WHEREAS in pursuance of subsection (1) of section 44 of the Transport Act, 1950 (No. 12 of 1950), Córas Iompair Éireann has submitted to the Minister for Industry and Commerce a superannuation scheme for its clerical, supervisory and executive staff who are not members of any special superannuation scheme : | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
AND WHEREAS the Minister for Industry and Commerce, having considered objections and representations in connection with the said scheme, has thought it proper to modify the scheme in certain respects : | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
NOW, I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by subsection (4) of section 44 of the Transport Act, 1950 (No. 12 of 1950), after consultation with the Minister for Finance, hereby order as follows :— 1. This Order may be cited as the Córas Iompair Éireann Superannuation Scheme, 1951 (Confirmation) Order, 1951. 2. The superannuation scheme submitted by Córas Iompair Éireann for its clerical, supervisory and executive staff, as modified by the Minister for Industry and Commerce (a copy whereof as so modified is set out in the Schedule hereto), is hereby confirmed and shall come into operation on the date on which this Order is made. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
SCHEDULE. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
1. Title of Scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
This Scheme shall be known as The C.I.E. Superannuation Scheme, 1951. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
2. Interpretation. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) In this Scheme, save where the context otherwise requires, any word or expression importing the singular shall be construed as if it also imported the plural, any word or expression importing the plural shall be construed as if it also imported the singular and any word importing the masculine gender shall be construed as if it also imported the feminine gender. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) In this Scheme, save where inconsistent with the context, the following expressions shall have, the meanings hereby assigned to them that is to say : | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" The Minister " means the Minister for Industry and Commerce : " | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" The Board " means Córas Iompair Éireann ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" The Trustees " means The trustees of the Scheme for the time being ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" The Committee " means the committee to whom under the provisions of the Scheme the administration of the Scheme is for the time being entrusted ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" The Fund " means the fund established by the Scheme ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" The Secretary " means the person appointed for the time being as Secretary of the Scheme and includes, where appropriate, a person acting temporarily as substitute for such person ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" The Actuary " means the actuary or actuaries for the time being appointed for the purpose of the Scheme ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" Special Superannuation Scheme " means any of the following Superannuation Schemes, that is to say : | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
C.I.E. Salaried Officers & Clerks (G.S.R.) Superannuation Scheme ; Group Life and Pension Scheme for ex-D.U.T. Company Staff ; Female Clerks' Provident Fund. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" Scheduled Officer " means an officer employed by the Board under a special contract or Board Minute whose name is mentioned in the Schedule to this Scheme ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" Member " means a member of the Scheme ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" Employment " by the Board includes employment by a company whose functions have been transferred to the Board and the word " employee " shall be construed accordingly ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" Salary " in relation to a member means the annual rate of remuneration for the time being paid by the Board to such member and does not include payments for overtime, bonuses, commissions, travelling expenses or subsistence and the like or the money equivalent of emoluments in kind or of railway or other tickets or passes provided for him or of motor cars or other vehicles supplied for his use, or of any other advantage payment or allowance given him ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" Retiring Average Salary " in relation to a member means his average salary during the ten years next preceding the date when his employment by the Board terminates. Provided that if the member during any part of the said ten years has been absent on leave at reduced pay or without pay his retiring average salaryshall be determined by reference to the full rate of salary which would have been payable to him if he had not been so absent ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" Pensionable Membership " in relation to a member means the number of completed years in the period between the date when he becomes or is deemed to have become a member and the date when he ceases to be a member ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" Infirmity " means permanent bodily or mental infirmity not the result of his own misconduct which in the opinion of the Committee renders a member incapable of performing the duties of his position under the Board ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" Committee Man " means a member of the Committee ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" Board's Committee-Man " means a Committee-man appointed by the Board ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" Members' Committee-Man " means a Committee-man appointed by the members ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
" The Current Bank Account " means the bank account kept by the Accountant of the Board pursuant to Rule 7 of this Scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
