ROAD TRAFFIC (BYE-LAWS AND TEMPORARY RULES) REGULATIONS, 1961.

The Minister for Local Government in exercise of the powers conferred on him by section 5, subsections (1) and (3) of section 6, subsection (3) of section 84, subsection (4) of section 89 and subsection (7) of section 90 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following Regulations:—

1. These Regulations may be referred to as the Road Traffic (Bye-laws and Temporary Rules) Regulations, 1961.

2. In these Regulations—

"the Act" means the Road Traffic Act, 1961 ;

"the Minister" means the Minister for Local Government;

"the Commissioner" means the Commissioner of the Garda Síochána.

3.—(1) Where a bye-law, which is required by the Act to be made with the consent of the Minister, is made by the Commissioner under the Act two copies of the bye-law shall be sent to the Minister for his consideration.

(2) Where the bye-law is required by the Act to be made after consultation with the local authority concerned there shall be sent to the Minister with the said copies such evidence as shall satisfy the Minister that the requirements of subsection (5) of section 6 of the Act have been complied with.

4.—(1) Where the Commissioner makes bye-laws under the Act and such bye-laws are approved by the Minister the Commissioner shall publish in at least three newspapers circulating in the area in which the bye-laws are to have effect (of which one at least shall be a daily newspaper) a notice of the making of the bye-laws.

(2) Every such notice shall contain—

(a) a statement that bye-laws have been made by the Commissioner and a statement of the section of the Act under which such bye-laws have been made;

(b) a statement of the name of the functional area of the local authority in which the bye-laws are to have effect and

(c) a statement of the place at which copies of the bye-laws are on sale and the price to be charged for such copies.

5. Where the Commissioner makes temporary rules under the Act he shall give notice in relation to such rules by publishing in at least three newspapers circulating in the area in which the rules are to have effect (of which one at least shall be a daily newspaper) a notice containing—

(a) a statement that temporary rules have been made by the Commissioner and a statement of the section of the Act under which the rules have been made;

(b) a statement of the date on which the rules are to come into operation;

(c) a statement of the name of the functional area of the local authority in which the rules are to have effect and

(d) a statement of the place at which copies of the rules are on sale and the price to be charged for such copies.

EXPLANATORY NOTE.

These Regulations prescribe the manner in which certain bye-laws made by the Commissioner of the Garda Síochána under the Road Traffic Act, 1961 are to be submitted to the Minister for Local Government for approval and the manner in which bye-laws and temporary rules made by the Commissioner under the said Act are to be published.
