SOLICITORS ACT 1954 (APPRENTICESHIP AND EDUCATION) (AMENDMENT) REGULATIONS, 1968.

The Incorporated Law Society of Ireland in exercise of the powers conferred on them by sections 4 , 5 and 40 of the Solicitors Act 1954 and of every other power thereunto them enabling hereby make the following regulations.

1. These regulations may be cited as the Solicitors Act 1954 (Apprenticeship and Education) (Amendment) Regulations, 1965, and shall be read together with the Solicitors Act 1954 (Apprenticeship and Education) Regulations, 1955 ( S.I. No. 217 of 1955 ) hereinafter called "the principal regulations"), the Solicitors Act 1954 (Apprenticeship and Education) (Amendment) Regulations 1956 ( S.I. No. 307 of 1956 ) the Solicitors Act 1954 (Apprenticeship and Education) (Amendment) Regulations 1965 ( S.I. No. 201 of 1965 ) and the Solicitors Act, 1954 (Apprenticeship and Education) (Amendment) Regulations 1966 ( S.I. No. 230 of 1966 ) which may be cited together with these regulations as the Solicitors Act 1954 (Apprenticeship and Education) Regulations 1955 to 1968.

2. These regulations shall come into operation on the 16th day of January 1968.

3. The Interpretation Act, 1937 shall apply for the purpose of the interpretation of these regulations as it applies for the purpose of the interpretation of an Act of the Oireachtas, except in so far as it may be inconsistent with the Act or with these regulations.

4. The following sub-paragraph shall be substituted for sub-paragraph (2) of paragraph 14 of the principal regulations.

(2) If the Court of Examiners are satisfied with the evidence of character submitted by the intending apprentice and with the information obtained from any other enquiries made and with the result of any enquiries made as to the fitness and capacity of the master to teach such intending apprentice and that the intending apprentice has complied with the provisions of the Act and regulations made thereunder concerning admission to apprenticeship, written consent shall be issued in such form and manner as they may direct to the entry of such person into indentures of apprenticeship with the master.

5. The following sub-paragraph shall be substituted for sub-paragraph (3) of paragraph 14 of the principal regulations.

(3) An application for registration of identures of apprenticeship shall be made by lodging with the Society within six months from the date of their execution the original indentures of apprenticeship duly executed together with a statutory declaration as to due execution of the indentures of apprenticeship in Form AE 4 in the schedule hereto. Such application shall be made within six months from the date of the written consent mentioned in sub-paragraph (2) of this paragraph.

6. The following sub-paragraph shall be substituted for sub-paragraph (1) of paragraph 28 of the principal regulations.

(1) The Court of Examiners on being satisfied as to the proficiency and fitness of a candidate at any examination shall report accordingly to the Council and the Council may thereupon direct in such form as they may think fit that the candidate has passed the examination.

7. The following sub-paragraph shall be substituted for sub-paragraph (2) of paragraph 28 of the principal regulations.

(2) If any allegation is made by the secretary of the Society or the registrar of solicitors as to the unfitness on any ground of any candidate to be an officer of the Courts, such allegation shall be considered by the Court of Examiners who may make such enquiries as they think fit. If the allegation is proved to the satisfaction of the Court of Examiners they may report thereon to the Council and the Council may, in their discretion, refuse to issue the direction mentioned in sub-paragraph (1) of this paragraph.

8. Forms AE 4, AE 6 and AE 8 of the principal regulations are hereby revoked. Form AE 5 is hereby renumbered AE 4 and form AE 7 is renumbered AE 5 and reference to the forms in the principal regulations as amended shall be construed accordingly.

EXPLANATORY NOTE.

The effect of these regulations is to provide for a quicker and less formal method of certifying attendance at lectures and the results of examinations conducted by the Incorporated Law Society of Ireland than the method prescribed by the present regulations.