3. Membership of the Scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) Every person holding a clerical, supervisory or executive position under the Board who is on its regular establishment and who is not a member of any special superannuation scheme shall be entitled to become a member of this scheme subject to the provisions of Clause (3) of this Rule in regard to the maximum age for entering the Scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) It shall be compulsory for any person other than a scheduled officer who is entitled to become a member of the scheme to become a member. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) No person may become a member of the scheme after reaching the age of 55 years in the case of a male or 50 years in the ease of a female. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(4) Any doubt, dispute or question which shall arise, or, in the opinion of the Board shall be likely to arise as to whether a position or positions under the Board is or are— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) clerical, supervisory or executive, or | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) on the regular establishment of the Board shall be decided by the Board, whose decision shall be final. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(5) A member of the scheme who leaves the employment of the Board shall cease to be a member of the scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(6) A person who was in the employment of the Board before the commencement of the scheme from whose salary contributions were deducted in anticipation of the scheme shall be deemed for ail the purposes of the scheme (and in particular for the purpose of the calculation of benefits) to have become a member of the scheme either on the first day of January, 1945, or on the date when such employment began, whichever of such dates shall be the later. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(7) The Committee may require a person becoming a member to furnish satisfactory evidence of his age. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
4. Establishment of the Fund. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) Upon the coming into operation of the Scheme a fund shall be established for the purpose of providing in accordance with the Scheme annuities and other benefits for the members of the Scheme or for the widows, children or dependants of deceased members of the Scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) The Fund shall consist of— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) the contributions of the members ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) the contributions of the Board ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) interest, dividends or other income from the investments and property of the Fund ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(d) any other sums which may be paid to the Trustees from time to time for the purposes of the Scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) The Fund shall be called the C.I.E. Superannuation Fund, 1951. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(4) The Fund shall be vested in the Trustees. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
5. Trustees. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) The first Trustees of this Scheme shall be Transport Subsidiary Limited. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) The Board shall have power, after consultation with the Committee— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) with the consent of the Minister to remove a Trustee from office ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) with the approval of the Minister to appoint a new Trustee. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) If at any time individuals are appointed to be Trustees in lieu of a corporation the number of such individual Trustees shall not exceed five ; and if at any time their number is reduced belowthree the Board shall proceed with all convenient speed to appoint, with the consent of the Minister, one or more new Trustees to bring the number up to three at least. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(4) If at any time there are no Trustees, the Board may act as Trustees pending a new appointment. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(5) A Trustee shall not be liable for any loss occasioned by negligence or breach of trust if in the opinion of the Board he has acted honestly and ought fairly to be excused. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
6. Investment of the Fund. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
All moneys in the hands of the Trustees belonging to the Fund and not required for the immediate purposes of the Scheme shall, as soon as practicable, be invested in the name or under the control of the Trustees in such securities as the Board shall, after consultation with the Committee, think proper, or may be lent to the Board re-payable on demand at an agreed rate of interest. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
7. Operation of the Fund by the Trustees. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) The Trustees shall stand possessed of the Fund upon trust out of the income thereof and as far as may be necessary out of the capital to make provision in accordance with Clause (2) of this Rule for the payment of benefits under the Scheme and any other payments required for the administration of the Scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) The Trustees shall lodge from time to time in a separate bank account, to be kept by the Accountant of the Board for the purpose, such sums as from an examination of particulars furnished to them and certified by the Committee the Trustees consider necessary to enable punctual payment to be made of all sums properly payable from time to time out of the Fund. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) The Trustees shall ensure that any unexpended balance on the said separate bank account is duly accounted for to them. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(4) The Trustees shall satisfy themselves so far as is reasonably possible that the records and accounts relating to the expenditure out of the Fund are accurately kept. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
8. Payment of Current Expenses. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) Payment of benefits or other sums out of the Fund shall be made from time to time by cheque on the current bank account signed by the Accountant of the Board and countersigned by the Secretary of the Board or their deputies. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) From time to time according as payments are required the Committee shall supply to the Accountant of the Board such lists of payments, accounts and vouchers as he requires for the preparation of the necessary cheques. Each such list shall be certified as accurate by one Board's Committee-man and one Members' Committee-man and countersigned by the Secretary. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) Save in accordance with this rule, no payment shall be made out of the current bank account. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
