AGRICULTURAL WAGES (MINIMUM RATES) ORDER, 1966.

The Agricultural Wages Board, in exercise of the powers conferred on them by Section 17 of the Agricultural Wages Act, 1936 (No. 53 of 1936), and of every and any other power them in this behalf enabling, hereby order as follows :—

1. (1) This Order may be cited as the Agricultural Wages (Minimum Rates) Order, 1966.

(2) (a) The provisions of this Order relating to Table " A " of each of the Second, Third, Fourth, Sixth and Seventh Schedules shall come into operation on the 6th day of June, 1966.

(b) The provisions of this Order relating to Table " B " of each of the Second, Third, Fourth, Sixth and Seventh Schedules shall come into operation on the 1st day of October, 1966.

(3) As from the 1st day of October, 1966, in respect of each of the Second, Third, Fourth, Sixth and Seventh Schedules Table " B " thereof shall be substituted in each case for Table " A ".

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In this Order—

As regards workers paid at the prescribed weekly minimum rates, the word " Winter " means the period commencing on the 1st day of November in any year and terminating on the last day of February in the next succeeding year, and as regards workers paid at the prescribed monthly minimum rates, the word " Winter " means the period commencing on the 1st day of October in any year and terminating on the last day of February in the next succeeding year;

As regards workers paid at the prescribed weekly minimum rates, the expression " remainder of the year " means the period commencing on the 1st March in any year and terminating on the 31st October in the same year, and as regards workers paid at the prescribed monthly minimum rates, the expression " remainder of the year " means the period commencing on the 1st day of March in any year and terminating on the 30th day of September in the same year;

the word " week " means any period of seven consecutive days;

the expression " weekly half-holiday " means a half-holiday under the Agricultural Workers (Weekly Half-Holidays) Act, 1952 .

4. The minimum rates of wages in respect of each wages district specified in the first column of the First Schedule hereto shall be the rates set out in the Schedule or Schedules mentioned in the fourth column of the said First Schedule opposite to the mention in such first column of such wages district and in the application of such rates to such wages district the following provisions shall have effect—

(a) where in the third column of the First Schedule hereto the whole of a wages district is mentioned as the scope of application of the minimum rates of wages fixed in respect of such wages district by this Order, such rates shall apply to such wages district universally,

(b) where in the third column of the First Schedule hereto special parts of a wages district are mentioned as the scope of application of the minimum rates of wages fixed in respect of such wages district by this Order, the rates of wages set out in the Schedule mentioned in the fourth column of such First Schedule opposite to the mention of each of such special parts shall apply to each of such special parts respectively,

(c) the rates of wages specified in any Schedule made applicable under this Order to a wages district, or to a special part of a wages district, shall in such wages district, or special part of a wages district, be payable in respect of the special classes of workers mentioned in the first column of such Schedule.

5. Where the minimum rates of wages set out in the Second, Third or Fourth Schedule hereto are made applicable by this Order to any wages district or to any special part of a wages district, and any agricultural employer in such wages district or special part provides any agricultural worker in his employment with all or any of the benefits or advantages specified in the first column of the Fifth Schedule hereto, such benefits or advantages shall, for the purpose of computing the wages paid to such agricultural worker, be reckoned as payment of wages in lieu of payment in cash, and the value at which any such benefit or advantage so provided is to be so reckoned shall be that indicated in respect thereof in the said Fifth Schedule.

6. Where for any district a rate of wages (hereinafter referred to as the winter rate) is fixed by this Order in respect of work done by an agricultural worker in winter and a different rate (hereinafter referred to as the rate for the remainder of the year) is fixed by this Order as the rate of wages in respect of work done by such agricultural worker during the remainder of the year, then for the purpose of calculating the amount of any sum payable as wages to such agricultural worker for work done partly in winter and partly during the remainder of the year, the winter rate shall be the rate of wages for so much of such work as may be done in winter, and the rate for the remainder of the year shall be the rate of wages for so much of such work as may be done during the remainder of the year.

7. Where an agricultural worker for whom an overtime rate is prescribed by this Order is allowed a holiday under the Agricultural Workers (Holidays) Acts, 1950 to 1961, he shall be regarded as having completed nine hours work on that holiday for the purpose of computing the wages, if any, payable to him for overtime in the week in which the holiday is allowed.

8. For the purpose of computing the wages payable to a worker who, by his contract of employment, is allowed a holiday on St. Patrick's Day or Christmas Day in respect of the week in which St. Patrick's Day or Christmas Day (as the case may be) falls, notwithstanding that he does not or is not required to work on such holiday, he shall be regarded as having completed 9 hours work on such day, and (a) he shall be entitled to wages in respect of such week at the same rate per week or per hour as he would be entitled to if the said St. Patrick's Day or Christmas Day fell on the Sunday of that week, and (b) for work (if any) done by such worker on St. Patrick's Day or on Christmas Day he shall be entitled to wages at the rate per hour payable in respect of work done on a Sunday in addition to the wages under paragraph (a) hereof.

EXPLANATORY NOTE.

The effect of this Order is

(1) to increase the minimum rates of wages payable to male agricultural workers in all counties and to female agricultural workers in Counties Dublin and Kildare, as from 6th June, 1966, and 1st October, 1966; and

(2) to increase the allowances for meals (Fifth Schedule).
