INFECTIOUS DISEASES (MAINTENANCE) REGULATIONS, 1968.

The Minister for Health, in exercise of the powers vested in him by section 5 and subsection (5) of
section 44
of the
Health Act, 1947
(No. 28 of 1947) hereby makes the following Regulations:—
1. These Regulations may be cited as the Infectious Diseases (Maintenance) Regulations, 1968.
2. These Regulations shall come into operation on the 1st day of August, 1968.
3. The Infectious Diseases (Maintenance) Regulations, 1967 (
S.I. No. 189 of 1967
) are hereby revoked.
4. In these Regulations—

"the Act" means the
Health Act, 1947
(No. 28 of 1947);
|
| |
"outgoings" means the rent, ground rent, rates and purchase annuity payable in respect of premises and mortgage repayments relating to the purchase of premises;
|
| |
"receiving institutional services" means receiving institutional services from a health authority or pursuant to an arrangement made by a health authority under
section 10
of the
Health Act, 1953
(No. 26 of 1953);
|
| |
"person" means a person to whom section 44 of the Act applies by virtue of subsection (1) of that section, and
|
| |
"the payment" means the payment to be made by a health authority under subsection (3) of section 44 of the Act to or in respect of a person or his dependants.
5. (1) The payment shall be a weekly payment not exceeding—
|
| |
(a) the sum specified in Part One of the Schedule hereto which is appropriate to the person and
|
| |
(b) such of the increases specified in Part Two of the said Schedule as are appropriate.
|
| |
(2) Where a married woman whose husband is unable to make proper provision for the care of their family is undergoing treatment for an infectious disease to the satisfaction of the chief medical officer of the health authority in whose functional area she resides and a woman is employed with the approval of the health authority to take care of such family, the payment shall not exceed
|
| |
(a) where such married woman is ordinarily resident in a County Borough, the Borough of Dún Laoghaire or an urban district the population of which (as shown by the census of population which is for the time being the latest such census) exceeds seven thousand, twenty-two shillings, or
|
| |
(b) in any other case, seventeen shillings.

EXPLANATORY NOTE.
|
| |
The effect of these Regulations is to revoke the existing Regulations governing the payment of maintenance allowances to persons being treated for certain infectious diseases—the Infectious Diseases (Maintenance) Regulations, 1967 (
S.I. No. 189 of 1967
)—and to remake them with amendments providing, as from 1st August, 1968, for increases in the maximum allowances payable.

The infectious diseases for which maintenance allowances are payable are tuberculosis, acute anterior poliomyelitis, typhoid, diphtheria, paratyphoid A, paratyphoid B, typhus fever, dysentery, salmonella infection, scarlet fever and streptococcal sore throat.
