ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF TIPPERARY SOUTH RIDING) REGULATIONS, 1968.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) amended as regards the said section 46 by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations :—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Tipperary South Riding) Regulations, 1968.

2 Commencement.

2. These Regulations shall come into operation on the 1st day of November, 1968.

3 Interpretation.

3. In these Regulations save where the context otherwise requires

"the Act" means the Road Traffic Act, 1961 ;

"road" means a public road;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town;

"special speed limit" and "built-up area speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road.

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following :—

(a) ambulances,

(b) fire brigade vehicles and

(c) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocation.

7. Articles 5 and 6 of the Road Traffic (Speed Limits) Regulations, 1963 ( S.I. No. 18 of 1963 ) in so far as they relate to roads in the County of Tipperary South Riding are hereby revoked.

FIRST SCHEDULE

Roads declared not to be public roads in a built-up area for the purposes of Section 45 of the Road Traffic Act, 1961 .

1. The following roads in the Urban District of Carrick-on-Suir:—

(a) Tinvane or Kilonerry Boreen.

(b) The Glenbower Road for a distance of 25 yards from the Urban District boundary.

(c) The Ballyrichard Road for a distance of 870 yards from the Urban District boundary.

(d) The Cregg Road for a distance of 875 yards from the Urban District boundary.

(e) The Waterford (North) Road for a distance of 1,320 yards from the Urban District boundary.

(f) The Waterford (South) or Tramore Road between the Urban District boundary and a point 160 yards east of its junction with the road leading northwestward to Dillon Bridge.

(g) The main Dungarvan Road for a distance of 450 yards from the Urban District boundary.

(h) The Mothel Road for a distance of 335 yards from the Urban District boundary.

(i) The Coolnamuck Road for a distance of 1,060 yards from the Urban District boundary.

(j) The Clonmel Road for a distance of 910 yards from the Urban District boundary.

2. The following roads in the Urban District of Cashel:—

(a) The Clonmel Road where the said road is a perimeter road.

(b) The Cahir Road for a distance of 280 yards from the point where the Urban District boundary intersects the eastern side of the road.

(c) The Dublin Road for a distance of 170 yards from the Urban District boundary.

3. The following roads in the Borough of Clonmel:—

(a) St. Patrick's Road for a distance of 200 yards from the Borough boundary.

(b) The Haywood Road for a distance of 255 yards from the Borough boundary.

(c) The road leading from the Haywood Road to Glenconnor Cottages.

(d) The Dublin or Waterford Road between the Borough boundary and a point 625 yards south-west of its junction with Silver Spring Road.

(e) The Cahir Road between the Borough boundary and a point 100 yards north-west of its junction with the Marlfield Road.

4. The following roads in the town of Fethard:—

(a) The Cloneen Road for a distance of 275 yards from the town boundary.

(b) The Rosegreen or Redcity Road for a distance of 200 yards from the point where the town boundary intersects the southern side of the road.

(c) The Cashel Road between the town boundary and a point 220 yards from the point where the said boundary intersects the western side of the road.

(d) The Rocklow Road where the said road is a perimeter road.

5. The following roads in the Urban District of Tipperary:—

(a) Carrownreddy Road, Old Barracks Road.

(b) The Rosanna Road for a distance of 380 yards from the Urban District boundary.

(c) Boheranuisge where the said road is a perimeter road.

(d) The Cahir Road for a distance of 225 yards from the point where the Urban District boundary intersets the northern side of the road.

(e) The Scalaheen Road for a distance of 120 yards from the Urban District boundary.

(f) The perimeter road connecting the Galbally Road with Old Barracks Road.

(g) The Railway Road for a distance of 45 yards from its junction with Old Barracks Road.

(h) The Galbally Road for a distance of 270 yards from the Urban District boundary.

(i) The Emly Road for a distance of 500 yards from the point where the Urban District boundary intersects the southern side of the road.

(j) The Limerick Road for a distance of 255 yards from the Urban District boundary.

(k) The Bohercrow Road for a distance of 360 yards from the Urban District boundary.

(l) The Murgasty Road for a distance of 210 yards from the point where the Urban District boundary intersects the eastern side of the road.

SECOND SCHEDULE

Roads declared to be public roads in a built-up area for the purposes of Section 45 of the Road Traffic Act, 1961 .

1. The following roads at Ardfinnan:—

(a) The Terrace.

(b) The Goatenbridge Road between its junction with the Clonmel-Mitchelstown road and a point 255 yards north of its junction with the Lacken Road.

(c) The Clonmel-Mitchelstown road between a point 5 yards south-west of its junction with the Marlhill Road and a point 100 yards north-west of its junction with the Goatenbridge Road.

