DOCKS (SAFETY, HEALTH AND WELFARE) (FORMS) REGULATIONS, 1965.

I, JOHN LYNCH, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 71 of the Factories Act, 1955 (No. 10 of 1955), by virtue of the operation of section 86 of that Act and, in so far as the following regulations are made in exercise of powers conferred by the said section 71, after consultation with the Minister for Health, hereby make as special regulations, the following regulations:

1.—(1) These Regulations may be cited as the Docks (Safety, Health and Welfare) (Forms) Regulations, 1965.

(2) These Regulations shall come into operation on the 7th day of April, 1965.

2. In these Regulations " the Principal Regulations " means the Docks (Safety, Health and Welfare) Regulations, 1960 ( S.I. No. 279 of 1960 ).

3.—(1) The form contained in Part I of the First Schedule to these Regulations is hereby prescribed as the form of notice under clause (i) of subparagraph (b) of paragraph (4) of Regulation 4 of the Principal Regulations.

(2) The form contained in Part II of the First Schedule to these Regulations is hereby prescribed as the form of written acknowledgment under paragraph (5) of the said Regulation 4.

4.—(1) The form contained in Part I of the Second Schedule to these Regulations is hereby prescribed, for the purposes of Regulation 26 of the Principal Regulations, as the form of certificate of the test and examination under paragraph (1) of Regulation 22 of the Principal Regulations of winches, derricks and accessory gear and the particulars specified in the form are hereby prescribed, for the purposes of the said Regulation 26, as the particulars of the test and examination aforesaid to be contained in the form.

(2) The form contained in Part II of the Second Schedule to these Regulations is hereby prescribed, for the purposes of Regulation 26 of the Principal Regulations, as the form of certificate of the test and examination under paragraph (1) of Regulation 22 of the Principal Regulations of cranes or hoists and their accessory gear and the particulars specified in the form are hereby prescribed, for the purposes of the said Regulation 26, as the particulars of the test and examination aforesaid to be contained in the form.

5. The form contained in the Third Schedule to these Regulations is hereby prescribed, for the purposes of Regulation 26 of the Principal Regulations, as the form of certificate of the test and examination under paragraph (1) of Regulation 23 of the Principal Regulations of chains, rings, hooks, shackles, swivels and pulley blocks used in hoisting or lowering and the particulars specified in the form are hereby prescribed, for the purposes of the said Regulation 26, as the particulars of the test and examination aforesaid to be contained in the form.

6. The form contained in the Fourth Schedule to these Regulations is hereby prescribed, for the purposes of Regulation 26 of the Principal Regulations, as the form of certificate of annealing under paragraph (2) of Regulation 23 of the Principal Regulations and the particulars specified in the form are hereby prescirbed, for the purposes of the said Regulation 26, as the particulars of the annealing aforesaid to be contained in the form.

7. The form contained in the Fifth Schedule to these Regulations is hereby prescribed, for the purposes of Regulation 26 of the Principal Regulations, as the form of certificate of the test and examination under paragraph (1) of Regulation 24 of the Principal Regulations of wire rope and the particulars specified in the form are hereby prescribed, for the purposes of the said Regulation 26, as the particulars of the test and examination aforesaid to be contained in the form.

8. The form contained in the Sixth Schedule to these Regulations is hereby prescribed, for the purposes of the certificate of exemption made by the Minister for Industry and Commerce under paragraph (3) of Regulation 23 of the Principal Regulations on the 31st day of December, 1960, as the form of certificate of examination of the gear specified in the said certificate and the particulars specified in the form are hereby prescribed, for the purposes of the said certificate, as the particulars of the examination aforesaid to be contained in the form.

9. A register in the form of the register which, sealed with the seal of the Minister and dated the 31st day of March, 1965, is deposited in the Office of the Chief Inspector of Factories, Department of Industry and Commerce, Kildare Street, Dublin, is hereby prescribed as the form of register for the purposes of the said Regulation 26 and of the certificate of exemption made by the Minister for Industry and Commerce under paragraph (3) of Regulation 23 of the Principal Regulations on the 31st day of December, 1960.

A. If the machinery is on a ship, the name of the ship must be stated. Sufficient particulars must be given to identify the gear. For example, in the case of a winch or derrick, the number of the hold, etc., should be shown.

B. As a rule, a derrick should be tested with the boom at the lowest position at which it is to be used.

NOTES

1. The manner of test and examination laid down in the Schedule to the Regulations is as follows:—

(i) Every winch with the whole of the gear accessory thereto (including derricks, goosenecks, eye-plates, eye-bolts or other attachments) shall be tested with a proof load which shall exceed the safe working load as follows:—

The proof load shall be applied either (i) by hoisting movable weights or (ii) by means of a spring or hydraulic balance or similar appliance, with the derrick at an angle to the horizontal which shall be stated in the certificate of the test. In the former case, after the movable weights have been hoisted, the derrick shall be swung as far as possible in both directions. In the latter case, the proof load shall be applied with the derrick swung as far as practicable first in one direction and then in the other.

(ii) After being tested, all machinery with the whole of the gear accessory thereto shall be examined to see whether any part has been injured or permanently deformed by the test.

2. The test and examination must be made by a competent person.

Under Regulation 25, a person will not be deemed to be a competent person if and in so far as the Minister for Industry and Commerce has given notice in writing that such person is in his opinion not technically qualified to carry out the tests or examinations required.

