ONIONS (MAXIMUM PRICES) ORDER, 1948.

I, DANIEL MORRISSEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946) as amended by the Supplies and Services (Temporary Provisions) Act, 1946 (Continuance) Act, 1947 (No. 39 of 1947)) and of every and any other power me in this behalf enabling, hereby order as follows :—

1. This Order may be cited as the Onions (Maximum Prices) Order, 1948.

2. References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

3. In this Order :—

(a) the word " onions " includes

(i) potato onions and shallots intended otherwise than for planting ;

(ii) onions which have been preserved by cold storage or by any other method of storage but does not include onions which have been canned or bottled or preserved otherwise than aforesaid ;

(b) any fraction of a halfpenny shall be regarded as one halfpenny.

4.—(1) On and after the 11th day of May, 1948, no person shall sell onions to a retail merchant at a price exceeding a price calculated at the rate of 28/- per cwt., free on rail at the railway station nearest to the premises of the vendor.

(2) Where onions are delivered to the premises of a retail merchant the maximum addition that may be made to the price calculated in accordance with Article 4 (1) of this Order in respect of such delivery shall be an amount not exceeding the lowest cost of delivery of such onions by public transport from the railway station nearest to the premises of the vendor to the premises of the retail merchant.

(3) Whenever a person sells onions to a retail merchant such person shall, on the demand in writing of the purchaser, deliver to such purchaser a statement in writing setting out the amount of the price which is referable to the cost of transport mentioned at Article 4 (2) of this Order.

5. During the period commencing on the 11th day of May, 1948, and ending on the 17th day of May, 1948, both dates inclusive, no person shall sell onions by retail at a price exceeding a price calculated at the rate of 5d. per lb.

6. On or after the 18th day of May, 1948, no person shall sell onions by retail at a price exceeding a price calculated at the rate of 4d. per lb.

7. Where a direction is given by the Minister in respect of any particular person or group of persons or in respect of any particular onions or description of onions the provisions of this Order shall, if and in so far as they are inconsistent with such direction, have effect subject to such direction.

8. The Emergency Powers (Onions) (Maximum Prices) (No. 3) Order, 1947 ( S. R. & O. No. 397 of 1947 ), is hereby revoked as on and from the 11th day of May, 1948.
