SHEEP DIPPING ORDER, 1948.

I, JAMES M. DILLON, Minister for Agriculture, in exercise of the powers conferred on me by the joint operation of the Agriculture Acts, 1931 to 1944, and the Diseases of Animals (Ireland) Acts, 1894 to 1945, and of every and any other power me in this behalf enabling, hereby order as follows :—

1. (i) This Order may be cited as the Sheep Dipping Order, 1948.

(ii) This Order shall come into operation on the 1st day of June, 1948.

2. The Interpretation Act, 1937 (No. 38 of 1937) applies to this Order.

3. In this Order—

the expression " the Principal Order " means the Sheep Dipping Order, 1937 ( S. R. & O. No. 169 of 1937 ) ;

the expression " the Minister " means the Minister for Agriculture ;

the expression " approved ' Single-Dipping ' type sheep dip " means a sheep dip approved for the time being as a " Single-Dipping " type sheep dip by the Minister for the purposes of the Principal Order as amended by this order.

4. Where under and in accordance with the provisions of the Principal Order or of any notice or requisition issued under the Principal Order or of any regulation made by a Local Authority under that Order, any sheep are required to be or to have been double-dipped, it shall be sufficient compliance with such requirement if they are or have been dipped once in a sheep bath of approved " Single-Dipping " type sheep dip.

5. Where in the Principal Order or in any Regulation made by a Local Authority under that Order, the owner or person in charge of any sheep is required to give notice of his intention to dip sheep, he shall, if it is intended to dip the sheep in a sheep bath of approved " Single Dipping " type sheep dip, also give notice in like manner that he intends to use such a dip.

6. Where approved " Single Dipping " type sheep dip is used for the dipping of sheep, the following shall apply in lieu of Article 14 of the Principal Order :—

Where sheep are dipped in accordance with the Principal Order as amended by this Order in the presence of an inspector, he shall give the person in possession or in charge of such sheep a certificate in Form F in the Schedule hereto that such sheep were dipped, and when such person declares to such inspector that he was not at the time of such dipping in possession or in charge of any sheep other than those so dipped such Inspector shall state on such certificate that such person has made such declaration.

7. The forms set out in the Schedule to this Order shall respectively be substituted for Forms A, B, E, F, G and H set out in the First Schedule to the Principal Order.

8. This Order and the Principal Order may be cited together as the Sheep Dipping Orders, 1937 and 1948.