9. Accounts of the Fund. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) The Trustees and the Committee shall cause full and true accounts to be kept of the Fund and of all dealings with the Fund. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) The accounts shall be audited annually by the Auditors of the Board who shall certify as to their accuracy and furnish a report thereon. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) The Secretary shall cause a copy of the annual accounts with the auditor's certificate and report to be exhibited in every Department of the Board where any member is employed and shall furnish a copy to any member on demand at a charge of one shilling. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
10. Administration of the Scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) The Scheme shall be administered by a committee consisting of eight Committee-men, of whom four shall be appointed by the Board and four shall be elected by the members. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) The Committee shall meet together for the despatch of business as often as may be necessary and all acts of the Committee and questions coming before the Committee for decision shall be done or decided by the majority vote of the Committee-men present and voting. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) The acts and decisions of the Committee shall not be rendered invalid by any vacancy among the Committee-men or by any defect in the qualification or election of a Committee-man. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(4) A Committee-man shall not be liable for any loss occasioned by negligence or breach of trust if in the opinion of the Board he has acted honestly and ought fairly to be excused. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
11. Repayment of Administrative Expenses by the Board. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
The Board shall repay to the Fund all expenses incurred in the administration of the Fund or the Scheme, not including theamount of benefits paid out of the Fund or the expenses incurred in relation to the investment of the Fund, but including all other expenses incurred by the Trustees or the Committee. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
12. Appointment and Removal of the Board's Committee-men. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) The Board shall appoint from time to time, as occasion may require, such persons as it thinks fit to be the Board's Committeemen. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) The Board may at any time remove from office a Board's Committee-man. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
13. Election of the Members' Committee-men | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) The first election of members' Committee-men shall be held as soon as possible and not more than three months after the date when this scheme is confirmed by the Minister. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) Election of members' Committee-men shall be held in every fifth year after the year in which the first election is held. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) At every election of members' Committee-men after the first election the nomination day shall be such day in the year of election as the Committee shall fix and at the first election the nomination day shall be such day in the period mentioned in clause (1) of this rule as the Board shall fix. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(4) The procedure at an election of members' Committee-men shall be as follows :— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) Not less than 6 weeks before the nomination day the Secretary shall cause to be exhibited in each department of the Board where any member is employed notice of the election specifying the nomination day and giving directions for nomination. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) Any eight members may nominate a member as a candidate by delivering to the Secretary on or before the nomination day a nomination in writing signed by each of the nominating members and accompanied by a written assent to the nomination signed by the person nominated. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) If not more than four candidates are validly nominated they shall be declared elected. If more than four candidates are validly nominated a ballot shall be held on a date, not less than four weeks after the nomination day, to be fixed by the Secretary. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(d) Where a ballot is to be held the Secretary shall post to every member not later than seven days before the day of the ballot a ballot paper showing the names of the nominated candidates in alphabetical order, specifying the day of the ballot and giving directions for voting. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(e) A member may vote at the ballot by completing his ballot paper and returning it so that it reaches the Secretary on or before the day of the ballot. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(f) Two scrutineers shall be appointed—at the first election by the Board and at subsequent elections by the Committee—who shall examine the ballot papers returned and declare the persons elected by notice in writing to the Secretary. The persons so declared elected shall be deemed to have been validly elected. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(g) The Secretary shall cause notice of the result of the election to be exhibited in all Departments of the Board where any member is employed. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(5) Every casual vacancy among the members' Committee-men caused by death, resignation, disqualification or removal shall be filled by the Committee co-opting a person representative of the members. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
14. Tenure of Office of the Members' Committee-men. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) Subject to his death, resignation, removal or disqualification, a members' Committee-man shall continue in office until the next quinquennial election of members' Committee-men has been duly completed. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) A members' Committee-man who ceases to be a member shall be disqualified from being and shall cease to be a members' Committee-man. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) The Committee may at any time remove from office a members' Committee-man who has become incapable of performing his duties efficiently through infirmity or who has been absent from meetings of the Committee for more than six months. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
