LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) ACT, 1963, (EXEMPTED DEVELOPMENT) (AMENDMENT) REGULATIONS, 1968.

The Minister for Local Government in exercise of the powers conferred on him by sections 4 and 10 of the Local Government (Planning and Development) Act, 1963 , (No. 28 of 1963), hereby makes the following regulations:—

1. These Regulations may be cited as the Local Government (Planning and Development) Act, 1963 (Exempted Development) (Amendment) Regulations, 1968.

2. The Local Government (Planning and Development) Act, 1963 (Exempted Development) Regulations, 1967, are hereby amended as follows:—

(a) by the insertion after "alteration" in subparagraph (ix) and subparagraph (x) of paragraph (a) of sub-article (5) of article 3 of "(other than an alteration of the type specified in Class 8 of Part 1 of the Schedule to these Regulations)",

(b) by the addition to article 3 of the following sub-article—

" (6) Sub-paragraph (vii) of paragraph (a) of sub-article (5) shall not apply where the development consists of the construction by any electricity undertaking of an overhead line or cable not exceeding one hundred meters in length for the purpose of conducting electricity from a distribution or transmission line to any premises",

(c) by the insertion in sub-paragraph (i) of paragraph (b) of sub-article (5) of article 3 after the number "17" of "20A",

(d) by the insertion in Column 1 of Part 1 of the Schedule before class 21 of the following:—

" CLASS 20A

The carrying out by any electricity undertaking of development consisting of construction of overhead transmission or distribution lines for conducting electricity at a voltage not exceeding 10 KV ".

EXPLANATORY NOTE.

These Regulations make minor amendments in the Local Government (Planning and Development) Act, 1963 (Exempted Development) Regulations, 1967, in the main relating to electricity undertakings.
