MEMBERS OF THE OIREACHTAS AND MINISTERIAL AND PARLIAMENTARY OFFICES (ALLOWANCES AND SALARIES) ORDER, 1979.

The Government, in exercise of the powers conferred on them by section 3A of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938) (inserted by section 5 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973)), as amended by section 4 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977), and section 8A of the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938) (inserted by section 11 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973)), as amended by section 7 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 , hereby make the following Order:

1. This Order may be cited as the Members of the Oireachtas and Ministerial and Parliamentary Offices (Allowances and Salaries) Order, 1979.

2. In this Order—

"the Act of 1938" means the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938);

"the Act of 1973" means the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973);

"the Act of 1977" means the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 No. 29 of 1977).

3. The allowance payable monthly under section 3 of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938), as amended by section 4 of the Act of 1977 to each member of Dáil Éireann, and the allowance so payable under the said section 3 as so amended, to each member of Seanad Éireann shall be and be deemed to have been increased—

( a ) with effect from the 26th day of June, 1978, by 8½%,

( b ) with effect from the 1st day of March, 1979, by 2%,

( c ) with effect from the 1st day of June, 1979, by 9%.

4. The annual sum payable under section 9A of the Act of 1938 (inserted by section 13 of the Act of 1973) or section 10 of the Act of 1938, as amended by section 14 of the Act of 1973, by way of allowance for expenses,

( a ) with effect from the 26th day of June, 1978, shall be and be deemed to have been,

(i) in case any such sum is payable under subsection (1) of the said section 9A, £21,493,

(ii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 9A, £15,045,

(iii) in case any such sum is payable under paragraph (b) of subsection (2) of the said section 9A, £6,448,

(iv) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 9A, £10,747,

(v) in case any such sum is payable under paragraph (b) of the said subsection (3), £10,747, divided in the manner specified in that paragraph,

(vi) in case any such sum is payable under subsection (1) of the said section 10, £53,743,

(vii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 10, £47,619,

(viii) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (2), £21,124,

(ix) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 10, £26,872, and

(x) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (3), £26,872, divided in the manner specified in that paragraph,

( b ) with effect from the 1st day of March, 1979, shall be and be deemed to have been,

(i) in case any such sum is payable under subsection (1) of the said section 9A, £21,923,

(ii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 9A, £15,346,

(iii) in case any such sum is payable under paragraph (b) of the said subsection (2), £6,577.

(iv) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 9A, £10,962,

(v) in case any such sum is payable under paragraph (b) of the said subsection (3), £10,962, divided in the manner specified in that paragraph,

(vi) in case any such sum is payable under subsection (1) of the said section 10, £54,818,

(vii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 10, £48,371,

(viii) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (2), £21,446,

(ix) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 10, £27,409,

(x) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (3), £27,409, divided in the manner specified in that paragraph,

( c ) with effect from the 1st day of June, 1979, shall be and be deemed to have been,

(i) in case any such sum is payable under subsection (1) of the said section 9A, £23,896,

(ii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 9A, £16,727,

(iii) in case any such sum is payable under paragraph (b) of the said subsection (2), £7,169,

(iv) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 9A, £11,949,

(v) in case any such sum is payable under paragraph (b) of the said subsection (3), £11,949, divided in the manner specified in that paragraph,

(vi) in case any such sum is payable under subsection (1) of the said section 10, £59,752,

(vii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 10, £51,824,

(viii) in case any such sum is payable under paragraph (b) of the last mentioned subsection (2), £22,926,

(ix) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 10, £29,876,

(x) in case any such sum is payable under paragraph (b) of the last mentioned subsection (3), £29,876, divided in the manner specified in that paragraph.

5. (1) Each of the annual sums specified in paragraph (2) of this Article shall be and be deemed to have been increased—

( a ) with effect from the 26th day of June, 1978, by 8½%,

( b ) with effect from the 1st day of March, 1979, by 2%,

( c ) with effect from the 1st day of June, 1979, by 9%,

(2) The annual sums referred to in paragraph (1) of this Article are—

( a ) any annual sum payable by way of salary under subsection (1) (inserted by section 7 of the Act of 1973) or subsection (2) (inserted by section 6 of the Act of 1977) of section 3 of the Act of 1938,

( b ) the annual sum so payable under section 4 (1) (b) of the Act of 1938 (inserted by section 8 of the Act of 1973),

( c ) any annual sum so payable under section 5 (1) of the Act of 1938 (inserted by section 9 of the Act of 1973), and

( d ) any annual sum so payable under section 6 (1) of the Act of 1938 (Inserted by section 10 of the Act of 1973).

(3) The annual sum payable by way of salary under section 4 (1) (a) of the Act of 1938 (inserted by section 8 of the Act of 1973) shall be and be deemed to have been increased—

( a ) with effect from the 26th day of June, 1978, by 8½%,

( b ) with effect from the 1st day of March, 1979, by 2%,

( c ) with effect from the 1st day of June, 1979, to £15,191.

6. Articles 3 (b), 4 and 5 (b) of the Members of the Oireachtas and Ministerial and Parliamentary Offices (Allowances and Salaries) Order, 1978, ( S.I. No. 129 of 1978 ), and Article 3 of the Parliamentary Offices (Allowances) Order, 1978, ( S.I. No. 365 of 1978 ), shall cease to have effect.

(2) Subparagraph (1) of this Article shall be deemed to have commenced on the 26th day of June, 1978.

EXPLANATORY NOTE.

This order gives to members of the Oireachtas and Office Holders increases recommended by the Review Body on Higher Remuneration in the Public Sector and increases the sums payable to leaders of qualified Parties in Dáil Éireann. It also applies certain National Agreement increases.