3. If the test and examination are made by public officials or by employees of an association or firm undertaking such tests and examinations, the certificate should be signed by a responsible officer of the public service, association or firm, who should state his position therein, at heading (6) overleaf. In the case of a ship's officer, he should state his rank.

If the test and examination are made by a person working on his own account, he should sign the certificate after briefly stating his technical qualifications at heading (6) overleaf.

1. The manner of test and examination laid down in the Schedule to the Regulations for lifting machinery other than winches and derricks is as follows:—

(i) Every crane and other hoisting machine with its accessory gear shall be tested with a proof load which shall exceed the safe working load as follows:—

The said proof load shall be hoisted and swung as far as possible in both directions. In the case of jib cranes, if the jib of the crane has a variable radius, it shall be tested with a proof load as defined above at the maximum and minimum radii of the jib. In the case of hydraulic cranes or hoists, where owing to the limitation of pressure it is impossible to hoist a load 25 per cent. in excess of the safe working load, it shall be sufficient to hoist the greatest possible load.

(ii) After being tested, each crane or hoist with the whole of the gear accessory thereto shall be examined to see whether any part has been injured or permanently deformed by the test.

2. The test and examination must be made by a competent person.

Under Regulation 25, a person will not be deemed to be a competent person if and in so far as the Minister for Industry and Commerce has given notice in writing that such person is in his opinion not technically qualified to carry out the tests or examinations required.

2. The Minister for Industry and Commerce has exempted the following classes of gear from the requirements set forth in Note 1 (i) above, provided they have been tested with the proof loads indicated below:—

3. The test and examination must be made by a competent person. If this person is working on his own account, his technical qualifications must be briefly stated at heading (10). If he is a public official or an employee of an association or firm undertaking such tests and examinations, his position in the public service, association or firm should be stated. If he is a ship's officer, his rank should be stated.

Under Regulation 25, a person will not be deemed to be a competent person if and in so far as the Minister for Industry and Commerce has given notice in writing that such person is in his opinion not technically qualified to carry out the tests or examinations required.

(a) The requirements as to annealing and the competency of the person under whose supervision the annealing is carried out, are explained overleaf.

(b) It is recommended-though not required by the Regulations—that annealing should be carried out in a suitably constructed furnace heated to a temperature between 1,100° and 1,200° Fahrenheit or 600° and 650° Centigrade.

2. The annealing must be carried out under the supervision of a competent person. If this person is working on his own account, his technical qualifications should be briefly stated at heading (8) overleaf. If he is a public official or an employee of an association or firm undertaking annealing, his position in the public service, association or firm should be stated. If he is a ship's officer, his rank should be stated.

Under Regulation 25, a person will not be deemed to be a competent person if and in so far as the Minister for Industry and Commerce has given notice in writing that such person is in his opinion not technically qualified to carry out the annealing required.

3. The requirement of annealing does not apply to bridle chains attached to derricks or masts, and the following classes of gear have been exempted from annealing subject to the conditions stated below:—

(1) Chains made of malleable cast iron;

(2) Plate link chains;

(3) Chains, rings, hooks, shackles and swivels made of steel;

(4) Pitched chains;

(5) Rings, hooks, shackles and swivels permanently attached to pitched chains, pulley blocks or weighing machines;

(6) Hooks and swivels having screw-threaded parts or ball bearings or other case-hardened parts;

(7) Bordeaux connections.

These classes of gear have been exempted from annealing subject to the conditions that such gear shall be thoroughly examined by a competent person once at least in every twelve months and that, before the gear is subsequently taken into use, the prescribed certificates of such examinations shall be entered in or attached to the prescribed register.

1. In pursuance of Regulation 23 (3) the Minister for Industry and Commerce has exempted the following classes of gear from the requirements of the said Regulation as to annealing:—

(1) Chains made of malleable cast iron;

(2) Plate link chains;

(3) Chains, rings, hooks, shackles and swivels made of steel;

(4) Pitched chains;

(5) Rings, hooks, shackles and swivels permanently attached to pitched chains, pulley blocks or weighing machines;

subject to the conditions that such gear shall be thoroughly examined by a competent person once at least in every twelve months, and certificates in the prescribed form and containing the prescribed particulars with regard to such examinations shall be obtained and entered in or attached to the prescribed register before the gear to which the certificate refers is subsequently taken into use in connection with the processes.

2. For the purposes of this exemption thorough examination means a visual examination, supplemented if necessary by other means, carried out as carefully as the conditions permit, in order to arrive at a reliable conclusion as to the safety of the parts examined; and if necessary for the purpose, parts of the gear must be dismantled.

3. If the examination is made by a public official or by an employee of an association or firm undertaking such examinations, the certificate should be signed by a responsible officer of the public service association or firm, who should state his position therein, at heading (6) overleaf. In the case of a ship's officer, he should state his rank.

If the examination is made by a person working on his own account, he should sign the certificate after briefly stating his technical qualifications at heading (6) overleaf.

Under Regulation 25, a person will not be deemed to be a competent person if and in so far as the Minister for Industry and Commerce has given notice in writing that such person is in his opinion not technically qualified to carry out the tests or examinations required.

EXPLANATORY NOTE.

The purpose of these Regulations is to prescribe the forms for use in connection with the Docks (Safety, Health and Welfare) Regulations, 1960.