15. Meetings of the Committee. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) The first meeting of the Committee after a quinquennial election of members' Committee-men shall be held not more than fourteen days after the election and shall be convened by the Secretary. At such first meeting the senior of the Board's Committee-men shall act as Chairman until the re-election of the Chairman of the Committee which shall be the first business of the meeting. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) The Committee shall select one of the Board's Committee-men to be Chairman of the Committee and the person so selected shall continue to be the Chairman (subject to his death, resignation or disqualification) until the completion of the next quinquennial election of members' Committee-men. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) The Chairman of the Committee shall act as chairman of every meeting of the Committee at which he is present. If he is absent or if the office is vacant the senior Board's Committee-man present shall act as chairman of the meeting. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(4) In the case of equality of votes at a meeting of the Committee the chairman of the meeting shall have a second or casting vote. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(5) The quorum at a meeting of the Committee shall be five Committee-men, of whom not less than two shall be Board's Committee-men, and not less than two shall be members' Committee-men. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(6) Subject to these rules, the Committee shall regulate the times and places of their meetings and the procedure at their meetings in such manner as they think fit. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(7) The Committee shall cause proper minutes to be kept of their proceedings. The minutes so kept of any meetings of the Committee purporting to be signed by the chairman of the meeting or of the next succeeding meeting shall be prima facie evidence of the matters and things recorded therein. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
16. The Secretary. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) Subject to the consent of the Board in regard to the particular person appointed the Committee shall appoint one of the staff of the Board to be the Secretary to the scheme and may at any time remove the Secretary and, subject to the like consent, replace him. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) Whenever necessary the Committee may, subject to the consent of the Board, appoint a member of the staff of the Board to act as temporary substitute for the Secretary. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) The Secretary shall act generally under the orders of the Committee. In addition to any duties expressly assigned to him by other provisions of the scheme he shall perform the following duties :— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) he shall keep all records, minutes and accounts relating to the Fund, the Scheme and the business of the Committee ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) he shall receive and report to the Committee all applications for benefits from the Fund and shall bring before the Committee all matters proper to be considered by them ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) he shall be responsible for submitting the accounts of the Fund to the auditors ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(d) any other duties in relation to the Scheme which the Committee shall require of him. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(4) The Board shall appoint a person to be the Secretary for the purposes of the first election of members' Committee-men who shall remain in office until the appointment of a permanent Secretary by the Committee at their first meeting. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
17. The Actuary. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) The Board shall from time to time appoint an actuary for the purposes of the Scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) The Board shall cause an actuarial investigation of the Fund to be made by the Actuary whenever the Board thinks necessary and not less than once every five years. The Actuary shall make a report on every such investigation to the Board, the Committee and the Trustees. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) The Committee may, with the consent of the Board, circulate a report of the Actuary among the members. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
18. Records. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
The Committee shall cause full and true records to be kept of the commencement and ending of membership of every member, the dates and amounts of the contributions of every member and all other relevant matters. They shall cause to be kept a register of members. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
19. Contributions by Members. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) Every member shall make contribution to the Fund. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) Subject to any alterations made under Clause (3) and to the limitation enforced by Clause (5) of this rule, the contributions of a member who is not a Scheduled Officer shall be such percentage of the salary of the member as is specified for the age and sex of the member in the following scale :— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||

(3) At any time and from time to time the Committee may provide that the contributions of all the members of the Scheme, except the Scheduled Officers, shall, in substitution for the scale set out in Clause (2), be regulated by such other scale as the Actuary, after an investigation of the Fund, may recommend as being the scale of contributions required for the time being to maintain the solvency of the Fund. Provided, however, that no member shall be required by such a substituted scale to contribute at a higher rate than fifteen per cent. of his salary. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(4) The contributions of a member shall be deducted by the Board from the member's salary, but if any contribution is not so deducted, it shall be paid into the Fund by the member himself in accordance with any directions of the Trustees. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(5) If the salary of a member at any time exceeds £3,000 he shall contribute under this rule as if his salary were £3,000. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(6) For the calculation of the benefits payable to a member of the Fund on his death or retirement, his salary shall be taken at any time during his service to have been the amount a percentage of which was then actually contributed by him under this rule, except during any period when his salary exceeded £3,000 and he had contributed under Clause (4) of this rule as if his salary had been £3,000. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
