CREAMERIES JOINT LABOUR COMMITTEE ESTABLISHMENT ORDER, 1948. | ||
WHEREAS pursuant to the provisions of Section 36 of the Industrial Relations Act, 1946 , application has been made to the Labour Court by a trade union of workers for the establishment of a Joint Labour Committee with respect to workers of the class, type or group described in the Schedule hereto and their employers : | ||
AND WHEREAS the Labour Court, having considered the application, is satisfied that the existing machinery for effective regulation of remuneration and other conditions of employment of such workers is inadequate : | ||
AND WHEREAS the Labour Court is further satisfied that, having regard to the existing rates of remuneration and conditions of ployment of such workers it is expedient that a Joint Labour Committee should be established : | ||
AND WHEREAS the provisions of Section 38 of the Industrial Relations Act, 1946 , have been complied with, and whereas the Labour Court held in pursuance of the said section 38 an enquiry into the application on the 24th June, 1947 and has considered the objections submitted in accordance with the said section : | ||
NOW THEREFORE, the Labour Court, by virtue of the powers conferred on it by sections 35 and 39 of the Industrial Relations Act, 1946 hereby orders as follows :— 1. A Committee is hereby established to perform in relation to the workers described in the Schedule to this Order and their employers the functions assigned to it by Part IV of the Industrial Relations Act, 1946 . 2. The Committee established by this Order may be known as the Creameries Joint Labour Committee. 3. This Order may be cited as the Creameries Joint Labour Committee Establishment Order, 1948. 4. This Order shall come into operation on the 19th day of January, 1948. | ||
SCHEDULE. | ||
Workers employed— | ||
(a) in a Creamery registered in the register of creameries kept by the Minister for Agriculture in pursuance of the provisions of The Dairy Produce Act, 1924 (No. 58 of 1924), or | ||
(b) in a Cream-Separating station registered in the register of Cream-Separating Stations kept by the Minister for Agriculture in pursuance of the provisions of the said Act, or | ||
(c) on a vehicle licensed by the Minister for Agriculture under Section 3 of the Dairy Produce (Amendment) Act, 1934 (No. 34 of 1934) to carry on cream-separating business, | ||
Whilst engaged in the making of butter, cheese or other dairy product or in any process preparatory or incidental thereto, including— | ||
(i) the collection of milk and the separation of cream, | ||
(ii) the upkeep and maintenance of plant and machinery, | ||
(iii) packing and warehousing, | ||
(iv) transport, | ||
but excluding— | ||
Managers, Branch Managers, Assistant Managers, Managers of Portable Creameries and workers engaged solely as clerks or typists and workers engaged in the manufacture of condensed milk. | ||
