FOOT AND MOUTH DISEASE (RESTRICTION ON THE MOVEMENT OF PERSONS) (No. 2) ORDER, 1968. | ||
I, NEIL T. BLANEY, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by section 3 of the Diseases of Animals Act, 1966 (No. 6 of 1966), hereby, for the prevention of the spreading of foot and mouth disease, order as follows: 1. (1) This Order may be cited as the Foot and Mouth Disease (Restriction on the Movement of Persons) (No. 2) Order, 1968. | ||
(2) This Order shall come into operation on the 11th day of April, 1968. 2. In this Order "animals" means— | ||
(a) cattle, goats, sheep and all other ruminating animals, and | ||
(b) swine. 3. (1) This Order applies to every person who arrives in the State and who at any time during the period of twenty-one days ending on the day of such arrival has been in any of the following places or any of the following premises (including any other land which is used in relation to the premises) being places or premises both in Great Britain and within an area which at any time within the said period was an infected area : | ||
(a) any wholesale meat market; | ||
(b) any premises in which meat or meat products are processed for sale other than a retail premises or a catering establishment; | ||
(c) any artificial insemination station; | ||
(d) any creamery or any other premises used for the processing of milk; | ||
(e) any cold store which is used— | ||
(i) for the storage of meat or any other animal or milk products, and | ||
(ii) in relation to the conduct of a cold storage business; | ||
(f) any other building or any other land, on which animals were present or to which animals had access at the time when the person was in the building or on the other land; | ||
and this Order shall continue to apply to such person for the period of twenty-one days commencing on the day after such arrival. | ||
(2) In this Article "infected area" means an area declared by an Order of the Minister of Agriculture, Fisheries and Food, London, or the Secretary of State for Scotland to be an infected area for the purpose of preventing the spread of foot and mouth disease. 4. A person to whom this Order for the time being applies shall not enter any of the following places or any of the following premises (including any other land which is used in relation to the premises): | ||
(a) any wholesale meat market; | ||
(b) any premises in which meat or meat products are processed for sale other than a retail premises or a catering establishment; | ||
(c) any artificial insemination station; | ||
(d) any creamery or any other premises used for the processing of milk; | ||
(e) any cold store which is used— | ||
(i) for the storage of meat or any other animal or milk products, and | ||
(ii) in relation to the conduct of a cold storage business; | ||
(f) any other building or any other land, on which animals are present or to which animals have access for the time being. 5. The owner of, or any person holding a position of responsibility in or in relation to any place, premises or land mentioned in Article 4 shall not permit any person to whom this Order for the time being applies to enter the place, premises or land. 6. (1) The Foot and Mouth Disease (Restriction on the Movement of Persons) Order, 1968 ( S.I. No. 25 of 1968 ), and the Foot and Mouth Disease (Restriction on the Movement of Persons) (Amendment) Order, 1968 ( S.I. No. 59 of 1968 ), are hereby revoked. | ||
(2) In case immediately before the coming into operation of this Order the Orders mentioned in paragraph (1) applied to a person and that person would, if this Order had been in force at the time of his arrival in the State, have been a person to whom this Order applies, the said Orders shall, notwithstanding paragraph (1), continue to apply to that person in the same manner as if this Order had not been made. | ||

EXPLANATORY NOTE. | ||
This Order | ||
(1) provides that any person arriving in the State from Great Britain who, within the twenty-one days prior to his arrival, has been in any of the following premises or places in a foot and mouth disease infected area in Great Britain is prohibited from entering any similar premises in this country within twenty-one days of his arrival:— | ||
(a) any wholesale meat market, (b) any meat processing premises, (c) any artificial insemination station, (d) any creamery or milk processing premises, (e) any commercial cold store used for animal or milk products, (f) any buildings or land on which animals (as defined in Article 2) were present or to which such animals had access; | ||
(2) requires the owner or any person holding a position of responsibility in any of the premises or places mentioned to deny entry thereto to persons to whom the restrictions set out in the Order apply; and | ||
(3) revokes the Foot and Mouth Disease (Restriction on the Movement of Persons) Order, 1968, and the Foot and Mouth Disease (Restriction on the Movement of Persons) (Amendment) Order, 1968, subject to the provisions of Article 6 (2) of this Order. |
