HARBOUR RATES (CLOGHERHEAD AND CARLINGFORD HARBOURS AND GYLES QUAY PIER) ORDER, 1952.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by
section 3
of the
Harbours (Regulation of Rates) Act, 1934
(No. 2 of 1934), hereby order as follows:—
1.—(1) This Order may be cited as the Harbour Rates (Clogherhead and Carlingford Harbours and Gyles Quay Pier) Order, 1952.

(2) This Order shall come into operation on the 17th day of October, 1952.
2.—(1) The rates set out in the Schedules to this Order are hereby fixed as the maximum rates to be charged by the Louth County Council in respect of Clogherhead and Carlingford Harbours and Gyles Quay Pier.

(2) Where the rates fixed under this Order are payable at a tonnage charge, lesser weights shall be chargeable as follows :—
|
| |
(a) any weight not exceeding 5 cwt. shall count as 5 cwt. ;
|
| |
(b) any weight exceeding 5 cwt. but not exceeding 10 cwt. shall count as 10 cwt.;
|
| |
(c) any weight exceeding 10 cwt. but not exceeding 15 cwt. shall count as 15 cwt. ;
|
| |
(d) any weight exceeding 15 cwt. but not exceeding 20 cwt. shall count as one ton.
3. Every statutory or other provision fixing, restricting or otherwise regulating the rates or the maximum or minimum rates chargeable by the Louth County Council on subjects of charge set out in the Schedules to this Order, or the basis on which or method by which such rates are computed, is hereby revoked.

Tonnage Dues on Vessel Other Than Fishing Vessels and Pleasure Boats:
|
|
|
|
(a) On every ton of the net tonnage or half the gross tonnage, whichever is the greater, of every vessel entering the harbour for the purpose of dishcarging or loading cargo and which cargo equals or exceeds in weight the net register tonnage
|
|

(b) In the case of a vessel entering the harbour and not paying the rate at 1 (a) above and loading or discharging cargo less in weight that the net register tonnage of such vessel (and subject to the minimum dues being not less than would be collected if a charge of one penny per register ton were levied) per ton of such cargo loaded or discharged
|

(c) In the case of a vessel entering the harbour and not paying the rates at 1 (a) or 1 (b) above and loading or discharging cargo less in weight than the net register tonnage of such vessel and where a charge of six pence per ton of such cargo would realise dues of less amount than would be realised by a charge of one penny per net register tonnage of the vessel, on every ton of the net register tonnage or half the gross tonnage whichever is the greater

(d) On every ton of the net register tonnage of half the gross tonnage, whichever is the greater, of every vessel entering the harbour to lie up or for shelter and not paying the rates at 1 (a), 1 (b) or 1 (c) above, per day or part of a day

(a) On every fishing vessel (including rowing boats) not exceeding 5 tons gross, using the harbour, as a composition in full of tonnage rates, an annual sum not exceeding
