HOUSING AUTHORITIES (LOANS FOR ACQUISITION OR CONSTRUCTION OF HOUSES) (AMENDMENT) REGULATIONS, 1978.

The Minister for the Environment, in exercise of the powers conferred on him by sections 5 and 39 of the Housing Act, 1966 (No. 21 of 1966) with the consent of the Minister for Finance hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Housing Authorities (Loans for Acquisition or Construction of Houses) (Amendment) Regulations, 1978.

(2) The Housing Authorities (Loans for Acquisition or Construction of Houses) Regulations, 1972 to 1977 and these Regulations shall be construed together and may be cited as the Housing Authorities (Loans for Acquisition or Construction of Houses) Regulations, 1972 to 1978.

2. Sub-article (1) of article 3 of the Housing Authorities (Loans for Acquisition or Construction of Houses) Regulations, 1972 ( S.I. No. 29 of 1972 ) as substituted by the Housing Authorities (Loans for Acquisition or Construction of Houses) (Amendment) Regulations, 1973 ( S.I. No. 250 of 1973 ) is hereby amended by the addition thereto of the following paragraph:—

"(i) in the case of a loan for the construction of a house the foundations of which were laid on or after the 1st day of September, 1978 or in the case of a loan for the acquisition of a house the contract for the acquisition of which was entered into on or after the 1st day of September, 1978, £9,000 or 95% of the value of the house excluding from that value the amount of any grant under any enactment, whichever is less."

In the case of a loan for the construction of a house the foundations of which were laid on or after the 1st day of September, 1978 or in the case of a loan for the acquisition of a house the contract for the acquisition of which was entered into on or after the 1st day of September, 1978 the provisions of paragraph (h) of sub-article (1) of article 3 of the Housing Authorities (Loans for Acquisition or Construction of Houses) Regulations, 1972 as inserted in the said sub-article by the Housing Authorities (Loans for Acquisition or Construction of Houses) (Amendment) (No. 2) Regulations, 1977 ( S.I. No. 293 of 1977 ) shall have effect as if the figure of "£9,000" were substituted for the figure of "£7,500" specified in the said article.

EXPLANATORY NOTE.

These Regulations amend the Housing Authorities (Loans for Acquisition or Construction of Houses) Regulations, 1972 to 1977.

The Regulations provide for an increase in the amount of a loan from £7,000 to £9,000 for the construction of a house where the foundations were laid on or after 1st September, 1978 or for the acquisition of a house where the contract for such acquisition was entered into on or after that date.

The Regulations also provide for an increase from £7,500 to £9,000 in the maximum amount of a loan available to—

( a ) the tenant or tenant purchaser of a local authority house who, on receiving the loan, will surrender his tenancy or interest, and

( b ) a family of not less than three persons who had applied to, and been accepted by, a housing authority at least one year before making application for the loan as being in need of rehousing because of the dangerous, unfit or overcrowded conditions of their existing accommodation and because their financial circumstances were such that they would not have been able to provide proper dwelling accommodation from their own resources.
