SOCIAL WELFARE (ASSISTANCE DECISIONS AND APPEALS) (NO. 2) REGULATIONS, 1953. | ||
The Minister for Social Welfare, in exercise of the powers conferred on him by sections 3 , 84 , 101 and 121 of the Social Welfare Act, 1952 (No. 11 of 1952) and paragraph (k) of section 5 of the Social Welfare (Children's Allowances) Act, 1952 (No. 12 of 1952) and of all other powers enabling him in this behalf, hereby makes the following Regulations :— 1. In these Regulations the expression " the Principal Regulations" means the Social Welfare (Assistance Decisions and Appeals) Regulations, 1953 ( S.I. No. 9 of 1953 ). 2.—(1) These Regulations may be cited as the Social Welfare (Assistance Decisions and Appeals) (No. 2) Regulations, 1953. | ||
(2) These Regulations shall be construed as one with the Principal Regulations. 3. Article 4 of the Principal Regulations shall be extended by the addition of the following sub-article— | ||
" (3) Article 8 of the Social Welfare (General Benefit) Regulations, 1953 ( S.I. No. 16 of 1953 ) modified in the manner appearing in Article 10A of these Regulations shall apply to old age pensions, unemployment assistance, widows' and orphans' (non-contributory) pensions and children's allowances." 4. Part III of the Principal Regulations shall be extended by the addition of the following article— | ||
" 10A. Where it appears to the Minister that a question has arisen or may arise as to whether— | ||
(a) the conditions for the receipt of assistance payable under a decision are or were fulfilled, or | ||
(b) a decision that assistance is payable ought to be revised under Article 10 of these Regulations | ||
he may direct that payment of the assistance shall be suspended in whole or in part until the question has been decided." | ||
