordinarily resident in a county borough or fifteen shillings per week where the person is ordinarily resident elsewhere, or the actual wage payable (whichever is the lesser) where, with the approval of the health authority, it is necessary to employ someone other than a relative to take care of such dependant or dependants, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) a sum in respect of dependants' allowances calculated at the appropriate rate specified in the Schedule hereto, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(d) a sum calculated in accordance with article 4 of these regulations in respect of the ownership or occupation of premises. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(5) Where the wife of a person is receiving free of charge institutional services in a health institution, the payment shall not exceed the sum of the following :— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) thirty-seven shillings per week where such person is ordinarily resident in a county borough or thirty-five shillings per week where such person is ordinarily resident elsewhere, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) where such person has one or more than one dependant other than his wife a sum not exceeding £1 per week, where the person is ordinarily resident in a county borough or fifteen shillings per week where the person is ordinarily resident elsewhere or the actual wage payable (whichever is the lesser) where, with the approval of the health authority, it is necessary to employ someone other than a relative to take care of such dependant or dependants, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) a sum in respect of dependants' allowances calculated at the appropriate rate specified in the Schedule hereto, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(d) a sum calculated in accordance with article 4 of these regulations in respect of the ownership or occupation of premises. 6. These regulations shall come into operation on the first day of March, 1948. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
