ROAD VEHICLES (REGISTRATION AND LICENSING) (AMENDMENT) (No. 2) REGULATIONS, 1976. | ||
The Minister for Local Government in exercise of the powers conferred on him by section 12 of the Roads Act, 1920, as amended by section 77 of the Finance Act, 1976 , (No. 16 of 1976) hereby makes the following Regulations:— 1. (1) These Regulations may be cited as the Road Vehicles (Registration and Licensing) (Amendment) (No. 2) Regulations, 1976. | ||
(2) These Regulations and the Road Vehicles (Registration and Licensing) Regulations, 1958 to 1976, shall be construed together as one and may be cited together as the Road Vehicles (Registration and Licensing) Regulations, 1958 to 1976. | ||
(3) These Regulations shall come into operation on the 1st day of September, 1976. 2. The Road Vehicles (Registration and Licensing) Regulations, 1958 ( S.I. No. 13 of 1958 ) are hereby amended by the substitution for sub-article (1) of article 14 of the following sub-article:— | ||
"(1) ( a ) Where a licence issued by a licensing authority under these Regulations has been lost, destroyed, mutilated, discoloured or defaced or the figures or particulars thereon have become illegible the owner of the vehicle shall apply to the licensing authority for the issue to him of a duplicate licence and the licensing authority upon being satisfied as to such loss, destruction, mutilation, discolouration, defacement or illegibility and upon the receipt of the licence (if available) shall issue a duplicate licence marked as a duplicate on payment of a fee of two pounds or the annual rate of vehicle excise duty charged, levied and paid in respect of the vehicle under section 1 of the Act of 1952 whichever is the less; | ||
( b ) Where a registration book issued by a licensing authority under these Regulations has been lost, destroyed, mutilated, discoloured or defaced or the figures or particulars thereon have become illegible the owner of the vehicle shall apply to the licensing authority for the issue to him of a duplicate registration book and the licensing authority upon being satisfied as to such loss, destruction, mutilation, discolouration, defacement or illegibility and upon the receipt of the registration book (if available) shall issue a duplicate registration book marked as a duplicate on payment of a fee of two pounds; | ||
and the duplicate licence or registration book so issued shall have the same effect as the original licence or registration book." | ||

EXPLANATORY NOTE. | ||
The Regulations provide that the fee payable to a licensing authority for the issue of a duplicate Registration Book in respect of a mechanically propelled vehicle shall, with effect from the 1st September, 1976, be £2. The Regulations also provide that as from the 1st September, 1976 the fee payable to a licensing authority on a duplicate tax disc issued in respect of a mechanically propelled vehice shall be £2 except in the case of vehicles where the annual rate of road tax is less than £2; in such cases the fee for a duplicate licence will be the same as for the issue of the original tax disc. |