(d) The Newcastle Road for a distance of 25 yards from its junction with the Clonmel-Mitchelstown Road.

(e) The Cahir Road for a distance of 25 yards from its junction with the Clonmel-Mitchelstown road.

(f) The Castlequarter Road for a distance of 25 yards from its junction with the Clonmel-Mitchelstown road.

(g) The roadway at Mount Carmel connecting the Clonmel-Mitchelstown road with the Goatenbridge Road.

(h) The Monroe West Road for a distance of 25 yards from its junction with the Goatenbridge Road.

2. The following roads at Ballyclerehan (Clerehan):—

(a) The Clonmel-Cashel road between a point 300 yards east of its junction with the Newchapel Road and a point 170 yards north-west of the said junction.

(b) The Cahir Road for a distance of 25 yards from its junction with the Clonmel-Cashel road.

(c) The Newchapel Road for a distance of 50 yards from its junction with the Clonmel-Cashel road.

3. The following roads at Bansha:—

(a) The Tipperary-Cahir road between a point 60 yards north of its junction with the Aughnagower Road and a point 250 yards south of its junction with the Glen of Aherlow Road.

(b) The Aughnagower Road for a distance of 70 yards from its junction with the Tipperary-Cahir road.

(c) The Glen of Aherlow Road for a distance of 200 yards from its junction with the Tipperary-Cahir road.

4. The following roads at Cahir:—

All roads (other than (i) the Dublin or Cashel Road between a point 135 yards north of the Railway Bridge and a point 395 yards north of the said Bridge, (ii) the Clonmel Road between a point 100 yards north-east of its junction with Market Street and a point 315 yards north-east of the said junction and (iii) the Cork Road between a point 300 yards south-west of its junction

with Barrack Street and a point 1,050 yards south-west of the said junction) in the area enclosed by a line commencing at a point on the Dublin or Cashel Road 395 yards north of the Railway Bridge and drawn thence in straight lines successively to the following points :—

(a) a point on the Clonmel Road 315 yards north-east of its junction with Market Street,

(b) a point on Pearse Street 150 yards south-east of its junction with Market Street,

(c) a point on Chapel Street 295 yards south of its junction with Pearse Street,

(d) a point on the Cork Road 1,050 yards south-west of its junction with Barrack Street,

(e) a point on the Tipperary Road 1,100 yards north-west of its junction with Mountain Road,

and from the last-mentioned point in a straight line to the commencement point on the Dublin or Cashel Road.

5. The following roads at Cappawhite:

(a) The Cashel-Cappamore road between a point 205 yards east of its junction with the Hollyford Road and a point 270 yards west of its junction with the Donohill Road.

(b) The Donohill Road for a distance of 200 yards from its junction with the Cashel-Cappamore road.

(c) The Hollyford Road for a distance of 250 yards from its junction with the Cashel-Cappamore Road.

6. The following roads at Clogheen:

(a) Creamery Lane, Clogheen Market, Cockpit Lane, the Lios Mhuire Housing Scheme Road, Chapel Lane.

(b) The Clonmel-Mitchelstown road between a point 250 yards south of its junction with the Cahir Road and a point 50 yards west of its westernmost junction with the Lios Mhuire Housing Scheme Road.

(c) The Lismore Road between its junction with the Clonmel- Mitchelstown road and its junction with the Newcastle Road.

7. The following roads adjacent to the Borough of Clonmel:—

(a) The Powerstown Road, the Old Fethard Road, the Western Road.

(b) Tivoli Road for a distance of 405 yards from the boundary of the Borough of Clonmel.

(c) The Fethard Road for a distance of 400 yards from the boundary of the Borough of Clonmel.

(d) The Glenconnor Road where the said road is a perimeter road.

8. The following roads at Emly:—

(a) The Tipperary-Knocklong road between a point 250 yards south-west of its junction with the Gallbally Road and a point 250 yards south-east of its junction with the Pallas-green Road.

(b) The cul-de-sac road leading south from Emly in the direction of the townland of Coolboy.

9. The following roads at Golden:—

(a) The Cashel-Tipperary road between a point 220 yards north-east of its junction with the Newinn Road and a point 430 yards south-west of the said junction.

(b) The Newinn Road for a distance of 180 yards from its junction with the Cashel-Tipperary road and the road connecting this part of the Newinn Road with the Cashel-Tipperary road.

(c) The Ballycarron Road for a distance of 60 yards from its junction with the Cashel-Tipperary road.

(d) The road leading from the Cashel-Tipperary road to the Catholic Church at Golden.

10. The following roads at Killenaule:—

(a) The Ballingarry Estate Road.

