S.I. No. 170 of 1952.

LOCAL GOVERNMENT (OFFICES) ORDER, 1952.

The Minister for Local Government in exercise of the powers conferred on him by Part II of the Local Government Act, 1941 (No. 23 of 1941) hereby declares and orders as follows :—

1. This Order may be cited as the Local Government (Offices) Order, 1952.

2. In this Order the following words and expressions shall have the meanings hereby assigned to them—

" the Act " means the Local Government Act, 1941 (No. 23 of 1941) ;

" the appropriate Minister " means the appropriate Minister for the purposes of Part II of the Act ;

" the Minister " means the Minister for Local Government ;

" office " means any office within the meaning of Part II of the Act in relation to which the Minister is the appropriate Minister and

" temporary officer " means an officer who is appointed to hold an office—

(a) for a specified period only,

(b) until the completion of a specified work or duty,

(c) until the appointment of another person to the office or

(d) during the absence or incapacity of another person.

3.—(1) Subject to subarticle (2) hereof, every office mentioned in the Schedule hereto and every office, the duties of which are analogous to the duties of any such office, shall be a major office.

(2) The office of a temporary officer shall not be a major office.

(3) The Schedule to and subarticles (1) and (2) of Article 9 of the Local Government (Officers) Regulations, 1943 (S. R. & O. 1943, No. 161) are hereby revoked as respects any office mentioned in the said Schedule in relation to which the Minister is the appropriate Minister.

(4) Every declaration made or deemed to have been made under Section 9 of the Act declaring an office to be a major office is hereby revoked.

4.—(1) The following orders shall cease to have effect and are hereby revoked as respects any office—

(a) Every order in force immediately before the 26th day of August, 1942, and continued in force by Section 14 of the Act—

(i) directing the kind or number of officers to be appointed by a local authority,

(ii) determining the duties, conditions of service or remuneration of an office.

(b) The Local Government (Minor Officers) Order, 1943 (S.R. & O., 1943, No. 46).

(c) The Local Officers (Removal by Local Authority) Regulations, 1943 (S. R. & O., 1943, No. 106).

(2) Article 36 of the Local Government (Officers) Regulations, 1943 (S. R. & O., 1943, No. 161) is hereby revoked in so far as it applies to orders and regulations respecting offices and employments in relation to which the Minister is the appropriate Minister.