20. Contributions by the Board. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) The Board shall make contributions to the Fund in respect of every member equal to the contributions made by such member. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) Where before the commencement of this Scheme deductions have been made from the salary of a person in the employment of the Board in anticipation of this Scheme and such person becomes a member of the Scheme the Board shall pay to the Trustees for the purpose of the Scheme the amount which such person should have contributed in accordance with the rules of this Scheme together with an equal amount representing the contributions of the Board in respect of such person during the period of such deductions. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
21. Superannuation Allowances on Retirement. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) A member who has not less than ten years' pensionable membership and leaves the service of the Board either after having attained the normal age of retirement or by reason of infirmity shall be entitled to receive by way of superannuation allowance from the Fund an annuity calculated in accordance with Clause (3) of this rule. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) For the purposes of this Scheme the normal age of retirement shall be :— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) in relation to a male member—at any time after attaining the age of 60 years but not later than upon attaining the age of 65 years, and | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) in relation to a female member—at any time after attaining the age of 55 years but not later than upon attaining the age of 60 years. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) The rate per annum of the annuity payable to a retiring member under this rule shall not exceed either two-thirds of his retiring average salary or £2,000, but subject to this limit shall be equal to one-sixtieth of his retiring average salary for every year of his pensionable membership. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(4) Any sum payable by the Board on foot of a weekly sum under the Workmen's Compensation Acts to a member who has retired shall be deducted from the sums payable to such member on foot of an annuity under this rule. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(5) An annuity payable to a retiring member under this rule shall continue to be paid for a period of five years or until the member's death whichever of such periods shall be the longer. Any payment of such annuity after the member's death shall be made to his personal representative. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
22. Death Benefit. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) If a member with not less than ten years' pensionable membership dies in the service of the Board leaving a widow or children under 18 years of age, an annuity shall be paid of an amount equalto the annuity to which the member would have been entitled if he had retired on the day of his death in either of the circumstances mentioned in clause (1) of Rule 21, but subject to the following provisions :— | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) if he leaves a widow and no children, the annuity shall be paid to the widow until the expiration of five years from his death or her death or her remarriage, whichever shall first occur ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) if he leaves one child under 18 years of age and no widow, the annuity shall be paid for the benefit of the child until the expiration of five years from the member's death or until the death of the child or his reaching 18 years of age, whichever shall first occur ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) if he leaves two or more children under 18 years of age and no widow, the annuity shall be divided equally between the children and each portion shall be disposed of in accordance with paragraph (b) ; | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(d) if he leaves a widow and a child or children under 18 years of age, the annuity shall be paid to the widow for five years after the member's death unless during that time she either dies or remarries and if she dies or remarries paragraph (b) or paragraph (c) (as may be appropriate) shall apply for the remainder of the said five years as if there had been no widow. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) If a member dies while in the service of the Board, and clause (1) of this rule does not apply, there shall be paid to his legal representative out of the Fund an amount equal to twice his contributions to the Scheme without interest. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
23. Payment of Annuities. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
Any annuity payable under this Scheme shall be paid monthly on the last day of each calendar month—provided,—however, that at the request of the recipient, the Committee may agree that an annuity shall be payable at greater intervals than one month. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
24. Return of Contributions. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) A member who leaves the service of the Board for any reason other than infirmity before reaching the appropriate age mentioned in clause (1) of Rule 21 shall be entitled to a refund of his contributions to the Fund. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) A member who leaves the service of the Board by reason of infirmity who has less than ten years' membership shall be entitled to a refund of his contributions to the Fund with compound interest at two and one half per cent. per annum. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) For the purpose of this rule any deductions made before the commencement of this Scheme from the salary of a person then in the employment of the Board in anticipation of the Scheme shall be deemed to be contributions by such person to the Fund. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(4) Except as expressly provided no interest shall be payable on any contributions refunded to a member under this rule. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(5) The Board shall be entitled to be paid any sums due to it by a member who becomes entitled to a refund of contributions under this rule out of the amount to be refunded. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
25. Proof of Existence and Identity of Recipient. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
It shall be a condition of the payment of any annuity under the Scheme that the person entitled to the payment shall give to the Committee if and so often as shall be so required satisfactory proof of his existence and identity. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
26. Recipient Unable to Manage his Affairs, etc. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
