ESTABLISHMENT ORDER (SUGAR CONFECTIONERY AND FOOD PRESERVING JOINT LABOUR COMMITTEE) AMENDMENT ORDER, 1962.

WHEREAS the Sugar Confectionery and Food Preserving Trade Board (hereinafter called "the Board") was established by Regulations dated 1st March, 1933, made by the Minister for Industry and Commerce ( S.R. & O. No. 50 of 1933 ) (hereinafter called "the said Regulations") for the trade specified in the Trade Boards (Sugar Confectionery and Food Preserving) Order, 1913 (hereinafter called "the said Order") and set out in the Schedule to the said Regulations;

AND WHEREAS the said Order was varied by the Trade Boards (Sugar Confectionery and Food Preserving Trade) Special Order, 1945;

AND WHEREAS the said Regulations were amended by the Trade Boards (Sugar Confectionery and Food Preserving Trade) (Amendment) Regulations, 1945;

AND WHEREAS the Board was a Trade Board which existed immediately before the commencement of the Industrial Relations Act, 1946 , (hereinafter called "the Act") and by virtue of Section 53 of the Act is deemed to be a Joint Labour Committee established under Part IV of the Act by an Establishment Order and operating in relation to the workers and employers in relation to whom it operated immediately before such commencement;

AND WHEREAS application has been made to the Labour Court in accordance with Section 40 of the Act by the Minister for Industry and Commerce for an Order varying the specification of the trade for which the Board was established and in which the employers and workers in relation to whom the Sugar Confectionery and Food Preserving Joint Labour Committee operates are engaged;

AND WHEREAS the requirements of Section 40 of the Act have been complied with in respect of such application;

NOW, THEREFORE, the Court in exercise of the powers conferred on it by Section 40 of the Act hereby orders as follows :—

(1) The said Order is hereby amended by the substitution for the appendix thereto of the Schedule to this Order.

(2) The said Regulations are hereby amended by the substitution for the Schedule thereto of the Schedule to this Order.

(3) This Order shall come into operation on the 14th day of August, 1962.

(4) This Order may be cited as the Establishment Order (Sugar Confectionery and Food Preserving Joint Labour Committee) Amendment Order, 1962.

SCHEDULE

The Sugar Confectionery and Food Preserving Trade, that is to say :—

(a) the making of sugar confectionery, cocoa, chocolate, jam, marmalade, preserved fruits, fruit and table jellies, meat extracts, meat essences, sauces and pickles,

(b) the preparation of meat, poultry, game, fish, vegetables and fruit for sale in a preserved state in tins, pots, bottles and similar receptacles,

(c) the processes of wrapping, boxing, parcelling, bottling, filling, packing, labelling, warehousing and despatching when such processes are carried out in connection with any making or preparation referred to in paragraph (a) or paragraph (b) above.

(d) all operations (including, in particular, the cleaning of premises, utensils and plant), incidental or appertaining to the making of articles referred to in paragraph (a) of this Schedule, to the preparation of articles referred to in paragraph (b) of this Schedule, or to the processes referred to in paragraph (c) of this Schedule,

But Excluding—

(i) maintenance work of all descriptions (including the maintenance of steam and power),

(ii) transport,

(iii) non-industrial work,

(iv) the covering and filling of biscuits, wafers and cakes with chocolate or sugar confectionery, and

(v) work in which workers affected by a registered employment agreement are engaged.

EXPLANATORY NOTE

This Instrument alters the scope of the Sugar Confectionery and Food Preserving Joint Labour Committee by the exclusion therefrom of work in which workers affected by a registered employment agreement are engaged.
