UNEMPLOYMENT ASSISTANCE (QUALIFICATION CERTIFICATE REGULATIONS) (AMENDMENT) ORDER, 1962.

I, CAOIMHGHÍN Ó BEOLÁIN, Minister for Social Welfare, in exercise of the powers conferred on me by subsection (1) of section 7 of the Unemployment Assistance Act, 1933 (No. 46 of 1933), as adapted by the Social Welfare (Transfer of Departmental Administration and Ministerial Functions) (No. 1) Order, 1947 (S.R. & O., No. 18 of 1947), hereby order as follows:

1. This Order may be cited as the Unemployment Assistance (Qualification Certificate Regulations) (Amendment) Order, 1962.

2. This Order shall come into operation on the 1st day of August, 1962.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. In this Order " the Principal Order " means the Unemployment Assistance (Qualification Certificate Regulations) Order, 1934 (S.R. & O., No. 33 of 1934).

5. Regulation (4) of the Principal Order is hereby amended by—

(a) the insertion in paragraph (a) after " Order " of " or a form substantially to the like effect,"

(b) the substitution in the proviso to paragraph (a) for " and with such modifications (if any) of the said Form as the Minister may direct " of " as the Minister may direct and in the said Form with such modifications (if any) thereof as the Minister may direct or in a form substantially to the like effect as the said Form or as the said Form as so modified, as the case may be," and

(c) the substitution in paragraph (b) for " Form set out in the First Schedule to this Order " of " form of application for a qualification certificate."

6. Regulation (6) of the Principal Order is hereby amended by the insertion after " Order " of " or a form substantially to the like effect."

7. The First Schedule to the Principal Order, as amended by the Unemployment Assistance (Qualification Certificate Regulations) (Amendment) Order, 1935 (S.R. & O., No. 574 of 1935), the Unemployment Assistance (Qualification Certificate Regulations) (Amendment) (No. 2) Order, 1938 (S.R. & O., No. 229 of 1938), and the UnemploymentAssistance (Qualification Certificate Regulations) (Amendment) Order, 1953 ( S.I. No. 3 of 1953 ), is hereby further amended by the substitution therein for the form of an application for a qualification certificate of the form set out in the First Schedule to this Order.

8. The Second Schedule to the Principal Order, as amended by the Unemployment Assistance (Qualification Certificate Regulations) (Amendment) Order, 1938 (S.R. & O., No. 194 of 1938), the Unemployment Assistance (Qualification Certificate Regulations) (Amendment) Order, 1952 ( S.I. No. 167 of 1952 ), the Unemployment Assistance (Qualification Certificate Regulations) (Amendment) Order, 1953 ( S.I. No. 3 of 1953 ), and the Unemployment Assistance (Qualification Certificate Regulations) (Amendment) Order, 1961 ( S.I. No. 161 of 1961 ), is hereby further amended by the substitution therein for the form of a qualification certificate of the form set out in the Second Schedule to this Order.

The conditions to be fulfilled by a person obtaining or holding a Qualification Certificate under the Unemployment Assistance Act, 1933 , are :—

(a) that he is at the date of the application resident in the State and has at any time been resident in the State for a continuous period of at least six months;

(b) that he has attained the age of 18 years and has not attained the age of 70 years;

(i) the amount of the scheduled rate of unemployment assistance applicable to a person who has an adult dependant and is resident in an urban area, and

(ii) in case he has a child dependant or child dependants, so much of the scheduled rate of unemployment assistance applicable to the person as is payable in respect of the child dependant or child dependants, as the case may be;

(d) in the case of a married woman, either—

(i) that her husband is a dependant of her, or

(ii) that neither she nor her husband is a dependant of the other and she has one or more dependants;

(e) in the case of a widow or spinster, that she has one or more dependants;

(f) in the case of a widow or spinster who has no dependant, that not less than fifty-two contributions have been paid in respect of her during the appropriate period.

EXPLANATORY NOTE

The Social Welfare (Miscellaneous Provisions) Act, 1962, replaces the present fixed yearly means limit for entitlement to a qualification certificate under the Unemployment Assistance Acts by a higher limit which varies with the number of the applicant's child dependants.

The change, which will operate from 1st August, 1962, necessitates consequential amendments in (a) the prescribed form of application for a qualification certificate, and (b) the prescribed form of a qualification certificate. This Order prescribes the amended forms, and also, by suitable amendment of the original Order made in 1934, provides for the use of forms substantially to the like effect as those now prescribed.