If a person entitled to any payment under this Scheme is in the opinion of the Committee unable by reason of mental or physical illness or defect to manage his affairs or to sign documents, the Committee may from time to time at their discretion order the payment to be made to the husband or wife or other person having charge of such person and such payment shall be made accordingly and shall be deemed to be a payment to such person who shall have no claim in consequence thereof against the Committee or the Trustees or the Fund. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
27. Payment of Sum under One Hundred Pounds on Death of Member. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
Where any sum not exceeding one hundred pounds is due under this Scheme to the personal representatives of a deceased member, probate or other proof of the title of the personal representatives of the deceased may, if the Committee so think fit, be dispensed with and the sum may be paid or distributed to or among the persons appearing to the Committee to be beneficially entitled to the personal estate of the deceased or to or among any one or more of these persons and the Committee, the Trustees and the Board shall be discharged from all liability as respects such payment or distribution. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
28. Application of the Scheme to the Scheduled Officers. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) As soon as may be after the confirmation of this Scheme by the Minister the Board shall deliver to every scheduled officer a copy of the Scheme with a notice directing his attention to this rule. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) A scheduled officer may become a member by giving to the Board a notice in writing stating his desire to become a member not later than one month after either the giving to him of a copy of the Scheme pursuant to clause (1) of this rule or the coming into operation of the Scheme (whichever shall be the later). | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(3) Save by complying with clause (2) of this rule a scheduled officer shall not become a member. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(4) The contributions to the Fund of a scheduled officer who becomes a member shall be at the rate provided for contributions to his superannuation in the contract or Board minute under which he holds his position under the Board, and on his becoming a member he shall contribute only to the Fund and his former contributions under the said contract or Board minute shall cease. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
29. Special Provisions for Persons Promoted from the Wages Grades. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
The following provisions shall apply in relation to an employee of the Board who becomes a member on promotion from a wages grade to a clerical, supervisory or executive position, that is to say : | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(a) For the purpose of determining his pensionable membership, his period of membership of this Scheme shall be increased by two-thirds of his period of service in the wages grade after attaining the age at which persons were entitled to become members of the relevant regular wages staff pension scheme whether in fact he did or did not become such member. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(b) At the commencement of his membership the Board shall make to the Fund a special contribution in respect of him of such amount as shall be advised by the actuary. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(c) If immediately before his promotion he was a member of a regular wages staff pension Scheme the contributions made by him under that Scheme shall be paid over to the Trustees for the purposes of this Scheme and shall be deemed for the said purposes to have been made under this Scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(d) If after paragraph (c) has applied to him he is re-transferred to the wages grade and is then eligible for re-admission to the regular wages staff pension Scheme, he shall be re-admitted accordingly and shall be entitled to reckon for the purposes of benefit his period of membership of this Scheme. He shall also be entitled to receive the total amount (without interest) by whichhis contributions to this Scheme exceeded the amount which he would have contributed to the said regular wages staff pension Scheme during the said period if he had not been promoted. The remainder of his contributions under this Scheme shall be paid to the Trustees of the regular wages staff pension Scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(e) If he is re-transferred to the wages grade and paragraph (d) does not apply to him he shall be entitled to the same refund of contributions to which he would have been entitled in the circumstances mentioned in Rule 25 of this Scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
30. Claims on the Fund. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(1) No person whether as a member or otherwise shall have any claim, right or interest upon, to or in respect of the Fund or any contributions thereto, or any claim upon or against the Committee or the Trustees except under or in accordance with the provisions of the Scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
(2) The decision of the Committee on the validity of a claim on the Fund shall be final, and in making such a decision, the Committee may act on such proofs and presumptions as they consider satisfactory whether the same would be legally admissible as evidence or not. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
31. Inalienability of Annuities. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
Annuities are to be regarded as strictly personal and shall not be assigned, charged, or alienated in any way, and shall cease to be payable if the member shall be adjudged a bankrupt, or take proceedings for liquidation in bankruptcy, or make any arrangement or composition with his creditors having the effect of a charge upon or alienation of his annuity or any part thereof, or assign, charge, or attempt to assign or charge the same, or if any act or event shall have been done or happened which would have the effect of depriving him of his right to receive the annuity or any part thereof had the same belonged to him absolutely for life. The Committee shall have the full discretion as to the payment or application of any forfeited annuity to or for the benefit of the member or his dependants or relatives. Nothing herein contained shall prevent a member from bequeathing by will any moneys from the Fund in which he may have a transmissible interest. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
32. Commencement of the Scheme. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
This Scheme shall come into operation on a date to be fixed by the Minister in his Order confirming the Scheme, not being less than one month after the said confirmation. | ||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
