Casual vacancy among members of the Board. |
18.—(1) A casual vacancy occurring among the members of the Board shall be filled by nomination by the Minister of— | |
(a) in case the member occasioning the vacancy was an officer of the Minister, an officer of the Minister, | ||
(b) in case the member occasioning the vacancy was nominated for membership by any group of persons, manufacturers or societies or was a person whom the Minister considered to be representative of any group of persons, manufacturers or societies or of the Company, a person whom the Minister considers to be representative of that group or the Company as the case may be, and | ||
(c) in case the vacancy was caused by the failure of any group of persons or societies specified in sections 9 and 10 of this Act to nominate a person for membership, a person whom the Minister considers to be representative of that group. | ||
(2) (a) If— | ||
(i) in relation to a nominating provision, on the nomination day in any nomination year no person stands proposed under that nominating provision, or | ||
(ii) a person nominated as a member of the Board in any nomination year under a nominating provision or under paragraph (c), (d) or (e) of subsection (2) of section 8 of this Act, dies before the commencement of his term of office as such member, | ||
there shall, on the day on which the term of office of members of the Board nominated in that year commences, be deemed to be a casual vacancy among the members of the Board. | ||
(b) Each of the following provisions of this Act, that is to say, subsections (1), (2) and (3) of section 9 and section 10 , shall be a nominating provision for the purposes of this subsection. |
