DISTRICT COURT (FEES) ORDER, 1978.

I, GERARD COLLINS, Minister for Justice, in exercise of the powers conferred on me by section 65 of the Courts of Justice Act, 1936 (No. 48 of 1936), with the consent of the Minister for Finance, hereby order as follows:

1. This Order may be cited as the District Court (Fees) Order, 1978.

2. This Order shall come into operation on the 8th day of March, 1978.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. (1) The fees set out in the second column of the Schedule shall be charged in the District Court Offices in respect of the items set out in the first column.

(2) The District Court (Fees) Order, 1970 ( S.I. No. 236 of 1970 ), is hereby revoked.

5. (1) In this article—

"maintenance order" means an order made under section 1 of the Married Women (Maintenance in case of Desertion) Act, 1886 (whether or not such order has been varied), and " maintenance proceedings " means any proceedings authorised by that Act to be taken by any person, any proceedings for the enforcement of a maintenance order and any appeal to the Circuit Court arising out of any such proceedings;

"affiliation order" means an order made under section 3 of the Illegitimate Children (Affiliation Orders) Act, 1930 (No. 17 of 1930) (whether or not such order has been varied), and " affiliation proceedings " means any proceedings authorised by that Act to be taken by any person, any proceedings for the enforcement of an affiliation order and any appeal to the Circuit Court arising out of any such proceedings.

(2) No fee shall be payable under this Order in any maintenance proceedings or affiliation proceedings—

( a ) by the applicant for a maintenance order or affiliation order, or

( b ) by a person to whom a sum or a weekly sum is payable by virtue of a maintenance order or affiliation order or a person claiming to be the proper person to receive such a weekly sum.

6. (1) This article applies to the following persons—

( a ) a state solicitor,

( b ) a person employed in the Civil Service of the State as a solicitor,

( c ) a member of the Garda Síochána,

( d ) a person authorised by a Minister of State to engage in the relevant prosecution or proceedings,

( e ) a witness in the relevant prosecution or proceedings, other than a witness on behalf of the defendant.

(2) No fee shall be payable by or in respect of a person to whom this article applies when he is engaged—

( a ) in a prosecution at the suit of the Attorney General or in any other proceedings at the suit of the Attorney General,

( b ) in a prosecution by a member of the Garda Síochána,

( c ) in proceedings by a Minister of State, other than the Minister for Posts and Telegraphs, or

( d ) in proceedings instituted by, or on the direction of, the Revenue Commissioners.

7. The fee in relation to each item shall be taken by means of a stamp affixed to or impressed on the document indicated in the third column of the Schedule.

8. Where the fee is denoted by means of an adhesive stamp, the stamp shall be cancelled by the Clerk of the District Court Office who issues or receives the document.

EXPLANATORY NOTE.

This Order increases the fees at present chargeable in District Court Offices. The present fees are prescribed in the District Court (Fees) Order, 1970, which is revoked by this Order.

The Order also provides that the fees in all cases may be taken by either adhesive stamps or impressed stamps.

It should be noted that under section 25 of the Rent Restrictions Act, 1960 , no court fees are payable by the tenant in any proceedings (including any appeal or case stated) under Part III of that Act.
