S.I. No. 211 of 1966.

DISTRICT COURT (SUMMONS-SERVERS FEE) RULES, 1966

The District Court Rules Committee, in exercise of the powers conferred on them by section 91 of the Courts of Justice Act, 1924 , section 72 of the Courts of Justice Act, 1936 , and section 48 of the Courts (Supplemental Provisions) Act, 1961 , and with the concurrence of the Minister for Justice, do hereby make the following Rules:—

1. These Rules may be cited as the District Court (Summons-servers Fee) Rules, 1966.

2. These Rules shall come into operation on the 1st day of October, 1966, and shall be read together with all other District Court Rules for the time being in force.

3. The following Rules are hereby annulled:—

(a) Rule 52 of the District Court Rules, 1948 ( S. R. & O. No. 431 of 1947 ), as amended by Rule 7 of the District Court Rules, 1955 ( S.I. No. 83 of 1955 ).

(b) Rule 130 of the District Court Rules, 1948 ( S. R. & O. No. 431 of 1947 ), inserted by Rule 5 of the District Court Rules (No. 2), 1955 ( S.I. No. 84 of 1955 ).

(c) Rule 28 of the District Court Rules (No. 2), 1962 ( S.I. No. 8 of 1962 ), as amended by Rule 8 of the District Court (Amending) Rules, 1962 ( S.I. No. 178 of 1962 ).

4. The fee to be paid to a summons-server for the service of any summons, civil process, originating or any other Court document shall be the sum of six shillings payable on proof of each separate service effected.

EXPLANATORY NOTE

These Rules, which come into operation on the 1st October, 1966, provide for a revision in the amount of the fees payable to summons-servers.