(b) The Clonmel-Urlingford road between a point 200 yards south of its junction with Boherlug and a point 340 yards north of its junction with the Ballingarry Road.

(c) Boherlug for a distance of 160 yards from its junction with the Clonmel-Urlingford road.

(d) The Ballingarry Road for a distance of 850 yards from its junction with the Clonmel-Urlingford road.

(e) St. Mary's Road for a distance of 300 yards from its junction with the Ballingarry Road.

(f) The northwesterly continuation of Bailey Street for a distance of 25 yards from its junction with the Clonmel-Urlingford road.

11. The following roads at Newinn:—

(a) Our Lady's Road.

(b) The Golden Road for a distance of 370 yards from its junction with the Dublin-Cork road.

(c) The Clonmel Road for a distance of 230 yards from its junction with the Dublin-Cork road.

(d) The Rosegreen Road for a distance of 60 yards from its junction with the Clonmel Road.

12. The following roads at Rosegreen:—

(a) The Clonmel-Cashel road between a point 215 yards south-east of its junction with the Newinn Road and a point 260 yards north-west of the said junction.

(b) The Newinn Road for a distance of 50 yards from its junction with the Clonmel-Cashel road.

(c) The Fethard Road for a distance of 40 yards from its junction with the Clonmel-Cashel road.

13. The following roads adjacent to the Urban District of Tipperary:—

(a) The Cashel Road for a distance of 250 yards from the boundary of the Urban District of Tipperary.

(b) The Corroge Road for a distance of 45 yards from its junction with the Cashel Road.

THIRD SCHEDULE

Roads in respect of which a special speed limit of 40 miles per hour is prescribed.

1. The following roads at Ballyporeen:—

(a) The Clonmel-Mitchelstown road between a point 270 yards east of its junction with the Burncourt Road and a point 400 yards west of the said junction.

(b) The Burncourt Road for a distance of 410 yards from its junction with the Clonmel-Mitchelstown road.

(c) The Carrigavisteal Road for a distance of 25 yards from its junction with the Burncourt Road.

(d) The Araglen Road for a distance of 240 yards from its junction with the Clonmel-Mitchelstown road.

2. The following road at Cahir:—

The Cork Road between a point 300 yards south-west of its junction with Barrack Street and a point 1,050 yards south-west of the said junction.

3. The following roads in and adjacent to the Borough of Clonmel:—

(a) The Dublin or Waterford Road between its intersection by the boundary of the Borough of Clonmel and a point 625 yards south-west of its junction with Silver Spring Road.

(b) The Cahir Road between a point 100 yards north-west of its junction with the Marlfield Road and a point 100 yards north-west of its junction with the Western Road.

4. The following roads at Dundrum:—

(a) The Thurles-Tipperary Road between a point 180 yards north-east of its junction with the Cashel Road and a point 50 yards south-west of its junction with the Annacarty Road.

(b) The Cashel Road for a distance of 330 yards from its junction with the Thurles-Tipperary road.

(c) The Gortussa Road for a distance of 70 yards from its junction with the Thurles-Tipperary road.

(d) The Annacarty Road for a distance of 50 yards from its junction with the Thurles-Tipperary road.

(e) The Ballintemple Road for a distance of 50 yards from its junction with the Thurles-Tipperary road.

5. The following roads at Grangemockler (Mullennaglogh):

(a) The Dublin-Clonmel road between a point 85 yards north of its junction with the Creamery Road and a point 270 yards south of the said junction.

(b) The Creamery Road for a distance of 140 yards from its junction with the Dublin-Clonmel road.

6. The following roads at Kilsheelan:—

(a) The Carrick-on-Suir-Clonmel road between a point 470 yards east of its junction with the Fethard Road and a point 450 yards west of the said junction.

(b) The Fethard Road for a distance of 120 yards from its junction with the Carrick-on-Suir-Clonmel road.

(c) The Back Road to Carrick-on-Suir for a distance of 25 yards from its junction with the Carrick-on-Suir-Clonmel road.

7. The following roads at Monard:—

(a) The Limerick-Tipperary road between a point 200 yards north-west of its junction with the Cullen Road and a point 150 yards south-east of the said junction.

(b) The Cullen Road for a distance of 30 yards from its junction with the Limerick-Tipperary road.

(c) The Monard Road for a distance of 110 yards from its junction with the Limerick-Tipperary road.

8. The following roads at Newinn:—

The Dublin-Cork road between a point 295 yards north of its junction with the Golden Road and a point 400 yards south of the said junction.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) Regulations, 1963 and 1965, in their application to the County of Tipperary South Riding and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by Section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to be subject to that speed limit.

The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule for all mechanically propelled vehicles.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations.
