REGISTRATION OF ELECTORS (AMENDMENT) REGULATIONS, 1977.

The Minister for the Environment, in exercise of the powers conferred on him by section 7 of the Electoral Act, 1963 (No. 19 of 1963) as amended by section 4 of the Juries Act, 1976 (No. 4 of 1976) and as adapted by the Local Government (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 269 of 1977 ) and by section 3 of the European Assembly Elections Act, 1977 (No. 30 of 1977), hereby makes the following Regulations, a draft of which has been approved by a resolution by each House of the Oireachtas:

1. These Regulations may be cited as the Registration of Electors (Amendment) Regulations, 1977.

2. In these Regulations—

"the Principal Regulations" means the Registration of Electors and Juries Acts (Specification of Dates) Regulations, 1963 ( S.I. No. 169 of 1963 );

"European Assembly constituency" means a constituency for which candidates may be elected under the European Assembly Elections Act, 1977 .

3. The Principal Regulations and these Regulations shall be construed as one and may be cited together as the Registration of Electors Regulations, 1963 and 1977.

4. Article 3 (1) of the Principal Regulations is hereby amended by,

( a ) the insertion in the definition of "elector" after "a Dáil elector" of ", a European Assembly elector";

( b ) the substitution for the definition of "the register" of the following: " 'the register' means, as the context may require, the register of Dáil, European Assembly and local government electors or the register of Dáil electors or the register of European Assembly electors or the register of local government electors and, where the context so requires, includes the postal voters list;"; and

( c ) the deletion of the definition of "jury district".

5. Article 5 (3) of the Principal Regulations is hereby revoked.

6. Article 8 (3) of the Principal Regulations is hereby amended by the insertion after paragraph (c) of the following paragraph—

"(d) to make a statutory declaration that he is a national of a Member State of the European Communities other than Ireland, and".

7. Article 9 (1) of the Principal Regulations is hereby amended by the insertion in paragraph (a) after "the Minister," of

"each representative in the European Assembly for the European Assembly constituency in which the registration area is contained,".

8. Article 13 of the Principal Regulations is hereby amended by the deletion of paragraphs (b) and (c) and by the substitution for paragraph (a) of the following paragraph—

"(a) a person is not registered more than once as an elector.".

9. Article 16 (4) of the Principal Regulations is hereby amended by the insertion in paragraph (a) after "the Minister," of "each representative in the European Assembly for the European Assembly constituency in which the registration area is contained,".

10. Article 18 (4) of the Principal Regulations is hereby amended by the insertion after paragraph (a) of the following paragraph—

"(aa) one copy of the register for the registration area to each candidate duly nominated at a European Assembly election for the European Assembly constituency in which the registration area is contained, and"

and by the addition after paragraph (b) of the following paragraph—

"(c) such number of copies of the register for the registration area as the returning officer or local returning officer at a European Assembly election requires for the purpose of his duties at such election.".

11. Article 21 of the Principal Regulations is hereby revoked.

12. The following forms are hereby substituted for Form R.F.1 and Form R.F.2, respectively, in the First Schedule to the Principal Regulations:

EXPLANATORY NOTE.

These Regulations provide for the identification on the register of electors of persons entitled to vote at elections to the Assembly of the European Communities. The Regulations are consequent on the Council Decision dated 20th September, 1976 and the Act annexed thereto relating to direct elections to the Assembly (Official Journal No. L278).

The Regulations also make minor amendments to the Registration of Electors and Juries Acts (Specification of Dates) Regulations, 1963 consequential on the enactment of the Local Elections Act, 1972 and the Juries Act, 1976 .
